The parliamentary elections in Namibia 2009 , d. H. the elections for the Namibian National Assembly took place on November 27th and 28th, 2009 together with the presidential election. Namibians at sea and abroad were able to vote on November 13, 2009.

The registration of about 1 million voters ran from June 2009 and was completed on September 30, 2009. 997 fixed and 2213 mobile voting stations were available for casting votes.

The turnout was extremely high (allegedly around 95.8%), although according to an opinion poll from 2009 on the "attitudes of Namibians to politics and elections" the population is dissatisfied with the political parties; central problems such as education, unemployment and health care are insufficiently addressed.

Election result

The official final result was announced on December 4, 2009.

Comments on the election

The Namibian Election Commission has published a handbook for election observers in cooperation with the Konrad Adenauer Foundation . In addition, national and international election observation teams were invited to observe the elections.

In the course of the election campaign there were occasional violent clashes between supporters of the ruling SWAPO party and the opposition parties RDP and CoD. The Namibian government condemned the acts of violence and called for peaceful elections in this context.

Due to various irregularities, the Namibian Election Commission (ECN) also came under fire , especially from the opposition party RDP and the National Society for Human Rights (NSHR). There were discrepancies in particular with regard to contradicting numbers of eligible voters, as there was, to a small extent, double listing of voters and listing of people who had already died. As a reaction of the Namibian Election Commission to repeated criticism of the preparations for the election by the NSHR, the NSHR Election Commission withdrew its observer status for the elections. In return, the latter sued the electoral commission before the Supreme Court , because they considered this decision to be "illegal and invalid". In the subsequent proceedings, the human rights society was granted the right to participate in election observation and suspended the decision of the election commission. In the reasoning, the court stated that the decision was unauthorized. However, the electoral commission opposed the judge’s decision and excluded the human rights organization from the election a second time.

Independent election observers from SADC spoke of an election that was "transparent, credible, peaceful, free and fair". The observers of the Pan-African Parliament (PAP) and the African Union's observer mission also gave positive comments on the elections . However, both PAP and AU observers criticized the vote count as being too long.

Election lawsuit

In mid-December 2009, nine parties filed a lawsuit with the Higher Court of Namibia to have the election canceled due to electoral fraud . The court dismissed all parts of the election complaint on March 4 on the grounds that the complaint had been filed with the court about 90 minutes late. The opposition, however, had successfully appealed to the Supreme Court .

On February 14, 2011, the complaint was finally dismissed by the Supreme Court, however, among other things, irregularities were complained about at the Namibian electoral commission and the costs were imposed despite the complaint being won. According to the presiding judge, irregularities apparently existed, but could not be proven in specific cases or presented on the basis of legally relevant evidence by the opposition.
