On January 22, 1858 was renamed Winston County, named after the governor of Alabama , John A. Winston . Winston was previously a member of both houses of the State Legislature and was elected to the United States Senate in 1867 after serving as governor . Since he refused to take an oath of allegiance to the American Constitution under the Reconstruction Terms, he did not take his seat there.

During the civil war , Winston County refused to integrate into the Confederation and declared itself the "Republic of Winston" (now known as "the Free State of Winston"). Attempts by the state of Alabama to gain permanent control of the breakaway county were unsuccessful. After troops of the Union Army reached the northern part of Alabama on their advance along the Tennessee River in 1862, many residents of the county joined militia loyal to the Union, such as the "First Alabama Cavalry". After the war, Winston County became a Republican bastion .

Four buildings in the county are listed on the National Register of Historic Places (NRHP) (as of April 14, 2020), in addition to the Winston County Courthouse , these are the Archeological Site No. 1WI50 , the Feldman's Department Store, and the Houston Jail .
