Siegfried Kauder (2005)

Siegfried Kauder (born November 20, 1950 in Eigeltingen , Stockach district ) is a former German politician ( CDU ). From November 2009 to October 2013 he was Chairman of the Legal Committee of the 17th German Bundestag .

He is the younger brother of Volker Kauder , the former chairman of the CDU / CSU parliamentary group.

education and profession

After graduating from high school at Hegau-Gymnasium in Singen , Kauder completed a law degree at Albert-Ludwigs-Universität Freiburg , which he completed in 1975 with the first state examination in law. After his legal clerkship , he also passed the second state examination in 1978 and since then (until 2015) has been working as a lawyer in Villingen-Schwenningen .

Political party

Kauder joined the Junge Union in 1967 and the CDU in 1968. From 1993 to 2012 he was chairman of the CDU district association in the Schwarzwald-Baar district . After he was not nominated for the 2013 federal election by the CDU, he ran as an independent candidate and received 3% of the vote. Then he resigned from the CDU.

MP

Kauder was a member of the German Bundestag from 2002 to 2013 . He always moved into the Bundestag as a directly elected member of the constituency of Schwarzwald-Baar . In the 2005 Bundestag election he achieved 51.3 % of the first votes and in the 2009 Bundestag election 47.4% .

Kauder is one of the nine members of the Bundestag who sued the Federal Constitutional Court against the compulsory publication of their ancillary income as a result of the “Transparency Act” passed in 2005 ; the lawsuit failed. Nevertheless, despite repeated requests by the Bundestag presidium, he still refused to report the specific amounts of the income from his legal work. He only stated the income levels that corresponded to the amounts in his view. In doing so, he violated the rules of conduct for members of the German Bundestag (Section 1, Paragraph 3, Clause 1, in conjunction with Paragraph 2, Number 1 of the Rules of Conduct) and was publicly reprimanded by the Bundestag Presidium on October 16, 2013 in accordance with the Rules of Procedure of the German Bundestag.

Chairman of the BND committee of inquiry

From April 2006 Kauder was chairman of the 1st committee of inquiry of the 16th electoral term, the so-called BND committee of inquiry ( Kurnaz committee of inquiry ). Because allegedly secret or confidential papers of the investigative committee were passed on to journalists by committee members, the public prosecutor's offices in Munich, Frankfurt and Berlin investigated a total of 17 journalists ( Der Spiegel , Süddeutsche Zeitung , Zeit , Frankfurter Rundschau , Tagesspiegel , Berliner Zeitung , tageszeitung , Welt ). A large number of commentators from the press, radio and television saw this as an attempt to restrict the freedom of the press, intimidate journalists and prevent them from doing their work, as a need for secrecy for a large part of the files that were stamped as classified information - only for official use is disputed. In addition to blank pages, newspaper clippings are said to have been classified as secret or classified information by means of a stamp. In addition to Kauder, the second committee chairman Jung and the President of the Bundestag Norbert Lammert also supported the work of the public prosecutor's offices, while other committee members - including Max Stadler , Thomas Oppermann , Christian Ströbele , Petra Pau and Michael Hartmann - criticized the public prosecutor's proceedings, in some cases sharply. Lammert had made the proceedings possible through a criminal prosecution authorization. Critics assumed that the institutions providing the files - including the federal government and the BND - intended to cover up. The federal press conference demanded that the investigation be stopped immediately. In the Cicero judgment it was decided that the mere publication of official secrets is no longer sufficient to justify suspicion of aiding and abetting the betrayal. Chairman Kauder almost caused a scandal when, during the questioning on June 26, 2008, he did not want to give the chairman of Bündnis 90 / Die Grünen an opportunity to question Heinz Fromm , President of the Office for the Protection of the Constitution . It was only after Ströbele protested and objected to it by other parties in the committee that the committee later received its rights.

Candidate nomination for the federal election 2013

A CDU constituency assembly took place on July 17, 2012, at which Siegfried Kauder was to be nominated as a constituency candidate for the 2013 federal election . A majority of voters, however, spoke out in favor of postponing the nomination due to dissatisfaction with Kauder. Among other things, he had given a former district manager a ban from entering the house for no apparent reason; the Junge Union (JU) criticized his lack of willingness to talk and was shocked by Kauder's statement that the JU was “not an organization of the CDU”. The former Baden-Württemberg Prime Minister Erwin Teufel , who was supposed to mediate between Kauder and his opponents, declared his attempt in October 2012 to have failed. Kauder described the arbitration as "bullshit". When his opponents reproached that he had recently had a "personality change", Kauder said there was a medical finding that he was up to the task as a member of parliament. At the request of Kauder's opponents, the mayor of Donaueschingen , Thorsten Frei , declared that he would compete against him. Siegfried Kauder said he was sticking to his candidacy. In a letter to the CDU members of the constituency, Kauder raised serious allegations against his critics.

