netzpolitik.org is a German-language news website on digital freedom rights and other network policy topics and deals, among other things, with state surveillance , open source software , telecommunications laws as well as creative commons and a free knowledge society . According to its own information, the blog is a platform "for digital freedom rights", which aims to highlight the "important issues relating to the Internet, society and politics" and to provide assistance on how to "use the internet to get involved in digital freedom and openness". The aim is to describe “how politics changes the Internet through regulation and how the Internet changes politics, the public and everything else.” The blog sees itself as a “journalistic offer”, but does not see itself as “neutral”. Rather, the attitude is to advocate “digital freedom rights and their political implementation”. According to its own information, it comprises 17,000 articles by more than a hundred authors. The fixed author base is numbered at slightly more than 30 members (as of 2015).

Markus Beckedahl sees the blog as "something in between the non-governmental organization and the medium , comparable to a mixture of Greenpeace and taz ". In addition to Beckedahl, Linus Neumann , Andre Meister, Constanze Kurz and Jörg-Olaf Schäfers, who died in 2011, are or were among the regular authors.

In the “German Blogcharts”, a ranking of German-language blogs according to degree of networking, which was kept until 2014, the blog was consistently among the blogs most frequently linked by other blogs. Since the end of June 2009 it has been the most linked blog in the German-speaking blogosphere with over 650 tracked backlinks . Technically, the blog is based on the WordPress software .

Costs and financing

The blog was cross-financed through advertising, donations and the Newthinking agency until 2010 . Beckedahl calls this the "open source business model". In addition, there was income from workshops or lectures by the individual authors.

In January 2013 costs and revenues were published in detail. According to this, the monthly expenditure at that time was around 6,900 euros. Among them were u. a. Including: two ¾ full-time jobs ; Infrastructure costs (approx. 1200 euros); Legal fees and invoices for inquiries about the Freedom of Information Act (500 euros). For the same point in time, income of 2950 euros was given. These include: 350 euros through Flattr ; about 50 euros through affiliate marketing for Amazon .

For its tenth birthday, the Chaos Computer Club donated 12,000 euros to the blog. After reporting on the investigation into alleged treason at the end of July 2015, the blog received 150,000 euros in donations within 10 days, which, according to Beckedahl, could also finance a possible legal action . In the whole of the previous year 2014, a total of almost 180,000 euros in donations were received.

Since 2017, the blog has published income and expenses in a monthly transparency report.

In 2018, the income amounted to around 484,600 euros, 98% of which was donations, the expenditure to around 486,200 euros (84.0% for personnel costs, 7.8% for rent, 2.6% for external services and 1.0% for fees).

In 2019, the income amounted to around 636,000 euros, the majority of which came from donations, similar to the previous year. The number of donors increased by approx. 50% compared to the previous year, the total donation by approx. 33%.

Awards

The blog has won several awards, including the Freedom Blog Award in 2005 , which is presented by Reporters Without Borders , and in 2006 the magazine's blog grant now . At the LeadAwards 2007 netzpolitik.org was awarded in the category “Best Weblog of the Year”. In 2008 the blog was nominated for the Grimme Online Award in the “Information” category. In 2010 he received the Alternative Media Prize .

Investigations into suspected treason

In the spring of 2015, the blog published twice excerpts from a report by the German Federal Office for the Protection of the Constitution (BfV) classified as " VS-CONFIDENTIAL " . It was about building a new unit to monitor the Internet, to analyze and monitor connections and profiles of radicals and extremists on social networks like Facebook . The President of the BfV, Hans-Georg Maaßen , filed a criminal complaint about this . In May 2015, the Federal Prosecutor General Harald Range opened an investigation against the journalist and author of the two articles Andre Meister , the blog operator Markus Beckedahl and against unknown persons in connection with the accusation of treason ( Section 94 StGB) . In the letter to Beckedahl, the investigation was justified with the words:

“… With regard to the provision of Section 78c Paragraph 1 No. 1 Variant 2 StGB in conjunction with Section 22 Paragraph 1 Alt. 2 of the Berlin Press Act, I inform you that, based on criminal charges from the Federal Office for the Protection of the Constitution, I have initiated an investigation against you on suspicion of treason in accordance with §§  94 Paragraph 1 No. 2,  25 Paragraph 2,  53 StGB. The subject of the investigation is the publication of the two articles mentioned below on the Internet blog 'Netzpolitik.org'. You are responsible for the blog. On February 25, 2015 at 10:40 a.m. the article with the headline 'Secret money rain: The protection of the constitution is working on' mass analysis of Internet content '(updates)' was published. Subsequently, on April 15, 2015 at 9:05 a.m., an article with the title 'Secret Section Group: We present the new constitution protection unit for the expansion of Internet surveillance' was published, which has also been in. In contrast to what was stated up until the beginning of August 2015, the Federal Ministry of the Interior also knew that the Federal Public Prosecutor had initiated an investigation against the network policy journalists on suspicion of treason. The Federal Criminal Police Office , which is subordinate to the Federal Ministry of the Interior, had already informed the responsible department in June 2015 that it had been commissioned by the Federal Prosecutor General to carry out specific investigations into suspected treason. It was also known that the proceedings were directed against individual journalists.

On August 10, 2015, the investigation against netzpolitik.org on suspicion of disclosure of state secrets was discontinued by the Attorney General . It is now only a public prosecutor with lower jurisdiction to bring charges against unknown officials because of the disclosure of official secrets. In the opinion of the originally accused, the matter is not yet closed, as it is z. B. go to their exploration. Even after the termination of the proceedings, the formerly accused are refused access to the files , which violates Section 147 (1) StPO, according to netzpolitik.org.

Reactions

Because of the parallels to the Spiegel affair , the incident attracted a lot of attention in German-language media. The German Union of Journalists in Ver.di called for the investigation to be stopped immediately and for informants to be protected more effectively by law. On July 30, 2015, the German Association of Journalists sharply condemned the investigation. The procedure was an "inadmissible attempt to silence two critical colleagues", said the then Federal Chairman Michael Konken . He asked the Attorney General to stop the investigation immediately. Markus Beckedahl stated in interviews with heise Online and the Tagesschau that he thought the ad was an attempt to intimidate the federal prosecutor.

“We see this as an attempt to intimidate our work. Last year the Federal Chancellery announced criminal charges, including against the Süddeutsche Zeitung and the Spiegel. That was withdrawn. Now is the attack on us. We are the smallest medium, the outcry would certainly be greater in the two other press organs. We also see this as an attempt to intimidate potential sources. "

As a result of the investigation, there was a nationwide protest. Between 1,300 and 2,000 activists demonstrated in Berlin. Citizens, politicians and journalists - including Gerhart Baum , Ralf Stegner , Konstantin von Notz , Sahra Wagenknecht , Renate Künast and Christian Lindner  - showed solidarity with netzpolitik.org . Range was attested among other things as a "betrayal of democracy", some commentators demand his resignation. The Organization for Security and Cooperation in Europe (OSCE) called for an end to the investigation against the journalists from Netzpolitik.org. "The threat of a treason lawsuit has a clear deterrent effect on investigative journalists."

The Federal Minister of Justice Heiko Maas also distanced himself from the Federal Prosecutor's Office with the words: "... that I have doubts whether the journalists intended to disadvantage the Federal Republic of Germany or to favor a foreign power". It is also questionable "whether the published documents are a state secret , the publication of which creates the risk of a serious disadvantage for the external security of the Federal Republic of Germany". Angela Merkel and Thomas de Maizière later shared this opinion.

