The Fürth District Court is a court of ordinary jurisdiction in Fürth in the Bergstrasse district of the State of Hesse . It emerged in 1879 from the Fürth district court in Hesse .

The seat of the court is in Fürth (Odenwald) in Heppenheimer Straße 15. The judicial district of the district court Fürth includes the cities and communities Abtsteinach , Birkenau , Fürth , Grasellenbach , Gorxheimertal , Lindenfels , Mörlenbach , Rimbach , Wald-Michelbach , Hirschhorn and Neckarsteinach ( each including all parts of the city and district). All are in the Bergstrasse district .

history

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Darmstadt” was set up as a court of second instance for the Principality of Starkenburg . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the second instance court for normal civil disputes, and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

With the establishment of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts in 1821 as part of the separation of jurisdiction and administration. “Landgericht Fürth” was therefore the name of the first instance court in Fürth from 1821 to 1879, today's district court. In the territorial territories of the Starkenburg province , there was still a judicial office in Michelstadt for court cases of the second instance, which was subordinate to the court. The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The “Hofgericht Darmstadt” has now become the “ Regional Court of Darmstadt ” as the superior second instance in the province, while the first instance courts have been renamed the District Court.

Fürth district court

With the separation of administration and justice through the Grand Ducal Hessian Ordinance of July 14, 1821, the Fürth Regional Court was formed , whose district was initially congruent with the Lindenfels district and thus had the following components:

With effect from August 1, 1826, the functions of the dissolved Schönberg Regional Court were transferred to the Fürth Regional Court and the regional court district was expanded to include Schönberg , Elmshausen , Gadernheim , Gronau , Hohenstein , Lautern , Raidelbach , Reichenbach , Rimbach , Wilmshausen Zell and Zotzenbach . However, these places - with the exception of Rimbach and Zotzenbach - were assigned to the regional court of Zwingenberg on December 16, 1839 . On the occasion of the reorganization of the judicial districts in the Starkenburg province on June 1, 1853 , Wald-Michelbach, Affolterbach, Aschbach, Dürr-Ellenbach, Flockenbach, Gadern, Gorxheim, Grasellenbach, Hartenrod, Kocherbach, Kreidach, Kunzenbach, Löhrbach, Mackenheim, Ober- Abtsteinach, upper Mumbach, upper-Schar Bach, upper Schönmattenwag, Siedelsbrunn, Trösel, sub-Abtsteinach, separated sub-Schar Bach, Vöckelsbach and elections and from then formed the district court Waldmichelbach , simultaneously to the Sprengel of the Fürth district court of the district of were the district court Michelstadt the Places Eberbach , Erzbach , Frohnhofen , Groß-Gumpen , Klein-Gumpen , Laudenau , Ober-Klein-Gumpen , Ober-Easter , Reichelsheim, Rohrbach , Unter-Easter and Winterkasten closed . Fürth district court

On the occasion of the introduction of the Courts Constitution Act with effect from October 1, 1879, as a result of which the previous grand-ducal Hessian regional courts were replaced by local courts in the same place, while the newly created regional courts now functioned as higher courts, the name was changed to the Fürth Local Court and assigned to the district of the Regional Court Darmstadt .

With effect from April 1, 1904 the districts Bockenrod, Eberbach, Erzbach, Frohnhofen, Groß-Gumpen, Klein-Gumpen, Laudenau, Ober-Klein-Gumpen, Ober-Easter, Pfaffen-Beerfurth, Reichelsheim, Rohrbach, Unter-Easter and Winterkasten separated from the district court district of Fürth and formed the basis of the district court district of Reichelsheim established at the same time .

The last major changes to the district court district of Fürth came as a result of the regional reform in Hesse . On September 25, 1971, the district of Mittershausen, which was incorporated into Heppenheim, was added to the Bensheim district court and the district of Laudenau, which was incorporated into Reichelsheim, to the Michelstadt district court, and on October 14, 1972, the districts of Knoden and Schannenbach, which were incorporated into Lautertal, were also assigned to the Bensheim district court.

The Regional Court of Darmstadt is superordinate to the AG Fürth . The higher regional court of Frankfurt am Main and the Federal Court of Justice are superordinate in the next instance .
