In the murder case of Mia V. on December 27, 2017 in Kandel ( Rhineland-Palatinate ), an Afghan refugee who had entered the country the year before as an unaccompanied minor stabbed his 15-year-old German ex-girlfriend. The perpetrator was for murder and assault on juvenile justice to a sentence convicted of eight years and six months.

prehistory

Abdul D. came to Germany in April 2016 and stated that he was an Afghan citizen. He applied for asylum and was classified in Frankfurt as an unaccompanied minor refugee after an inspection and initial medical screening . His asylum application was rejected in February 2017; he was also given no refugee or other protection status. Because he was classified as a minor , he was not deported. D. was initially registered in Frankfurt am Main . He was then handed over to the care of the youth welfare office in Germersheim , housed in a youth welfare facility in Wörth am Rhein and attended the comprehensive school in neighboring Kandel. From September 2017 he was moved to a supervised youth living group in Neustadt an der Weinstrasse , but continued to go to school in Kandel, which is 34 km away. D. appeared to the police several times, among other things because of a schoolyard brawl.

D. and the victim are said to have been a couple for several months before the girl separated from the later perpetrator in early December 2017. As a result, D. had stalked the girl, harassed her and threatened her over the phone and via social networks . He threatened to publish nude pictures of her and to ambush her. The girl finally filed a complaint against D. with the Wörth police station on December 15 for insulting , coercion and threats , and again her father on December 17; the police then spoke to the threats by telephone . On December 18, D. was visited by two police officers in the Integrated Comprehensive School Kandel and warned in the presence of two of his supervisors. The same day the police informed the official guardian of the criminal charges. The youth welfare office later denied having been informed about the threat to the girl. The police pointed out that the telephone conversations made with D's guardian on December 18 and 19, 2017 had been documented.

On the morning of the day the perpetrator was again visited and summoned by police officers in Neustadt after he had failed to comply with several written summons .

Sequence of events

On the afternoon of December 27, 2017, the perpetrator and the later victim first met at the train station; then the perpetrator followed the victim to a supermarket, where he bought a bread knife about eight inches long . He followed the victim to a drugstore and stabbed him several times in the upper body around 3:20 p.m. without warning. According to the autopsy result, one of the knife wounds hit the heart and was fatal. The perpetrator was held in the store by employees and customers. He was initially due to the strong suspicion of manslaughter in custody taken; On January 16, the public prosecutor's office in Landau announced that it would classify the act as murder because of the insidious manner in which it was committed .

Based on his own age information in the asylum procedure, the authorities initially assumed that D. was 15 years old at the time of the crime; this age was checked during the investigation by the public prosecutor's office. According to a medical report, the perpetrator was probably 20 years old, at most 21 years old and at least 17.5 years old at the time of the offense. According to the principle of in dubio pro reo, the court therefore assumed that the defendant was a minor at the time of the offense.

The criminal trial against the accused began on June 18, 2018 in camera before the youth chamber of the Landau Regional Court in the Palatinate . On September 3, 2018, the perpetrator was to juvenile justice for murder and injury to a prison sentence condemned by eight and a half years. The public prosecutor's office and co-plaintiffs had demanded the maximum sentence of ten years, the defense had pleaded for a sentence of seven years and six months in prison for manslaughter . The criminal defense attorney for the offender declared that he waived his right to appeal . Death of the perpetrator

In view of the circumstances, a political discussion arose. The Bavarian Interior Minister Joachim Herrmann ( CSU ) demanded "a strict regulation for a medical age check of all arriving refugees who cannot be clearly identified as children". The FDP Federal Chairman Christian Lindner spoke out in favor of the deportation of “criminal underage asylum seekers”, if this was possible in the respective case. The then Saarland Prime Minister Annegret Kramp-Karrenbauer (CDU) called for a nationwide procedure for determining the age of “unaccompanied minor refugees” after the death. She pointed out that medical examinations in Saarland found that 35% of the UMF were actually adults. The domestic policy spokesman for the Union parliamentary group, Stephan Mayer (CSU), made a similar statement . The Prime Minister of Rhineland-Palatinate Malu Dreyer (SPD) said she saw no need for changes. Youth welfare offices should only arrange a medical examination in cases of doubt. The German Medical Association rejected x-ray examinations to determine the age of the UMF. These are an interference with human welfare and are only permissible in criminal proceedings . The German Society for Forensic Medicine accused the German Medical Association that the allegations were "rationally incomprehensible" and that the study situation was presented in a distorted manner.

The Frankfurter Allgemeine Zeitung published a comment on its front page in which, referring to the act, the “defensive democracy” was questioned. Among other things, the Bild newspaper very quickly published the origin and asylum status of the suspect. One headline read: "Afghan (15) stabs German girl (15)". The editor-in-chief of Welt am Sonntag , Peter Huth , demanded in a comment that the citizens should learn all the details of the case, including about the suspect. The journalist Tomas Avenarius commented in the Süddeutsche Zeitung that anyone who wants to integrate migrants must consider their origins and their values ​​soberly in order to develop integration models “that go beyond German courses and carpentry apprenticeships”.

