Bernd Busemann , also Bernhard Busemann , (born June 5, 1952 in Dörpen , Emsland district ) is a German politician ( CDU ). He is Vice President of the 18th Lower Saxony State Parliament . From February 19, 2013 to November 13, 2017, he was President of the 17th Lower Saxony State Parliament . Before that he was Lower Saxony's Minister of Education and Culture and then Lower Saxony's Minister of Justice .

Life

education and profession

Busemann graduated from high school in Papenburg in 1972 . Two years as a contract soldier in Buxtehude followed . He then began studying law at the University of Cologne . He has been working as a lawyer since his second state examination in 1982 and as a notary since 1985 .

Busemann has been a member of the CDU since 1971. Since 1987 he has been the chairman of the Aschendorf-Hümmling district association, and since 1994 a member of the Lower Saxony state parliament , in which he represents the constituency 82 of Papenburg as a directly elected member . From 1998 to 2003 he was deputy chairman of the CDU parliamentary group. From March 2003 to February 2008 he was Minister of Education for Lower Saxony. After the state elections in 2008 , which were successful for the CDU and FDP , Busemann took over the office of Justice Minister from Elisabeth Heister-Neumann , who succeeded him and became Minister of Education. After losing the state elections in Lower Saxony in 2013 , he resigned from office with the McAllister cabinet and the Weil I cabinet assumed office.

On February 5, 2013, Busemann was nominated by the CDU state parliamentary group as a candidate for the office of state parliament president (successor to Hermann Dinkla ). He prevailed against his party colleague Astrid Vockert with 35 to 19 votes. Since the CDU is still the strongest parliamentary group despite the lost election, it was assumed that Busemann would be elected at the constituent session of the state parliament on February 19. However, this required votes from the majority camp of the SPD and the Greens. After Busemann was caught drunk behind the wheel of his company car on February 5, 2013 and, when it became known two days later, he still held on to his candidacy, the SPD and the Greens initially left it open whether they would actually support him in the election. A little later the SPD signaled its approval, the Greens continued to keep a low profile. At the constituent session of the 17th Lower Saxony State Parliament on February 19, 2013, Busemann was finally elected President of the State Parliament with a large majority, and some members of the Greens voted no. Since the clear victory of the SPD as the strongest party in the state elections in November 2017, Bernd Busemann has been Vice President of the Lower Saxony state parliament.

Busemann and his wife Ilse-Marie have two adoptive daughters.

Positions

Dissolution of the state center for political education

On his initiative as minister of education, the cabinet of the Lower Saxony state government under Prime Minister Christian Wulff decided to dissolve the Lower Saxony state center for political education on December 31, 2004. This decision triggered outrage nationwide and calls for the decision to be withdrawn, but without success. On November 18, 2004, the Lower Saxony State Parliament passed a law of its own to establish the Lower Saxony Memorial Foundation (GedenkStG) as the successor organization to the 'Memorial work and reappraisal of National Socialism and its Consequences' department .

Indemnities

In 2008, Busemann was asked by the FAZ what he thought of the increase in compensation demanded by lawyers for citizens who had been imprisoned innocently for years. According to the FAZ, some federal states are responding to such cases with "cold fiscal and legal logic". The article came to this assessment through Busemann's position, because he stated: "I do not deny that the indemnity in individual cases leads to unsatisfactory solutions", but he could only imagine an increase of a few euros. "... unsatisfactory situations are inherent in the law." The demand for an increase to one hundred euros per day in detention is therefore "downright absurd".

Castor transports

After the massive protests against the Castor transport to Gorleben in November 2010, in the discussion about the distribution of the costs of the police operation, Busemann asked the demonstrators to pay. "Anyone who obstructs an officially approved transport through a sit-in and thereby causes damage such as additional costs for the police operation must not be exempt from punishment from the outset," he told the FAZ . While the Bavarian Interior Minister Joachim Herrmann ( CSU ) agreed with him, the Greens chairwoman Claudia Roth criticized him for criminalizing the demonstrators: "Demonstrations are the staple food of democracy."

Preventive detention

Rape in juvenile detention

When a study by the Criminological Research Institute of Lower Saxony was published in August 2012, which stated that inmates of the juvenile penal system had a seven percent probability of being raped within a month, Busemann said he could “accept this result” and said: “A prison is just not a boarding house for girls. ”The criminologist in charge of the study, Christian Pfeiffer , explained the result:“ That is a horror rate. Adoption rights for same-sex couples

In August 2012, Busemann rejected a general right of adoption proposed by Federal Justice Minister Sabine Leutheusser-Schnarrenberger (FDP) with reference to the best interests of the child. He emphasized that the best interests of the child must take precedence over the will of the couple, as children of same-sex couples have to fear stigmatization and bullying . In addition, the presence of a father and mother is of particular importance for the "upbringing and personal development of children". He respected people's decision to "realize their life plans in other forms of partnership". He rejects "undifferentiated equality with marriage between men and women". The Lesbian and Gay Association (LSVD) called Busemann's argument irresponsible, and members of the Left and the Young Liberals accused him of discrimination.

Data retention

Busemann is an advocate of data retention . After the Federal Constitutional Court had declared the original regulation unconstitutional and thus void, it explained in August 2012 that in 2010 alone there had been 3,000 cases of child pornography , and in the following year only half. However, the number of crimes in this area has not decreased, it is just that they can no longer be prosecuted. "We are not allowed to do anything, I cannot accept that". Alcohol in traffic

In December 2010, Busemann called for the alcohol content in the blood to be lowered from 0.5 to 0.3 per mille . He also spoke out in favor of the abolition of the judge's reservation for blood samples . In February 2013 he was caught driving his company car with around 0.9 per mille. Busemann asserted that he himself thought he was still fit to drive after visiting a bar. He then apologized publicly: "I am embarrassed about the incident, I am extremely sorry".

Anti-Corruption Policy

As Minister of Justice and President of the State Parliament, Busemann has repeatedly stated that he is in favor of an intensification of the criminal offense of bribery of parliamentarians . Germany has not yet been able to ratify the UN Convention against Corruption , which was signed in 2003 , because buying votes by members of parliament is a criminal offense, but not influencing political decisions through monetary benefits. On April 9, 2013, Busemann therefore welcomed the change of course in the Legal Committee of the German Bundestag , which will enable the criminal offense to be intensified soon.
