The Michelstadt District Court (until 1879 Michelstadt District Court ) is a court of ordinary jurisdiction that has existed since 1822 and is based in Michelstadt in the Odenwald district .

The seat of the court is in Michelstadt at Erbacher Straße 47. The judicial district of the Michelstadt District Court includes the cities and communities Bad König , Brensbach , Breuberg , Brombachtal , Erbach , Fränkisch-Crumbach , Höchst , Lützelbach , Michelstadt , Mossautal , Oberzent and Reichelsheim ( each including all parts of the city and district). The AG Michelstadt is thus responsible for the entire Odenwald district.

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Darmstadt” was set up as a court of second instance for the Principality of Starkenburg . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the second instance court for normal civil disputes, and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

With the founding of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts in 1821 as part of the separation of jurisdiction and administration. “Landgericht Michelstadt” was therefore the name for the first instance court in Michelstadt from 1821 to 1879, today's district court. In the territorial territories of the Starkenburg province , there was still a judicial office in Michelstadt for court cases of the second instance, which was subordinate to the court court (replaced by the court court in 1824).

The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The “Hofgericht Darmstadt” has now become the “ Regional Court of Darmstadt ” as the superior second instance in the province, while the first instance courts have been renamed the District Court.

District Court

On the occasion of the introduction of the Courts Constitution Act with effect from October 1, 1879, as a result of which the previous grand-ducal Hessian regional courts were replaced by local courts at the same location, while the newly created regional courts now functioned as higher courts, the name was changed to the Michelstadt Local Court, assigned to the district of the regional court Darmstadt and submission of the Nieder-Kainsbach community to the Reinheim district court . As a result of all these changes, the district of the Michelstädtergericht now consisted of Asselbrunn, Bullau, Dorf-Erbach, Ebersberg, Erbach, Elsbach, Erbuch, Erlenbach, Ernsbach, Eulbach, Günterfürst, Haisterbach, Kimbach, Kirch-Beerfurth, Langen-Brombach (Breuberger Seits ), Langen-Brombach (Fürstenauer Seits), Lauerbach, Michelstadt, Momart, Ober-Gersprenz, Ober-Kainsbach, Ober-Mossau, Rehbach, Roßbach, Schönnen, Steinbach, Steinbuch, Stockheim, Unter-Gersprenz, Unter-Mossau, Vielbrunn, Wide buttocks, Würzberg and Zell.

With effect from April 1, 1904, the districts of Kirch-Beerfurth, Ober-Kainsbach, Ober- and Unter-Gersprenz were separated from the Michelstadt district court and from then on belonged to the district of the Reichelsheim district court, which was established at the same time .

The last major changes to the Michelstadt district court were due to the regional reform in Hesse . On September 25, 1971, the district of Laudenau, which was incorporated into Reichelsheim, was added by the Fürth district court and, with effect from July 1, 1973, the communities of Brensbach with the incorporated district of Wersau and Fränkisch-Crumbach were added by the district court of Dieburg .

The Darmstadt Regional Court is superordinate to the Michelstadt District Court . The higher regional court of Frankfurt am Main and the Federal Court of Justice are superordinate in the next instance .
