The state constituent assembly for Württemberg-Baden was elected on June 30, 1946. Its main task was to give the state of Württemberg-Baden established in the American occupation zone a new constitution.

After the Second World War , the states of Baden and Württemberg were divided between the American occupation zone in the north and the French zone in the south. The states of Württemberg-Hohenzollern and Baden were established within the French zone, and the state of Württemberg-Baden in the American zone .

In the emerging state of Württemberg-Baden, the first parliamentary tasks were initially performed by a district councilors' conference and, from January 1946, by the provisional parliament for Württemberg-Baden . On February 11, 1946, the American military administration ordered that the Interim People's Representation should set up a preparatory constitutional commission whose task it was to prepare a constitution and draft a bill for the election of a constituent assembly. The members of the Standing Committee of the Provisional People's Representation were represented in this commission, supplemented by constitutional law experts such as Carlo Schmid . Under the leadership of Carlo Schmid, the commission worked out a draft constitution. A draft law drawn up by the Interior Ministry under Fritz Ulrich on the election of a state constituent assembly was discussed by the commission, approved by the military government and announced on March 21, 1946.

The election for the constituent state assembly took place on June 30, 1946. 1,790,403 citizens of the state of Württemberg-Baden were eligible to vote. The turnout was 67.5 percent.

The first meeting of the assembly took place on July 15, 1946 in the Furtbachhaus in Stuttgart and was chaired by Wilhelm Keil as senior president. President was William Simpfendörfer selected.

The assembly set up a constitutional committee, which, under the direction of Wilhelm Keil and with advice from Carlo Schmid, further developed the draft drawn up by the preparatory constitutional commission. On October 24, 1946, the state constituent assembly adopted the draft constitution. The referendum on the constitution took place at the same time as the election for the first state parliament of Württemberg-Baden on November 24, 1946. A total of 921,628 citizens voted yes and 140,657 no.

The constitution entered into force on the day of its promulgation, November 28, 1946. Thus it was the first constitution of a German country after the Second World War , before the Hessian constitution .
