Altenschlirf District Court

The Altenschlirf Regional Court (from 1854: Herbstein Regional Court ) was a court of first instance of ordinary jurisdiction in the Grand Duchy of Hesse and existed from 1821 to 1879.

history

Starting position

The jurisdiction of the first instance was exercised in the Grand Duchy of Hesse before 1821 through the offices in which jurisdiction and administration were not yet separated. The offices were not all state. In some, the corresponding sovereign rights were wholly or partially in the hands of nobles ( patrimonial courts ).

From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level.

The tasks previously carried out by the offices have now been reorganized into district districts (responsible for administration) and district court districts (responsible for jurisdiction). The district court Altenschlirf arose from it

Further development

In 1828 the municipality of Landenhausen was separated and assigned to the Lauterbach district court .

On May 1, 1849, a number of places from the district of the Schotten regional court were assigned to the Altenschlirf regional court.

As part of the reorganization of the judicial districts in the province of Upper Hesse in 1853, the seat of the regional court was relocated from Altenschlirf to Herbstein on September 1, 1854, and its district was expanded to include several communities. Difficulties arose in implementing the measure.

The End

With the Courts Constitution Act of 1877, the organization and names of the courts were standardized across the empire . On October 1, 1879, the Grand Duchy of Hesse therefore repealed the regional courts. Functionally, they have been replaced by local courts . So that replaced local court Herbstein the district court Herbstein . The higher courts directly superordinate to the local courts were now called “ regional courts ”. The district court Altenschlirf was assigned to the district of the regional court Gießen .

Instanced

Subordinate to the Altenschlirf district court was the court court of Gießen and, subsequently , the higher appeal court of Darmstadt .
