Reactions and actions

Reactions and measures of the state authorities

Laws

On March 19, the state parliament passed a law that declared the COVID-19 pandemic a natural disaster. In addition, an addendum to the 2020/2021 state budget was adopted. This allows loans of up to 5 billion euros to be taken out to cover expenses in connection with the pandemic ( Journal of Laws p. 125 ).

Regulations

Many of the measures that the state government took were regulated in ordinances . The most comprehensive was the Corona Ordinance , which was announced on March 16, 2020 and is due to expire on June 15. The state government shaped the way through the pandemic with several new versions, amending ordinances and other ordinances. On June 23, 2020, the state government passed a new ordinance on infection protection measures, which came into force on July 1, 2020.

Restaurants were allowed to continue operating under strict conditions.

Closed playground at the end of March 2020 in Ulm

After a change in the regulation, discos, clubs, bars, playgrounds, football fields, amusement parks, animal parks and all retail outlets (with the exception of food retail, weekly markets, pick-up and delivery services, beverage markets, pharmacies, medical supply stores, drug stores, petrol stations , Banks and savings banks, post offices, hairdressers, dry cleaners, laundromats, newspaper sales, farm shops, Raiffeisen, DIY, horticultural and pet supplies markets and wholesalers ) close on the following day.

From March 21, restaurants had to close, the pick-up and delivery service was still permitted. Hairdressers, nail salons and the like had to close. The operation of hotels and guesthouses for tourist purposes was prohibited, business travelers were still allowed to be accepted. The distribution points for the food banks were allowed to resume operations.

Company canteens were allowed to reopen from March 22nd.

With another change on April 10th, dental treatments were regulated, only the treatment of acute cases was permitted.

On April 15, Prime Minister Kretschmann announced that the Corona regulation would be changed so that all retail outlets up to a sales area of 800 square meters as well as car, bicycle, bookseller and libraries will reopen under strict hygiene requirements from April 20 allowed to. According to a complaint by a retailer, retailers with a sales area of more than 800 square meters were allowed to open from April 23, if the area with partitions was reduced to less than 800 square meters.

From May 4th, retailers were allowed to reopen completely, with one customer per 20 square meters of retail space as a guide. Hair salons and pedicure studios with strict hygiene rules were also allowed to open to customers. Dentists were allowed to perform their treatments in full again. From May 6th, zoos, museums and playgrounds opened; here too, strict hygiene rules were a prerequisite for opening.

From May 11th, the regulations were further relaxed so that service providers close to the body (e.g. nail salons), driving schools, music and art schools as well as casinos and amusement arcades could resume operations subject to hygiene requirements. In addition, training in outdoor sports facilities was allowed to resume, provided that the contact restrictions still apply .

From May 18th, pubs and restaurants were allowed to resume operations, as were holiday apartments and campsites. Hotels and amusement parks reopened to the public on May 29th, the outside areas of pubs and bars on May 30th and the indoor areas of sports facilities on May 31st.

Stay in public space and block contacts

On March 20, a change in the Corona regulation prohibited more than three people from staying in public spaces .

In order to harmonize the regulations nationwide, the federal states agreed on a common catalog of measures. With one change, the state government essentially implemented these changes. From the entry into force on March 22nd, only one other person not living in the household was allowed to stay in public space. In public spaces, a minimum distance of 1.5 meters to other people had to be maintained wherever possible. No more than five people were allowed to meet in private, but the closest family circle was excluded from this regulation.

From May 11th, meetings in the public space of two different households were allowed to take place again. The number of people no longer played a role. In private space - but not in public space - siblings (sideline) and their descendants (i.e. children and grandchildren) were also allowed to meet. From May 27th, meetings of up to ten people in private rooms were again allowed. The number of participants was increased to 20 with effect from July 1, 2020 and has since then been uniform for meetings in private and public spaces.

