The Cantonal Council is the cantonal parliament of the Canton of St. Gallen in Switzerland. It has 120 members. It usually meets five times a year. Since the canton was founded in 1803, the conference venue has been the cantonal council chamber in the former throne room of the prince abbot of St. Gallen. Until 2002 the official name of the parliament was the Grand Council .

The last general renewal elections took place in March 2020.

The Cantonal Council has 120 members who are elected according to the proportional representation system.

A legislative period usually begins every four years in June and ends in April shortly after the renewed general renewal elections - in February or March of the following period - with the so-called clean -up session .

In the constituent session - here too at the beginning of June of the year of the general renewal elections, in the first session of the legislative period - the members elect the President of the Cantonal Council, his deputy and three tellers from among their number. Together with the parliamentary group presidents, they form the presidium. The posts of president, vice-president and teller change annually.

The Cantonal Council meets five times a year. This usually happens in June, September, November, February and April. Depending on the number of business deals or the political situation, special sessions are also possible.

tasks

The Cantonal Council is the legislative power in the Canton of St.Gallen.

Its tasks according to Art. 65 of the Cantonal Constitution (KV) are essentially

  • the resolution of constitutional amendments
  • Enact, amend and repeal laws
  • Conclusion and termination of intergovernmental agreements with constitutional and legal status
  • Decision on the budget (annual budget) and taxes
  • Approval of the annual accounts
  • Oversight of government and courts

Decisions are made by a majority of the voting members. The majority of all members of the Cantonal Council can be provided for certain transactions. (Art. 66 KV)

In the event of urgency, the Cantonal Council can enact laws with immediate effect. However, these must be submitted to a referendum after one year at the latest (Art. 68 KV)

In contrast to other cantons, there are no legal provisions on the quorum of the cantonal council.

Resolutions of the Cantonal Council must be approved by referendum if

  • the constitution is changed or completely revised
  • intergovernmental agreements have been adopted which have constitutional status
  • the cantonal council does not approve a popular initiative or makes a counter-proposal

Furthermore, the constitution allows so-called financial referenda, i.e. referendums on expenditure of a certain amount. When these should be compulsory and optional is specified in the law on referendum and initiative.

In the canton of St.Gallen, for example, one-off expenses of more than CHF 15 million or annual expenses of more than CHF 1.5 million that recur for at least ten years must be submitted to the people for a vote. (Art. 6 Law on Referendum and Initiative (GRI)).

There is also an optional referendum; Legislative resolutions are then subject to a referendum if 4,000 voters or a third of the cantonal council members request it. (Art. 49 KV) This applies to all legislative resolutions and international treaties with legal character.

Decrees on the remuneration of state staff and teachers in primary schools are expressly exempt from the referendum.

The facultative referendum can be called for a one-off expenditure of CHF 3 million to CHF 15 million or a period of at least ten years of CHF 300,000 to 1.5 million. (Art. 7 GRI)

The financial referendum is restricted by Art 7bis, which provides for exceptions for state road construction and state contributions to transport companies. One-off expenses for the construction of state roads and state contributions for railway construction are only subject to an optional referendum above CHF 6 million.

Resolutions of the Cantonal Council to promote public transport that have recurring expenses of more than CHF 200,000 per line or more than CHF 2 million per tariff association for at least ten years are subject to an optional referendum.

The 120 members of the cantonal council are distributed among the eight constituencies of the canton and are elected for four years using the proportional representation procedure. The last general election for the Cantonal Council took place on March 8, 2020, at the same time as the election of the St. Gallen Government Council .
