List of motorcycle club bans in Germany

The list of motorcycle club bans in Germany lists all the prohibition proceedings that have taken place so far that have affected a motorcycle club or an outlaw motorcycle gang .

Criminal law background

From a legal perspective, motorcycle clubs are to be treated in accordance with association law , even if the clubs do not declare themselves as associations. A ban can take place on the basis of Article 9 (2) of the Basic Law. For this purpose, a prohibition order according to § 3 Paragraph I of the Association Act (VereinsG) is necessary, which can be issued by the Ministry of the Interior of the respective state or a higher state authority. For this purpose, the competent authority must provide evidence that the joint purpose or certain joint activities of the motorcycle club are contrary to criminal law. The findings of the public prosecutor's offices and the investigating police authorities often serve as the basis for such a ban.

In addition, there is usually a charge according to § 129 StGB (formation of a criminal organization). As a consequence of a ban, the organization's property is confiscated . In addition, it is forbidden for former members to openly show their club membership. This means, among other things, that their habit may no longer be worn. The complete transfer of a chapter to another club of the same name or a start-up is also prohibited, as this would create a substitute organization.

It is also possible to obtain a ban at a higher level (federal level). This then affects the entire club with all chapters. However, this is only possible if the entirety of the club could be proven to have committed an offense under Section 129 of the Criminal Code. The first ban concerned the Satudarah MC , which was announced on February 24, 2015 by the Federal Minister of the Interior , Thomas de Maizière . There was sufficient evidence that the Dutch parent club MC Satudarah Maluku directed criminal activities in Germany.

Recently, the so-called supporter clubs , which are viewed as sub-organizations of the club, have also been banned with the larger clubs .