At the CDU constituency assembly on November 16, 2012, which was attended by 733 CDU members with voting rights, Thorsten Frei was nominated as a direct candidate with 68.6% of the votes, while Siegfried Kauder received 31.4% of the votes.

Kauder ran as a single applicant in his previous constituency. The CDU state chairman Thomas Strobl advised Kauder in mid-July 2013 to leave the CDU in order to forestall a party exclusion. Volker Kauder advocated the exclusion of his brother Siegfried from the party.

On August 8, 2013, the CDU district executive in the Schwarzwald-Baar district voted with 17 out of 19 votes for an application for exclusion from the party, which should be negotiated before the arbitration tribunal of the state CDU. In the federal election on September 22, 2013 Kauder received 3.0% of the first votes in the constituency of Schwarzwald-Baar. Shortly after the federal election, he left the CDU.

Other engagement

Kauder was President of the Federal Association of German Music Associations (BDMV) from 2010 to 2016 . From 1998 to 2014 he was a member of the executive board of the White Ring , Mainz . Furthermore, he was president of the soccer club FC 08 Villingen from 2010 to 2014 .

Private life

Widowed since he was 46, Kauder has been married again since 2011.

Political positions

Bribery of Members of Parliament

On April 8, 2011, Kauder spoke out in a speech to the German Bundestag against stricter legal regulations with regard to corruption and the bribery of members of parliament. He refused to ratify an international UN agreement to fight corruption. As a reason for his rejection, he cited the vague formulation of the UN Convention and what he saw as the wrong view of MPs as officials. In addition, Kauder takes the position that parliamentarism and lobbyism are inextricably linked and concludes from this that potential cash flows should not be punished. Kauder explained in this context: "For a politician, suspicion is enough, and the office he has is already damaged." In 2013, Kauder acted as a co-initiator of a cross-faction bill that not only "accepted the benefits of." Mandate holders ”, but also the granting of advantages is a criminal offense. He was isolated within the CDU / CSU parliamentary group. In addition to Kauder, all opposition factions, including the left, supported the motion.

Stock exchange sales tax

Kauder generally rejects a stock exchange sales tax . In September 2009, he declared that the introduction of the relevant taxes was not justifiable in his view. He stated "In the current difficult economic situation, tax increases do not fit into the political landscape".

Freedom of the press and criticism

At the end of November 2010, Kauder, who at that time already held the office of chairman of the legal committee of the Bundestag, demanded , due to terror warnings in Germany, that the press must be obliged to refrain from reporting on places at risk, as such reports may be an incentive for terrorists. His proposals in this regard were seen in parts of the German press landscape as a demand for restrictions on press freedom . However, the CDU / CSU parliamentary group rejected Kauder's proposal.

According to Spiegel Online , Kauder renewed his attacks on freedom of the press in September 2011 in the debate about the so-called “Depeschen Debacle” and the discussion about Wikileaks . In an editorial on Spiegel Online this position was described as "populist - and dangerous". The German Association of Journalists rejected Kauder's demands. Michael Konken , chairman of the association, regretted that Kauder was making a new attempt with the same goal only nine months after his last attempt to restrict freedom of the press.

Two strikes warning model

In autumn 2011 it became known that Kauder was promoting a two-strikes warning model for copyright infringements on the Internet. He announced that he would introduce a corresponding bill in the fourth quarter of 2011. He justified his initiative by stating that, as President of the Federal Association of German Music Associations (BDMV), he was dissatisfied, as FDP Justice Minister Sabine Leutheusser-Schnarrenberger had not yet submitted a draft for a new amendment to copyright that contained such an obligation. Kauder emphasized that the warning model had to be taken out of the third basket on copyright law and presented as a “little law”. The music industry reacted enthusiastically to this proposal, while critical voices were raised about his initiative from his own group.

During the debate about the Two Strikes model, a poem was published on Google+ in which the assumption was made that Kauder repeatedly infringed the copyrights of others on his website by taking at least two images from the Panoramio photo service without knowing or naming the respective author and had used it without a copyright notice. After further dissemination of these allegations, Kauder confirmed the use of third-party images, as well as their removal from his website and used the process as an example of the practicality of his own legislative proposals. At the same time, he stated that he now owned the copyrights to the two photos, which in Germany, in contrast to the rights of use, is only possible through inheritance. As a result of this unlawful "appropriation" of copyright, the verb "kaudern" per tweet was redefined ".
