The Offenbach am Main District Court ( Offenbach Regional Court until 1879 ) is a court of ordinary jurisdiction in Offenbach am Main that has existed since 1823 .

The AG Offenbach am Main is locally responsible for the city of Offenbach am Main and the communities Dietzenbach , Heusenstamm , Mühlheim am Main , Neu-Isenburg and Obertshausen in the Offenbach district .

The seat of the court is in Offenbach am Main at Kaiserstraße 16-18, 63065 Offenbach am Main . The court is housed in several buildings. The headquarters are in the new justice center, which was inaugurated in 2005. The courthouse on the left is a listed building and was built between 1878 and 1879. Both buildings are connected to one another by a glass transition. The Offenbach branch of the public prosecutor's office at the Darmstadt regional court and the Offenbach am Main labor court are also located in the justice center . The long-standing branch at Kaiserstraße 27, opposite the justice center, was given up in June 2010. Some departments are still located at Luisenstrasse 27.

Jurisdiction

In addition to its own judicial district, the Offenbach AG is responsible for association, commercial and cooperative registry matters as well as insolvency matters in the district court districts of Langen and Seligenstadt. It is also responsible for the district court district of Seligenstadt in criminal matters as a youth lay judge and lay judge court. history

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Darmstadt” was set up as a court of second instance for the Principality of Starkenburg . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the second instance court for normal civil disputes, and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

With the founding of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts in 1821 as part of the separation of jurisdiction and administration. The "Offenbach Regional Court" was therefore the name of the court of first instance in Offenbach from 1823 to 1879, today's district court. In the territorial territories of the Starkenburg province , there was still a judicial office in Michelstadt for court cases of the second instance, which was subordinate to the court. The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The “Hofgericht Darmstadt” has now become the “ Regional Court of Darmstadt ” as the superior second instance in the province, while the first instance courts have been renamed the District Court.

As a result of the reorganization of the judicial districts in the Starkenburg province that came into force on June 1, 1853 , extensive changes were made to the Offenbach district court, while the places Bieber , Dietesheim , Hausen , Heusenstamm, Lämmerspiel , Mühlheim and Obertshausen , which had previously belonged to the Seligenstadt district court , were new added, the communities Götzenhain, Offenthal, Philippseich, Sprendlingen and Urberach had to be handed over to the district court of Langen and the town of Münster to the district court of Umstadt . The former Hessian town of Rumpenheim , acquired by the peace treaty of September 3, 1866 with the Kingdom of Prussia , was assigned to the Offenbach district court at the beginning of 1867.

District Court

On the occasion of the introduction of the Courts Constitution Act in the Grand Duchy of Hesse on October 1, 1879, the name was changed to Offenbach District Court, the district was assigned to the district of the newly established Darmstadt District Court and the communities of Klein- and Groß-Steinheim, which previously belonged to the Seligenstadt district, were incorporated into the Offenbach District Court district.

With effect from May 1, 1948, the municipality of Dietzenbach was separated from the district court district of Langen and the municipality of Rembrücken from the district court district of Seligenstadt and both were assigned to the district court district of Offenbach. Today's court district finally came about when the district of Steinheim, which was incorporated into the city of Hanau, was handed over to the Hanau District Court on July 1, 1974.

Superior courts

The Darmstadt Regional Court is superordinate to the Offenbach am Main District Court . The higher regional court of Frankfurt am Main and the Federal Court of Justice are superordinate in the next instance .