The Tagesschau initially did not report on the case on the day of the crime, but on the following day in its 8 p.m. main edition. The second editor-in-chief of ARD-aktuell , Marcus Bornheim , said on Facebook that even if the act was horrific, one usually does not report on relationship acts , especially since in this case it was about young people who needed special protection. The SWR has also already reported and will continue to monitor the case.

In the Hamburger Abendblatt , Matthias Iken criticized the media coverage that “nobody wants to be shaken by his view of the world, but rather read what strengthens his attitude”. The Kandel case shows how far we are from this utopia. ”The taz criticized the fact that the case was reported completely differently and more intensively than on comparable cases of relationship crimes. "If other standards are applied to an Afghan, it has a name: racism ." It is not the job of the press to mourn every victim of the approximately 150 acts of relationship each year. However, one must protect against political instrumentalization of the victims.

The Frankfurter Allgemeine Zeitung again criticized the approach of the Tagesschau and that of the chairman of the German Association for Juvenile Courts and Juvenile Justice Aid , Theresia Höynck , as well as the commentary of the taz . Michael Hanfeld criticized the hasty assumption of the attributes of minors and offenses because neither of these two attributions has been conclusively clarified so far, as well as the orientation of the reporting on the perpetrator and his previous history. The Rheinpfalz complained that "on the Internet [...] hatred by far outweighs grief". On June 4, 2018, the ARD broadcast the documentary The Girl and the Refugee about the case in Kandel and a similar one in Darmstadt, in which the attacked girl survived seriously injured. Memorial events

On New Year's Day 2018, around 350 people attended the ecumenical memorial service for the killed 15-year-old in the Kandler St. Pius Church . On January 10th there was a minute's silence, which the student council had called for. The burial of the victim and a funeral service in the Kandler St. Georgs Church took place one day later.

Demonstrations and protests

In the aftermath of the crime, there were various demonstrations by right-wing populist and right-wing extremist groups and counter-demonstrations in Kandel:

AfD

On December 30th, around 200 people responded to a call by the AfD . Two groups (15 people from the Greens and another group) demonstrated against it.

NPD

On January 6, 2018, the NPD held a rally with 14 participants. Between 100 and 150 people took part in a counter-demonstration.

"Kandel Women's Alliance" / "The March 2017"

After the fact, the founders organized by the far-right and rich grassroots movement "March 2017", Marco Kurz, under the name "Mrs. alliance Kandel" several demonstrations. In a leaflet distributed in advance in Kandel, the “Frauenbündnis Kandel” had given the impression that it consisted of women and mothers from Kandel, but it was not known locally. On January 2, around 400 sympathizers marched through Kandel. The participants shouted slogans such as “Merkel must go!” At the scene of the crime, there were arguments with a group of around 30 counter-demonstrators who demonstrated with colorful umbrellas for a colorful Germany. The police had to separate the two groups. According to the Rheinpfalz it was in the silent march participants next to "unsuspecting Kandelern well" to "very many members of the right scene from the Palatinate, Baden and beyond." On January 28, around 1,000 participants attended another demonstration, including around 100 people from the right-wing extremist scene. At the same time there was a counter-demonstration by the “Alliance to Stand Up Against Racism South Palatinate” with around 150 participants.

On March 3, Kurz called for another demonstration that took place in the context of the separate demonstration by the alliance “Kandel is everywhere” mentioned below.

Alliance "Kandel is everywhere"

The AfD member of the Baden-Württemberg state parliament, Christina Baum , called for demonstrations in Kandel under the heading “Kandel is everywhere”.

On March 3, 2018, around 4,000 participants followed her call. At the same time there were counter-protests with around 500 participants. According to the police, around 1,000 people took part in another demonstration on March 24, 2018. The alliance "We are Kandel", which has meanwhile been founded by Kandel citizens, was able to mobilize around 2000 people, including high-ranking state politicians, for a counter-demonstration. There was also another counter-demonstration from the ranks of the Antifa with around 250 participants.

The Kandel alliance is everywhere on the Internet a photo on which brass plates with the names of murdered girls like Mia V. and Susanna F. from Mainz are depicted. The conscious reference to the Stolpersteine ​​campaign , which the artist Gunter Demnig has been publishing since 1992 in memory of the victims of Nazi crimes, has been heavily criticized. Josef Schuster , President of the Central Council of Jews in Germany , said that the Central Council shared a sincere sorrow, but initiatives like Kandel is everywhere “not only instrumentalize the murder victims themselves for their agitation against refugees and foreigners. They don't even shy away from relativizing the Shoah by imitating the stumbling blocks ”. That is unbearable. Demnig himself said that he could possibly take legal action against it, but he did not want to "give such people a stage".
