The district court Groß-Gerau (until 1879 district court Großgerau ) is a court of ordinary jurisdiction that has existed since 1821 and is based in the city of Groß-Gerau .

The seat of the court is at Europaring 11-13 in 64521 Groß-Gerau. The judicial district of the district court Groß-Gerau includes the cities and communities Biebesheim am Rhein , Bischofsheim , Büttelborn , Gernsheim , Ginsheim-Gustavsburg , Groß-Gerau , Mörfelden-Walldorf , Nauheim , Riedstadt , Stockstadt am Rhein and Trebur .

Jurisdiction

The Groß-Gerau District Court is the first instance in civil, family and criminal matters for its own judicial district. In addition, it is responsible as the youth lay judge and lay judge court for its own district and the district court district of Rüsselsheim. The AG Groß-Gerau is not responsible for commercial, cooperative and association register matters as well as insolvency matters. The Darmstadt District Court is responsible for this. It is also not responsible for dunning procedures, in this case the Hünfeld District Court is responsible for the whole of Hesse .

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “ Hofgericht Darmstadt ” was set up as a court of second instance for the Principality of Starkenburg . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the second instance court for normal civil disputes, and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

With the founding of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts in 1821 as part of the separation of jurisdiction and administration. "District Court Groß-Gerau" was therefore from 1821 to 1879 the name of the court of first instance in Groß-Gerau, today's district court. In the territorial territories of the Starkenburg province , there was still a judicial office in Michelstadt for court cases of the second instance, which was subordinate to the court. The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The “Hofgericht Darmstadt” has now become the “ Regional Court of Darmstadt ” as the superior second instance in the province, while the first instance courts have been renamed the District Court.

When a new district court in Gernsheim was established on December 16, 1839 , the places Biebesheim, Crumstadt and Stockstadt had to be given to the district of that court. As a result of the reorganization of the judicial districts in the Starkenburg province that came into force on June 1, 1853 , the municipality of Griesheim was also ceded to the Darmstadt Regional Court .

District Court

On the occasion of the introduction of the Courts Constitution Act on October 1, 1879 in the German Empire, the name was changed to the Groß-Gerau District Court and the district was assigned to the newly created Darmstadt District Court . With effect from January 1, 1883, the districts of Mörfelden and Walldorf were separated from the district court district Langen and assigned to the district court district Groß-Gerau. On April 1, 1931, the places Bischofsheim and Ginsheim-Gustavsburg were assigned to the Mainz District Court after their incorporation into Mainz . In contrast, the district of the Groß-Gerau court was expanded to include the communities of Gernsheim, Biebesheim, Crumstadt, Klein-Rohrheim and Stockstadt through the dissolution of the Gernsheim district court on October 1, 1934 . The community of Allmendfeld , newly formed from parts of Gernsheim, Crumstadt, Pfungstadt and Hähnlein on October 31, 1937, was added to the Groß-Gerau district court on October 1, 1938.

In 1945 the district court of Groß-Gerau was reassigned the towns of Bischofsheim and Ginsheim-Gustavsburg, which had been separated from the Mainz district court. With effect from October 1, 1956, the Rüsselsheim branch of the Groß-Gerau district court was created for the communities of Raunheim and Rüsselsheim , which was converted into a full court on June 1, 1976.

Superior courts

The district court of Darmstadt is superordinate to the Groß-Gerau district court . The higher regional court of Frankfurt am Main and the Federal Court of Justice are superordinate in the next instance .