Health care measures

With the entry into force of the Corona Ordinance on March 17, 2020, restrictions on visits to clinics, retirement and nursing homes and facilities for the disabled were set. Later, in order to protect patients, the Ministry of Health stipulated, in addition to visiting restrictions, that more and more tests should be carried out on patients and employees in these facilities in order to effectively break the chains of infection. In order to protect the residents of old people's homes, nursing homes and facilities for people with disabilities, strict exit restrictions were issued on April 7, 2020. Residents were not allowed to leave the facility for no good reason, such as visiting a doctor or running errands that the facility could not meet. Walks in public spaces were only allowed if the facility's premises were not large enough. As of May 6, the exit restrictions for residents were relaxed, residents were allowed to leave the premises again, but were only allowed to enter the common areas with a mask for 14 days after their return. From May 18th, visits to hospitals and old people's homes were again possible subject to strict hygiene regulations.

Teaching and education

From March 3, 2020, the Ministry of Culture prohibited all school trips to risk areas, and trips that had started had to be canceled. Planned trips abroad had to be evaluated by the local health department before starting . On March 20, the ministry banned all extracurricular events until the end of the school year, trips that had already been booked had to be canceled.

At the end of February and beginning of March 2020, schools in Baden-Württemberg were partially or completely closed, and the decisions were made by the respective local health authorities.

On March 13, 2020, Baden-Württemberg ordered the state-wide closure of all schools and day-care centers from March 17 to April 18. Monday, March 16, 2020, should be used by the teachers to prepare the students for homeschooling . Schools for medical / nursing professions were allowed to reopen on March 18. On March 16, 2020, Minister of Culture Eisenmann announced that the school closure would be extended until April 30. From May 4, the final classes of all schools as well as the final classes in 2021 at the general schools were schooled again. The further procedure will take place gradually, she explained, and [we] e will certainly have to struggle with the consequences of the corona crisis in the next school year. In primary schools, face-to-face classes began on May 18, and day-care centers opened for 50% of the children on May 18.

In the closed facilities, the ordinance also stipulated that emergency care was to be offered for children in these facilities up to the 6th grade if the legal guardians were active in areas of critical infrastructure (such as health care, public safety and order, public infrastructure or the food industry) . At the special education and counseling centers with a focus on mental development and physical and motor development, emergency care was also available beyond these grade levels. Emergency care should also take place during the Easter break. The communities were urged to also set up emergency care at the day-care centers. From April 27, the emergency care was extended to 7th grade students and to students whose parents worked in occupations requiring attendance and could not provide any other care.

On March 14th, the Ministry of Education and Culture announced that exams that take place during the school closings will be postponed. All exams starting April 21st should take place as scheduled. Minister Eisenmann announced that the special situation would be taken into account when selecting the examination questions. On March 27, all final exams were postponed and changes to the examination regulations announced. In addition, two night Ermine in the school year 2019/2020 and a night Ermin in September 2020 were provided for all tests and the non-offsetting exposed unique.

The beginning of the summer semester at the colleges, technical colleges and universities in the state was postponed to April 20 and extended nationwide until September 2020, accordingly the start of the winter semester was postponed to November. Lectures were largely held digitally, face-to-face events were only allowed until May 3 if they were absolutely necessary.

Private educational institutions for vocational training were allowed to gradually resume teaching on May 4th.

Religious events

On the basis of the Infection Protection Act (IfSG), the Ministry of Culture banned almost all religious events and gatherings of all faiths on March 21 . Only weddings and baptisms in close family circle (no more than five people) as well as funerals and funeral services in the open air with no more than ten people were permitted. In addition, the celebration of church services on a small scale for broadcast as a live stream or for recording was allowed. As of April 2, the maximum number of people attending funerals has been reduced to five. Church services and similar religious events took place again from May 4th, while observing the distance requirement. Funerals were limited to a maximum of 50 participants.

Dealing with travelers from abroad

On February 27, 2020, the Ministry of Culture issued the directive that all persons involved in school life (i.e. students, teachers and non-teaching staff) who had contact with a COVID-19 sufferer or who had visited a risk area in the last 14 days, except for should stay at home again. On February 28, the Ministry of Health recommended travelers returning (initially only from Northern Italy, later from all risk areas) to go into isolation for 14 days and avoid unnecessary social contacts. Employees of the country should not appear on duty, but rather contact their office by telephone. On March 16, people returning from the risk areas were banned from entering schools, universities, clinics, retirement and nursing homes and facilities for the disabled. From March 21st, journeys from the risk areas to Baden-Württemberg were only allowed to work, deliver goods and for special personal reasons (e.g. death); this regulation was canceled on April 10th. From April 11th, all immigrants from abroad , with a few exceptions, for example commuters , had to isolate themselves independently for 14 days and were not allowed to pursue any professional activity.

