The Darmstadt District Court (AG Darmstadt) is a German district court of ordinary jurisdiction with its seat in Darmstadt .

The judicial district includes the cities of Darmstadt, Griesheim , Ober-Ramstadt , Pfungstadt and Weiterstadt as well as the communities Alsbach-Hähnlein , Bickenbach , Erzhausen , Messel , Modautal , Mühltal , Roßdorf and Seeheim-Jugenheim .

The district court itself is housed in two buildings. On the one hand, this is Justice Building B from 1905 at Mathildenplatz 12, 64283 Darmstadt, where the administration of the local court, the civil litigation department, the estate and registry court, the land registry and the court are located, and on the other hand, Justice Building D at Mathildenplatz 15, 64283 Darmstadt, in which the criminal litigation department, the family and guardianship court, the bankruptcy and enforcement court and the training center for legal clerks are located.

Jurisdiction

The AG Darmstadt is responsible beyond its own district

  • in criminal matters as a youth lay judge and lay judge court for the district of the district court of Langen ,
  • in civil status proceedings for all district court districts of the Darmstadt district court,
  • in commercial, cooperative and association register matters as well as in insolvency matters for the district court districts of Bensheim, Dieburg, Fürth, Groß-Gerau, Lampertheim, Michelstadt and Rüsselsheim.

The district court is not responsible for dunning matters, here the Hesse- wide jurisdiction lies with the district court of Hünfeld , and in partnership register matters , for which the district court of Frankfurt am Main is there throughout Hesse .

history

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Darmstadt” was set up as a court of second instance for the Principality of Starkenburg . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the court of the second instance for normal civil disputes and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

District Court or City Court

With the founding of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts (for Darmstadt city court) in 1821 as part of the separation of jurisdiction and administration. From 1821 to 1879, “Darmstadt city or regional court” was the name for the court of first instance in Darmstadt. In the territorial territories of the Starkenburg province , there was still a judicial office in Michelstadt for court cases of the second instance, which was subordinate to the court.

District Court

The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The “Hofgericht Darmstadt” has now become the “ Regional Court of Darmstadt ” as the superior second instance in the province, while the first instance courts have been renamed the District Court.

The Darmstadt District Court was created on January 1, 1932 by amalgamating the Darmstadt I District Court , whose district included the city of Darmstadt, with the Darmstadt II District Court , whose district consists of the communities of Arheilgen , Braunshardt , Eberstadt , Eich , Erzhausen, Eschollbrücken , Frankenhausen , Graefenhausen , Griesheim, Hahn , Malchen , Messel, Neutsch , Nieder-Beerbach , Nieder-Ramstadt , Ober-Ramstadt, Pfungstadt, Roßdorf, Schneppenhausen , Traisa , Waschenbach , Weiterstadt and Wixhausen .

On July 1, 1968, the district of the Darmstadt District Court was added to the towns of Alsbach , Balkhausen , Bickenbach, Hähnlein , Jugenheim , Ober-Beerbach and Seeheim , which were separated from the Bensheim District Court , and the towns of Allertshofen , Asbach , Brandau , Ernsthofen , Herchenrode , Hoxhohl , Klein -Bieberau , Lützelbach , Neunkirchen , Nieder-Modau , Ober-Modau , Rohrbach and Wembach-Hahn expanded from the district of the dissolved Reinheim District Court .

A separate district court building, the old district court , was built for the district court between 1903 and 1905 . Since the size of the building was no longer sufficient, buildings B and C were also built next to it on Mathildenplatz .

The office building at Julius-Reiber-Straße 15 was given up.

The district court of Darmstadt is superordinate .
