Dubravko Mandic (also Mandić , born May 12, 1980 in Sarajevo , SR Bosnia and Herzegovina , SFR Yugoslavia ) is a Yugoslav - German lawyer and politician ( AfD ).

Life

Mandić was born in Sarajevo in what was then Yugoslavia as the son of a Croatian German studies specialist and came to Freiburg with his Serbian mother and brother in 1983 . The father had worked as a social worker for the workers' welfare in Freiburg since the 1970s . After elementary school , high school and the armed forces, Mandic studied law at the Albert-Ludwigs-Universität Freiburg . He was initially a member of the fraternity Alemannia Freiburg and later joined Freiburg fraternity Saxo-Silesia ( DB ) to. He did his legal clerkship at the Freiburg Regional Court .

After the second state examination , he established himself as a lawyer in his own law firm in Freiburg. He mainly works on mandates from criminal law and immigration law . Mandic also represents asylum seekers from the Balkan countries who are threatened with deportation due to their origin from countries that are considered safe by the state . Mandic has legal expertise in relation to Bosnia and Herzegovina , Croatia and Serbia . He speaks Serbo-Croatian . In the case of a raped 15-year-old, Mandic, who defended the defendant who was ultimately convicted, gave the victim complicity in his pleading: she “aggressively danced” at the perpetrator and thereby aroused her sexually. "Rape does not take place independently of sexual stimuli". The court reacted to this plea with incomprehension.

Because of a fight on the Kaiserstuhlbrücke in Freiburg in the 2019 local election campaign, in which Mandic is said to have used irritant gas, the Freiburg district court issued a penalty order against him, according to which he faces a suspended prison sentence for dangerous bodily harm. Mandic appealed against the penalty order.

Mandic is a member of Alternative für Deutschland and its right-wing national and ethnic group Der Flügel . He was also a member of Junge Alternative , the AfD's youth organization.

In 2014 he was elected to the federal board of the Patriotic Platform , a conservative national association inside and outside the AfD. He was a member of the court of arbitration of the AfD Baden-Württemberg .

Mandic ran for the 2017 federal election as a direct candidate in the Tübingen constituency . He narrowly prevailed against a competitor in a by-election . Previously, he had failed in the attempt to be list candidate in Baden-Württemberg and direct candidate in the Bundestag constituency of Waldshut . He received 8.7% of the first votes in the constituency of Tübingen.

After the AfD had received two seats in the Freiburg city council in the local elections on May 26, 2019 , Mandic, as one of the two mandate holders, declared: “Now the old parties and, above all, Mayor Horn will really be upset. I'll chase him out of office. "

Positions

According to Mandic, the wars in crumbling Yugoslavia shaped his attitude towards the nation. While all of them had previously been Yugoslavs, the crumbling state structures had led to people becoming more aware of their origins. This danger would also exist for Germany. When in doubt, immigrants would always orientate themselves by ethnicity and not by a constitution. A constitution is not enough to create identity for a country.

After a violent demonstration in Cologne in October 2014, Mandic publicly opposed plans by the then AfD executive committee to initiate party regulatory proceedings against members who supported the hooligans' mobilization against Salafists (HoGeSa). In an open letter distributed by the Patriotic Platform, he called for the board's acceptance "if a few of us try to demonstrate with worried hooligans".

In June 2016, Mandic called on his Facebook page for his party to work more closely with the Identitarian Movement (IB). With this "due to similar political objectives" "[s] owohl the AfD and above all the Junge Alternative [...] personally [...] connected." Mandic himself took part in a demonstration of the IB Austria in Vienna in mid-June 2016 . According to Mandic, the protection of the constitution has infiltrated the AfD. That is why he calls for a “defense structure” to be created in the party. In order to prevent observation, board members of the JA and AfD should not be allowed to work in leading positions at the IB at the same time. This is "our tribute to the system". He criticized the incompatibility decision of the federal executive with the Identitarian Movement. According to Mandic, Frauke Petry and Marcus Pretzell pushed this “the old way”.

Controversy

Controversial Facebook posts by Mandic were widely received in the media. So Mandic wrote that the AfD differs from the NPD “primarily through our bourgeois supporters, not so much through content”. He described Barack Obama as a “quota negro”, but sees this not as an insult to Obama, but as a criticism of the people who abused him. A party exclusion procedure against him was set after a conversation with the AfD state chairman Jörg Meuthen .

According to a report in the “Badische Zeitung”, Mandic is said to have invited to a celebration of the “Saxo-Silesia” fraternity in April 2016 , at which “Nazi songs” were played and “ Heil Hitler ” shouted. According to the publicist Liane Bednarz , the second court case has already been initiated against Mandic. In an initial procedure, Mandic himself could not be proven to have directly failed.

In October 2016, the Karlsruhe public prosecutor had Mandic's apartment searched after several criminal charges were received on suspicion of insult, among others by Claudia Roth , Cem Özdemir and Anton Hofreiter . Mandic had shared a picture on Facebook in which the faces of top German politicians had been mounted in a photo of the accused at the Nuremberg war crimes trials . According to a decision by the Karlsruhe Regional Court, the searches were unlawful. In April 2018 the Freiburg District Court sentenced him to a fine of 90 daily rates of 100 euros for insulting him in five cases.

As part of the election campaign for the European elections, the pro-European citizens' movement Pulse of Europe also invited the AfD to a meeting in early May 2019 in Freiburg, which Mandic sent. Since the event took place in cooperation with the state center for political education , it was obliged to “take into account all parties represented in the state parliament”, the LpB explained in response to subsequent criticism.

At the football game at the start of the season in August 2019, two fans of SC Freiburg unfurled banners in the Black Forest Stadium against the AfD city council, including the inscription "Mandic du Nazi piss you off!" The person concerned filed a complaint. In August 2020, the public prosecutor closed the investigation against the two fans on the grounds that it was not an insult, but an expression of opinion.

On the occasion of the debate about the satirical version of the WDR of Meine Grandma drives a motorcycle in the chicken coop , protests against the public service broadcaster also broke out in front of the SWR building in Baden-Baden at the beginning of 2020 . In a speech, Mandic threatened the journalists that they would "be driven out of their editorial offices". Two weeks later, the SWR announced that Mandic regretted in an email that the impression arose that he had called for people to achieve their goals by force.