Events and meetings

On March 8, 2020, Federal Health Minister Spahn recommended the cancellation of events with more than 1,000 people in Germany. State Health Minister Manne Lucha also recommended this a day later. On March 11, 2020, all events in Baden-Württemberg with more than 1,000 people were prohibited by decree. On March 13, it was announced that the maximum number of participants had been reduced to 100. With the change in the Corona regulation on March 17, outdoor events and gatherings were banned from March 18, regardless of the number of people. After another change to the Corona regulation on March 20, all gatherings, also in private, with more than five people were forbidden, unless the participants are directly related (e.g. grandparents), partners, in a domestic community live together or have to work together for social or business reasons. Furthermore, meetings to maintain public safety and order or to serve public services (e.g. notaries and courts) were exempt from the restrictions. At the beginning of May, the state government announced that major events such as folk festivals, larger concerts, village and street festivals and large sporting events with more than 500 visitors would be banned until at least August 31st. From June 1st, events with fixed seats and a maximum of 100 participants were permitted again. Private celebrations with fewer than 100 participants, which take place in specially rented rooms, were again permitted from June 9, 2020, subject to conditions. Further easing was decided on June 23, 2020. For example, the number of participants for events with fixed seats was increased to 250 with effect from July 1, and events with up to 500 participants were allowed again from August 1, 2020.

Wearing everyday masks

In Baden-Württemberg, Sulz am Neckar and Kirchheim unter Teck were the first cities to introduce a mask requirement. With the fifth amendment to the Corona regulation, the state government made an urgent recommendation to wear so-called everyday masks in retail and local transport. A few days after the recommendation, an obligation to wear everyday masks in retail and local transport was declared as of April 27, as the state government had determined that the recommendation was not being adequately adhered to. On May 11th, carrying was expanded to include long-distance rail transport and airports.

Since mid-April 2020, Baden-Württemberg has been the first federal state to allow protective masks to be worn at the wheel for the duration of the COVID-19 pandemic. This is especially true for taxi and bus drivers. The eyes and forehead must remain recognizable.

Catalog of fines

On March 29, 2020, violations of the Corona Ordinance were declared administrative offenses and a catalog of fines was issued. Fines between 100 and 5,000 euros could be imposed, in the event of repetition up to 25,000 euros.

Public calls

In Baden-Württemberg teachers were asked to volunteer for work in health authorities or hospitals. More than 5,000 students volunteered in response to a call from the Ministry of Science , of which around 1,000 were employed as student assistants in laboratories, health authorities and clinics. The Ministry of Health called on nurses and comparable professional groups who do not work in nursing to register on the Bertelsmann Stiftung's #pflegereserve portal . The portal establishes contact between institutions and potential workers and is intended to reduce potential bottlenecks in health care.

Health care measures

In addition, a task force was set up at the Ministry of the Interior to coordinate and organize the procurement of urgently needed protective equipment and to distribute it to the urban and rural districts according to a specified distribution key.

On March 5, the Ministry of the Interior presented the COVID-19 Resource Board. It was supposed to facilitate the distribution of patients with COVID-19 to all hospitals in the country. The instrument displayed all free intensive care and ventilation beds in all hospitals in real time. If there should be a nationwide distribution, the overhead control center, located in the Ministry of the Interior, the assignment of the patient to a hospital.

State Health Office

On January 27, the State Health Office announced that, in cooperation with the Ministry of Social Affairs, information about the handling of suspected cases of COVID-19 had been given to the State Medical Association and that airports and train stations had been informed about how to deal with returning travelers . Since April 3, the State Health Office has published a daily status report that contains the current number of cases and an assessment of the situation in Baden-Württemberg.

