The elections to the South West African Legislative Assembly in 1940 were the fourth (of nine) elections in the Mandate South West Africa . They took place on February 21, 1940.

Elections were made in twelve one-person constituencies. Only the white inhabitants were entitled to vote, not the black majority of the population. In addition, the South African administrator of the mandate appointed six more MPs.

For the first time, white voters were given the right to vote.

The German Federation for South West Africa was banned in 1937. A party of the Deutschnamibier therefore did not stand for election. In addition to the United National South West Party (UNSWP) ( Afrikaans : Verenigde Nasionale Suidwes-Party, VNSWP), which had won the last elections, the elections for the South West African Legislative Assembly in 1929 , and which consisted mainly of Afrikaans-speaking members, the newly formed National Party of South West Africa .

A total of 8138 votes were cast, of which 4649 were for the UNSWP, 3028 for the National Party of South-West Africa and 451 for independent candidates. Ten representatives from the UNSWP and two from the National Party of South-West Africa were elected to parliament. In addition, six representatives of the UNSWP were appointed.
