The nature reserve in Burgenland nature conservation and landscape conservation law

Section 21 of the Burgenland Nature Conservation and Landscape Management Act (NG 1990) determines the type of nature reserve:

"Section 21. (1) Areas,

a) which are characterized by complete or extensive originality and in which the course of a natural development is guaranteed (§ 1 Paragraph 1 [ Objectives , Note] lit. b),
b) the rare or endangered animal or plant species or which can accommodate such after the course of natural developments (Section 1 (1) c),
c) which have rare or endangered communities of animals or plants or which may have such communities with or after the course of natural developments (Section 1 (1) c) or
d) in which rare or scientifically interesting minerals and fossils occur (Section VIII [ Protection of Minerals and Fossils , Note]),

can be declared nature reserves by ordinance of the state government . "

The protective provisions are set out in § 21a and include, as “it is necessary to achieve the protective purpose”, measures from “to prohibit any human intervention in the protected area, including entry”, restriction to certain routes ( route command ) to towards exceptions for "modern, sustainable country - and forestry use, the lawful pursuit of hunting and fishing , the necessary maintenance and servicing officially approved systems and measures to preserve or improve the protection purpose," and "intervention for scientific purposes or for Purposes of training at scientific institutions ", always provided that" there is no lasting impairment of the protective purpose associated with it "-" long-term ecological research and studies "are expressly part of the protective purpose (Section 21, Paragraph 1)

In contrast to most of the other federal states, Burgenland generally sets strict criteria for environmental and landscape protection (II. Section General Nature and Landscape Protection NG). The express prerequisite for a favorable forecast of the development is also particularly important. The explicit mention of minerals and fossils is similar to the regulations in Lower Austria and Vorarlberg, otherwise such areas usually fall under the definition of natural monuments .