Range stated that he would let the investigation rest for the time being and said in an interview that he was refraining from “possible executive measures under the Code of Criminal Procedure” with a view to “the great good of freedom of the press and freedom of expression”. First of all, it should be clarified in the preliminary investigation whether the publications involved the disclosure of a state secret, for which an external expert opinion should be obtained, which, however, could only be done through a formal preliminary investigation. According to the FAZ , the original criminal complaint was “not directed against specific persons”, but against “unknown persons” from the environment of the Federal Prosecutor's Office. The aim of the BfV President Hans-Georg Maaßen was not that journalists should be investigated, but that the passing on of secret documents was thwarted. Only this project had the approval of the leadership of the Federal Ministry of the Interior. That is also why Interior Minister Thomas de Maizière was not informed of the plans. According to information from the Süddeutsche Zeitung, the files of the treason proceedings show that Maaßen should have known that the proceedings would be directed against journalists. The media also highlighted the names of the two journalists in the advertisement, which apparently contradicts Maassen's claim that the prosecution of the journalists was not the aim of the advertisement.

According to heute.de , Maassen informed the responsible department head and the state secretary in the Ministry of the Interior. However, they considered the information "apparently so politically explosive" that they did not inform their minister about it. The former data protection officer, Peter Schaar, sees the Ministry of the Interior as being politically responsible for the investigation against the blog's journalists: “I assume that Mr Maassen has got the green light from the ministry,” the affair has “the potential that a minister holds office could cost ”.

At a press conference on August 4, 2015, Harald Range accused Federal Justice Minister Heiko Maas of wanting to withhold the report because its content was not politically opportune and supported the accusation of treason. Maas contradicted that the decision to withdraw the contract for the expert opinion had already been taken on July 31, in agreement with Range; At this point in time, no possible result of the report was known. As a consequence, Maas took steps to move Ranges into retirement. The opposition spoke of a pawn sacrifice and demanded further consequences with a view to the reporter, President of the Constitutional Protection, Maaßen and the ministries involved. As a result of Rank's dismissal, several charges were brought against Maas, so that the Berlin public prosecutor's office examined the initial suspicion of preventing punishment in the office .

The Association of Federal Judges and Federal Prosecutors at the Federal Court of Justice announced through Federal Judges Harald Reiter and Christian Tombrink in the first press release since the association was founded that there were “indications of an unlawful obstruction of the Federal Prosecutor's investigation”. The impression arose "that the ongoing investigations in accordance with the procedural rules were interfered with in order to achieve a certain - politically desired - result, namely through targeted control of the taking of evidence". The chairman of the Bund Deutscher Kriminalbeamter , André Schulz , was of the opinion that Maas had “publicly discredited the work of the public prosecutor and damaged trust in an objective criminal prosecution.” Conversely, the case was in the press as one of a number of cases in the recent past discussed in which journalists should be intimidated by legal means in order to achieve a politically desired result. A survey by the German Union of Journalists among 821 journalists showed that the majority (92% of those surveyed) fear further attempts by government agencies to intimidate journalists. In the press, the risk of self-censorship resulting from this was seen as a threat to democratic press coverage.

The CSU politician and deputy member of the NSA investigation committee Stephan Mayer considers the criticism of the investigation against netzpolitik.org to be inappropriate. It is not the job of politics to assess whether there is sufficient initial suspicion for an investigation, he said. Journalists and press representatives did not act in a vacuum. Several lawyers, including Gerhard Strate , criticized Range's statements, however, because the legal situation does not provide for the "independence of the judiciary" postulated by him. Dieter Deiseroth , judge at the Federal Administrative Court in Leipzig, sees the preliminary investigation as having an “objective effect, intimidating investigative journalists and uncomfortable critics and their informants. [..] Likewise, there can be no legal requirement to secure something against the law (e.g. through secrecy), which is wrong according to the constitutional order, ”said Deiseroth.

On August 5, 2015, a statement was published on the netzpolitik.us website calling for the investigation to be terminated. Network policy yearbook

Since 2012, in addition to other publications at the end of the year, a summary has been published looking back on events in network policy, enriched by contributions from various authors, published under a Creative Commons license with a request for donations.
