The High Coarse Fool's Court in Stockach , or Stockach Fool's Court for short , is a traditional event of the Swabian-Alemannic Carnival held annually at the “ Schmotzige Dunschtig ” in Stockach , at which a person from state or federal politics is “accused”. The tradition goes back to the “Battle of Morgarten” in 1315. The court jester of the Habsburg Duke Leopold, Kuoni, is said to have advised before the battle that one shouldn't talk about how to get to the slaughterhouse, but how to get out again. For the good advice, the Habsburg promised the Kuoni a privilege for his home town Stockach. In 1351 the Habsburg Duke Albrecht is said to have finally issued the privilege. It says that the Stockachers are allowed to rule themselves “between Candlemas and Latars ”. From this, over the centuries, the custom of the "high, coarse, foolish court of fools" developed. For a long time a trial was held in the street. The court has been inviting prominent politicians to trial since 1960. Since then, negotiations have taken place several times in other places, such as in Furtwangen (dispute over the origin of the Danube) or in Berlin (dispute over who the port of Lindau belongs to).

Battle of the Morgarten

The Stockach tradition goes back to a report in which the court jester Kuony von Stocken gave advice to Archduke Leopold I of Habsburg before the battle of Morgarten against the inhabitants of the village of Steinen (now part of Schwyz in the canton of the same name). “Now the hertzog had a fool who was called Kueni von Stocken; he also asked how he liked the subject? The answer: Evil! Said the Hertzog: why? Answer to the fool: do you all guess, we come to the country, but no one has grimaces, wa ir harwider uskomind ”. The first report in Konrad Justinger's chronicle, written around 1420, neither mentions a site of the battle nor does it mention the subsequent promise that Leopold had promised the court jester a privilege. Other Swiss chroniclers have taken over the story and embellished it with further stories. An original of the privilege from 1351 is no longer available, there is only a copy from 1743. Whether this corresponds to the original in terms of content cannot be clarified. In addition, there is the “Statute and Regulations” from 1687, in which the customs are set down in writing. It mentions the court of fools and describes the privilege as the “main letter”. In Stockach's minutes of the council, for the first time in 1661 there was talk of a “court of fools”. In older chronicles, the court jester's name is only spoken of as a kuony (Kueni, Chuni). The first name "Hans" was only given to him at a later date, probably by incorrectly copying an older version of the privilege. Conservative historians in Switzerland have reinterpreted the “Battle of Morgarten” as a struggle for freedom. In publications they converted the Swiss noble family of the Habsburgs to Austrians and made stones “Schwyzer” or “Confederates” from the inhabitants of the village. In a documentation center near Sattel in the canton of Schwyz, it has recently been pointed out that there could have been a dispute between a Habsburg bunch and the stone farmers below the Morgartenberg between Ägerisee and the town of Sattel, the alleged struggle for freedom from the perspective of the modern historical Research, however, is an offshoot of national historiography.

At the head of the court of fools, which has a maximum of 21 members, is the judge of fools. Other offices such as running fool father, plaintiff, advocate, bag master, fool writer, etc. are added. Plaintiffs, advocates and fool judges each select a defendant or a defendant from federal or state politics and invite them to a trial on Dirty Thursday . Cancellations are rarely made. The name of the defendant remains unknown to the rest of the college until the first meeting of fools on January 6th (Epiphany meeting). The plaintiff writes his statement of claim, hands it over to the advocate, who in turn drafts his defense. Lawsuits and advocacy texts will be served on the defendant in good time. The defendant is indicted by the plaintiff at the “Schmotzige Dunschtig” after the fool's tree setting in the public and from the SWR television broadcast main hearing before the “high gross cheap fool's court” in the Jahnhalle in Stockach in front of 1200 spectators by the plaintiff and defended by the advocate . The defendant then defends himself in an appearance with self-portrayal. The judgment by the judge provides as a punishment, depending on the severity of the guilt, one or more buckets of wine (Austrian capacity of 60 liters) as penance by the Laetare day. The negotiation is characterized by a mixture of good-natured ridicule and respectful treatment.
