List of courts in the province of Hessen-Nassau (1867)

from Wikipedia, the free encyclopedia

The list of courts in the province of Hessen-Nassau (1867) of the Kingdom of Prussia was taken from the official registers ( plan for the organization of the courts ) of 1867 for the two administrative districts of the province, the administrative district of Kassel and the administrative district of Wiesbaden ; In the former free city of Frankfurt , which was part of the Wiesbaden administrative district , the court organization remained essentially unchanged from 1867 to 1879 . The regulations existed until the Courts Constitution Act of January 27, 1877 came into force on October 1, 1879.

For the administrative district of Kassel and the administrative district of Wiesbaden with the exception of the city of Frankfurt a. M. there were two plans of the Prussian Minister of Justice, which he put into effect in 1867 . These plans served the implementation of the two ordinances of June 26, 1867 on the constitution of the courts in the former Electorate of Hesse and the formerly Royal Bavarian territorial parts, excluding the enclave Kaulsdorf and in the former Duchy of Nassau and the formerly Grand Ducal Hessian territorial parts, excluding the Upper Office district of Meisenheim .

The ordinances on the reorganization of the courts, which were enacted by the victorious Prussia after the German War in 1866, were based on the annexation law for Kurhessen, Nassau and Frankfurt of September 20, 1866. The Prussian annexation of the areas in the newly founded province of Hesse in 1868 -Nassau , which was formed from the two previously established administrative districts of Kassel and Wiesbaden , had taken over their courts (in the administrative district of Kassel [Kurhessen] judicial offices / in the administrative district of Wiesbaden [Nassau] offices) with only a few changes of territory.

The Kingdom of Bavaria joined the Peace Treaty of 22 August 1866, the district office Gersfeld, later county Gersfeld and the District Court Orb without aura to Prussia, the Grand Duchy of Hesse in the peace agreement dated September 3, 1866 the district Vöhl , including enclaves Eimelrod and Höringhausen . These annexed areas were of relatively small size.

In 1867 the Prussian urban district of Frankfurt am Main was formed from the urban area and most of the land area of the free city of Frankfurt . M. formed. Due to a clever negotiation with Prussia, the latter was largely able to maintain its judicial organization. It was not until the Courts Constitution Act (GVG) that the new Reich-wide court system was introduced in Frankfurt in 1879.

C. Courts in the area of the city of Frankfurt a. M. (urban area and the Frankfurt rural communities)

The court constitution of the former free city of Frankfurt (Prussian spelling (1867–1945): Frankfurt a. M.) was not based on a plan. With a few changes, Frankfurt's existing court system was retained. In contrast to the courts in the area of the former Electorate and the former Duchy of Nassau (each with the former Bavarian and Grand-Ducal Hessian areas), there was no comprehensive redesign. The regulations existed until the Reich Justice Acts of October 1, 1879, here the Courts Constitution Act of January 27, 1877 .

The city and its rural parishes largely retained the previous court structure; only the highest authority changed. Therefore, there is also no official publication about it in the Prussian Justice Ministerial Gazette (officially: Justiz-Ministerial-Blatt für die Prussische Leggebung und Rechtspflege) , but in the unofficial part in an article under the title Judicial Constitution of the former Free City of Frankfurt am Main there is also a section contained on the constitution of the judicial authorities .
