Restriction of visiting rights

The standard rates apply to an intentional first violation and are to be doubled in the case of subsequent violations or repeated violations. In the event of negligence, the standard rates are to be halved. The rules and frameworks can be increased or decreased according to the principles of Section 17 (3) and (4) sentence 1 OWiG, depending on the circumstances of the individual case, within the respective legal limits.

Regardless of the regulatory offense, a violation can also be a criminal offense in accordance with Section 75 of the Act for the Prevention and Control of Infectious Diseases in Humans (Infection Protection Act - IfSG). There, anyone who violates an enforceable order can be punished with a prison sentence of up to two years or a fine.

Violations found and fines imposed

By the beginning of August, 64,143 reports of administrative offenses and criminal offenses in accordance with the Infection Protection Act had been recorded across Bavaria against 58,282 people affected. The following violations were punished: 45,441 against exit restrictions, 15,758 because of prohibited gatherings, 1,882 against the mask requirement, 1,777 against event bans and 437 against quarantine obligations.

In the three largest Bavarian cities, fines of 1.6 million euros were waived by August 21, of which around 950,000 euros in Munich (5,220 notices), around 400,000 euros in Augsburg (approx. 1,700) notices and 262,525 euros in Nuremberg (1,861 notices).

Aid programs of the "Bavaria umbrella"

On March 31, 2020, the Bavarian government cabinet decided on the “Bavaria umbrella” (independent state aid programs amounting to 60 billion euros). Of this, 20 billion euros are earmarked for a participation package and a further 40 billion euros for guarantees and loans.

Nursing bonuses

At the meeting on April 7, 2020, the Bavarian cabinet decided that 250,000 nurses in Bavarian hospitals, retirement homes and outpatient care, as well as paramedics and paramedics, would receive a tax-free one-off payment. The requirement and obligation to cover the mouth and nose

Ordered by the Second Bavarian Infection Protection Measures Ordinance of April 16 (2nd BayIfSMV), from April 20, people should wear a mouth and nose cover when using local public transport (ÖPNV) (Section 6). The staff as well as the customers of open shops are to wear a mouth and nose cover from April 20 (§ 2).

In his government statement on April 20, Markus Söder announced an obligation to apply such coverings from April 27. This means that your mouth and nose must be covered in public transport (excluding the driver) and in shops (including staff). On April 21, 2020, the Bavarian cabinet decided that the obligation should apply to children from the age of 7. On May 29, 2020, the AfD Bavaria demanded the immediate lifting of the mask requirement; however, the demand was largely ignored in the media and in legislative terms. On April 8, 2020, the Bavarian MPs of the AfD demanded “the consistent wearing of (even makeshift) mouth and nose masks to protect others in closed public spaces”.

Ban on accommodation for visitors from hotspot districts

At his press conference on June 23, 2020, the head of the Bavarian State Chancellery, Florian Herrmann, announced the decision of the Bavarian cabinet that Bavarian accommodation providers in Bavaria are not allowed to accept guests from counties with more than 50 new infections per 100,000 inhabitants in the past seven days. People from corresponding districts or cities may only be admitted to Bavarian hotels, guest houses and holiday apartments if they can show a current negative Corona test. This measure was justified in particular with the current infection numbers and the corona events in the North Rhine-Westphalian districts of Gütersloh and Warendorf .

On July 28, 2020, the Bavarian Administrative Court temporarily suspended the regulation. The court justified its decision that the conclusion that a new infection frequency in seven days of more than 50 per 100,000 inhabitants of a rural district / urban district automatically leads to a ban on accommodation is not proportionate. Test margin for travelers returning

Tests for COVID-19 have been carried out at the Bavarian motorway crossings, Nuremberg , Munich and Memmingen airports and the main train stations in Nuremberg and Munich since the start of the Bavarian holiday on July 27th . On August 12, the Bavarian Health Minister Huml admitted that 40,000 people tested had not yet been informed of the result; this would correspond to more than half of the cases, including 1,000 who tested positive from all over Germany. 908 people who tested positive had been informed by August 13th. In response to the breakdown, the head of the Bavarian State Office for Health and Food Safety (LGL), Andreas Zapf, was transferred to the Bavarian Ministry of Health after twelve years; responsibility for the operation of the test centers was transferred from the LGL to the Bavarian Ministry of the Interior. In addition, the LGL is to receive 100 new jobs in order to be able to do the work better in the future. The test stations were initially operated by voluntary aid organizations, which, at least at the beginning of the tests, did not have the technical capabilities for rapid, continuous digital data processing. It was already planned that private providers would gradually take over operation from August 10th. This should also digitize data transmission at all points.

The responsibility for the corona test stations at the main train stations in Nuremberg and Munich has been transferred to the Eurofins company . The military service provider Ecolog was entrusted with the operation of the test stations at the Bavarian airports . According to the tender, Ecolog should have carried out the tests from July 30th, but did not begin until mid-August. The competitor Aicher Ambulanz criticized that Ecolog had submitted an offer in the tender that was a third below the second best without already having enough staff.

Bavarian Infection Protection Act

On March 25, 2020, the Bavarian Infection Protection Act (BayIfSG) was passed with the consent of all parliamentary groups in the state parliament and came into force on March 27, 2020. The Tirschenreuth district is considered a particularly affected area in Bavaria. There are the highest numbers of cases per 100,000 inhabitants of the COVID-19 pandemic in Bavaria.

The districts of Miesbach, Rosenheim and Erding are also severely affected by the COVID-19 pandemic. Most of the COVID-19-related deaths across Bavaria were recorded in the independent city of Würzburg and in the districts of Tirschenreuth, Fürth, Rottal-Inn and Rosenheim.