Emergency financial aid

On March 25, 2020, the Ministry of the Interior launched an emergency aid program for companies with up to 50 employees, self-employed persons and members of the liberal professions . These are supported with a one-time, non-repayable grant of between 9,000 and 30,000 euros. By April 7, 2020, almost 120,000 applications had been processed and 1.14 billion euros had already been paid out. The Ministry of Education and Sports and the State Sports Association make funds available from the Solidarity Pact for sports clubs that cannot receive funds from one of the rescue packages and are in financial need. The minister called for members to remain loyal to their association.

The Ministry of the Interior made 15.3 million euros available for volunteers in civil protection. The aim was to quickly and unbureaucratically compensate volunteers for their work and compensate for any loss of earnings. According to Finance Minister Edith Sitzmann , this should ensure that no one suffers disadvantages as a result of their involvement in the pandemic.

Dealing with elections and community issues

Protection against infection always had priority when elections were held, so it had to be ensured that sufficient distance could be maintained in the polling stations and during the counting. Individual municipalities voted in pure postal votes , with a central polling station or postponed the election. The processes in the municipal councils and district assemblies were also adapted, necessary meetings were allowed to take place as video or telephone conferences , but the principle of publicity had to be observed.

Reactions and measures of the districts

On May 5, the federal and state governments agreed that urban and rural districts, in which more than 50 new infections per 100,000 inhabitants were reported within seven days, would introduce local restrictions on social and economic life. The district of Karlsruhe sets the upper limit at 35 new infections per 100,000 inhabitants.

Health system responses and actions

Outpatient care

Specialized practices for the treatment and diagnosis of infected people have been set up across the country. For this purpose, provisional practices were opened in town halls and sports halls, on the one hand, and general practitioners' practices were defined as specialist practices that only took care of suspected cases and confirmed infections. According to the Baden-Württemberg Association of Statutory Health Insurance Physicians, 20 provisional practices and a further 90 specialty practices in general practitioners' practices were available. Drive-in test centers have opened in several cities. Suspected cases could be tested relatively quickly and safely after referral by the family doctor. This was to prevent patients from having a lot of contact with people or objects that then had to be disinfected at great expense, and to limit the donning and doffing of personal protective equipment to the bare minimum. Drive-in were used in Nürtingen , Stuttgart and Schorndorf , for example .

Inpatient care

The districts set up emergency clinics in exhibition halls to relieve the hospitals, u. a. in the Stuttgart trade fair . These emergency clinics were designed for the inpatient treatment of patients with milder symptoms and relieve the burden on general practitioners, as an outpatient fever clinic was sometimes attached. In addition, closed hospitals were reactivated and used as isolation wards for infected people who have no way of isolating themselves at home. Several counties wanted to use rehabilitation clinics as makeshift hospitals in an emergency. At the end of March, around 2,200 hospital beds with the option of ventilation were available in Baden-Württemberg; by April 7, this number had been increased to 2,800. In order to relieve the hospitals in neighboring Alsace , hospitals in Karlsruhe, Mannheim, Freiburg and Ulm took over the treatment of 23 French citizens.

Responses and measures of the transport system

In order to increase the availability of goods, the Sunday driving ban for trucks was suspended. Despite this exception, significantly fewer traffic jams were reported; the ADAC stated that there was hardly any traffic on the autobahns and that the number of traffic jams had decreased by 85% between calendar weeks 11 and 14. The border controls at the borders with France and Switzerland led to delays. Only ten border crossings were available for crossing the French-German border , at these there were waiting times of up to 45 minutes, but mostly on the French side.

Long-distance cross-border passenger rail transport to both France and Switzerland was almost completely discontinued, and local cross-border passenger transport ran only with major restrictions. The timetable has been thinned out for local public transport . In many transport associations , local transport was operated according to holiday timetables, and night transport offers were often completely discontinued. The Ministry of Transport recommended that the transport associations refrain from selling tickets and ticket inspections in trains and buses and opening the car doors centrally. According to VAG , the number of passengers in the city of Freiburg decreased by 70%. Occasional traffic almost completely collapsed in the VVS network .

Ferry operations on Lake Constance were also initially completely stopped, and freight traffic could be resumed at the end of March.

