After the War of the Polish Succession , the Peace of Vienna brought an agreement: the candidate of the French party, Stanislaus I. Leszczyński , renounced the Polish crown and received Lorraine in return; Franz Stephan in turn renounces this, but not the title of (titular) Duke of Lorraine, in favor of Tuscany . Franz Stephan was also interested in obtaining consent to marry Maria Theresa (1736). It was also agreed that the country would fall to France after Leszczyński's death , in 1766. The title of Duke of Lorraine is still used by the descendants from the marriage of Franz Stephen to Maria Theresa, the heiress of the House of Habsburg (including the Roman-German emperors from Joseph II and the Austrian emperors); these form the House of Habsburg-Lothringen .

In the 16th century, Lorraine historians tried to increase the legitimacy of the Dukes of Lorraine through a direct connection with the Carolingians ; They therefore called the Duke Karl von Niederlothringen, who died in 991, as Karl I and began counting the Dukes of (Upper) Lorraine with that name as Karl II .; this approach has been preserved to this day.
