A state or federal state is a member state of the federally organized Republic of Austria . The federal states represent local authorities , i.e. legally independent entities. Within the federal constitution one speaks of the state level as the opposite of the federal level .

Position of the countries in the state

The states have their own state constitutions , which may not contradict the federal constitution. In addition, they have their own legislative bodies with the state parliaments and their own executive bodies with the state governments . The judiciary , on the other hand, with the exception of administrative jurisdiction , belongs to the federal government alone.

The states are also administrative units of the federal government; In the context of indirect federal administration , state bodies also work for the federal government.

Five of the nine Austrian federal states, Lower Austria, Carinthia, Styria, Tyrol, Salzburg (as an archbishopric), were established in the Middle Ages , Upper Austria became independent under Joseph II in 1783/84; Vorarlberg was part of Tyrol for a long time and became independent in 1861; In 1921 Burgenland, which had been part of Hungary until then, was added. In 1922 Vienna was finally separated from Lower Austria and raised to the status of a separate federal state.

For major border changes between the federal states, laws of the federal government and the affected states must be the same. If only border adjustments between the countries are carried out, the corresponding laws of the countries concerned are sufficient.

About the terms country and state

The Federal Constitutional Law mainly uses the term land instead of federal state . The state constitutions also follow this choice of words.