The number of passengers at Stuttgart Airport plummeted, with less than 10% of the usual passengers being recorded. The airport operator took advantage of the effects of the pandemic and on March 6th completely ceased flight operations due to construction work, originally operations should continue during construction work. A few passenger flights were still processed at the Baden-Airpark . a. flights with harvest workers from Romania landed there.

Jurisprudence

Before the administrative court in Sigmaringen , an operator of a shop complained that she had to keep her shop with over 800 square meters of retail space closed, even if she only made 800 square meters accessible to customers through partitions. In the opinion of the administrative court, the Corona regulation allowed such separations; therefore the plaintiff was right. The country said it would not appeal the decision and changed the policy on opening retail establishments.

Other effects

Closed facilities

Several clinics, old people's and nursing homes had to be quarantined or temporarily closed during the COVID-19 pandemic. The State Health Office reported at least 2,450 infections among medical staff on May 14, 2020, the proportion of which is attributable to doctors or nurses was not recorded. In several clinics, doctors continued to practice under strict conditions after contact with an infected person. As of April 7th, around 450 cases of COVID-19 were detected in 43 geriatric care facilities in Baden-Württemberg. Infected residents were isolated in single rooms, and nurses were ordered to quarantine at home. In individual homes there was a very high number of cases, and the resulting staff shortages were so great that those infected without symptoms continued to work or new nurses were sought at short notice. The lack of personal protective equipment was also problematic.

In two rehabilitation clinics and five nursing homes, a complete quarantine had to be ordered during the COVID-19 pandemic in the Main-Tauber district after an increase in infections among employees, patients and residents. The federal fencing base in Tauberbischofsheim also had to be temporarily closed.

In the state initial reception center in Ellwangen , almost half of the residents were infected. A contact and curfew was then imposed, which was monitored by the police. A quarantine area has been set up within the facility. In Althütte , the state set up an isolation center for refugees in a former youth camp. It relieved the four state initial reception centers in the country, as isolation was difficult to implement there. The center was under video surveillance and a security service made sure that no one left the premises.

Areas particularly affected

With more than 670 infections per 100,000 inhabitants, the Hohenlohe district is the most severely affected district in Baden-Württemberg (as of May 14). In the meantime, 2.2% of the district population was in quarantine at home. The district administrator Mathias Neth suspected a church concert in Eschental as a source of infection.

More than 100 COVID-19-related deaths had been reported by May 14, 2020 from the Esslingen and Ortenau districts .

Due to a noticeable increase in the number of cases, on April 17, 2020, Sulz am Neckar in the Rottweil district was the first city in Baden-Württemberg to issue a general order to introduce the mask requirement in places where close encounters are unavoidable, e.g. E.g. when shopping or on public transport.

criticism

The medical director of the Esslingen Clinic and virologist Michael Geißler criticized the school closings in Baden-Württemberg. In the worst case scenario, these would infect the groups at risk. Instead, he advocated hygiene measures in schools.

The managing director of the Baden-Württemberg Hospital Society criticized the fact that the Baden-Württemberg hospitals have to enter their vacant intensive care beds in two different systems, namely in the federally prescribed DIVI intensive care register and the resource board prescribed by the state.

Some health authorities passed on the personal data of infected people to the police. Both the deputy state parliamentary group chairman of the SPD, Sascha Binder, and the state's data protection officer, Stefan Brink, were critical of this. However, the police union defended the action as there was insufficient protective equipment for the police officers. The Ministry of the Interior also saw the procedure as uncritical, as the data would be deleted after recovery. On March 26th, the Ministry of Social Affairs instructed the health authorities not to pass on the data.

The slow disbursement of emergency aid to companies was also criticized. While other federal states did this fully electronically without a handwritten signature, a handwritten signature was necessary in Baden-Württemberg. In addition, in Baden-Württemberg the applications were checked before the distribution, in Bavaria, for example, afterwards. The President of the Federation of Self-Employed People hoped that the application backlog would only cost a few livelihoods. Individual members of the FDP and SPD joined the criticism. The IHK , on the other hand, spoke of rapid processing. The L-Bank pointed out that after a simplification of the procedure, only about a week would pass between receipt of the application and payment.
