The District Court of Beerfelden was a court of ordinary jurisdiction from 1822 to 1879 with its seat in Beerfelden in today's Odenwaldkreis .

Beerfelden was the seat of the Freienstein office and the local court in the Old Kingdom . Most recently it belonged to the county of Erbach-Fürstenau . The original core of the office was Freienstein Castle .

With the Rhine Federation Act , the Counts of Erbach were mediated in favor of the Grand Duchy of Hesse . However, they retained their traditional rights and obligations with regard to jurisdiction. These rights were exercised in the “ freienstein civil office ”. Such offices were a level between the municipalities and the sovereignty . The functions of administration and jurisdiction were not separated here.

From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level.

In a first step, this was done in the areas of the state in which he exercised the sovereign rights in full ("Dominiallande"). The tasks previously performed by the offices have been reorganized in district districts (responsible for administration) and district court districts (responsible for jurisdiction). In 1822 this was also carried out in the territorial dominated areas ("sovereign lands") of the Grand Duchy. The district court of Beerfelden was set up in part of the area dominated by the Counts of Erbach . When it was founded, it was called: Großherzoglich Hessisches Graeflich Erbach Erbachisches and Erbach Fürstenauisches Landgericht Beerfelden .

Further development

On September 16, 1822, the regional court was renamed: Großherzoglich Hessisches Graeflich Erbach Fürstenauisches Landgericht Freienstein . Beerfelden remained the seat.

With the March Revolution of 1848, the last aristocratic rights in the judiciary were abolished and not restored in the subsequent era of reaction . The jurisdiction monopoly in the Grand Duchy of Hesse was now completely with the state.

At an unknown point in time it was renamed the District Court of Beerfelden .

The End

With the Courts Constitution Act of 1877, the names of the courts were standardized across the empire . On October 1, 1879, the regional courts in the Grand Duchy of Hesse were repealed and replaced by local courts . In fact, that was a renaming. The tasks of the District Court of Beerfelden were now taken over by the District Court of Beerfelden .
