District Court Friedberg (Hesse)

The district court Friedberg (Hessen) was from 1821 to 1879 as a district court a court of first instance of the ordinary jurisdiction in Friedberg (today: Wetteraukreis ) in the Grand Duchy of Hesse .

Starting position

The jurisdiction of the first instance was exercised in the Grand Duchy of Hesse before 1821 through the offices in which jurisdiction and administration were not yet separated. The offices were not all state. In some, the corresponding sovereign rights were wholly or partially in the hands of nobles ( patrimonial courts ).

founding

From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level.

In a first step, this was done in the areas of the state in which it exercised sovereign rights in full ("Dominiallande") or at least predominantly. The tasks previously carried out by the offices have now been reorganized into district districts (responsible for administration) and district court districts (responsible for jurisdiction). The Friedberg Regional Court was formed from the former offices of Butzbach , Friedberg , Burg Friedberg and the state share in the Munzenberg office .

Further development

Incorporation of patrimonial courts

In the following years the state succeeded in adopting the jurisdiction previously exercised by nobles in a series of patrimonial courts before the state court. The corresponding communities were incorporated into the judicial district of the Friedberg Regional Court. In 1822 this affected the municipality of Melbach and the Ockstadt office . As a result of an agreement with the Count's House of Solms-Rödelheim , in 1823 the places belonging to the civil office of Nieder-Wöllstadt were added to the Friedberg district court. On October 1, 1825, the baron family Löw von Steinfurth transferred the patrimonial jurisdiction to which they were entitled in a number of communities to the state. In 1831 the baronial von Rau von Holzhausen family ceded the patrimonial rights to which they were entitled in the town of Beienheim to the state.

Shifts in the district boundary

On January 1, 1837, some communities came from the Lich Regional Court to the Friedberg Regional Court.

On June 1, 1840, the Butzbach Regional Court was re-established. The Friedberg Regional Court gave up a number of communities for its judicial district, but at the same time the Bönstadt and Bruchenbrücken communities , which had previously belonged to the Großkarben Regional Court , were added to the Friedberger Sprengel. Another change in the boundaries of the district of the Friedberg district court took place on January 1, 1844. While Nieder- and Ober-Mörlen were assigned to the district of the Butzbach district court, Ilbenstadt came from the Großkarben district court .

In 1853 the areas of responsibility of the regional courts in the province of Upper Hesse were reorganized with effect from October 15, 1853, which also had an impact on the Friedberg regional court. (see: overview).

A final change in the jurisdiction of the Friedberg Regional Court resulted from the peace treaty of September 3, 1866 with the Kingdom of Prussia and the associated territorial changes: The former Nassau office of Reichelsheim was assigned to the Friedberg Regional Court, Ober-Mörlen, Nieder on January 20, 1867 -Mörlen and Wisselsheim, on the other hand, were handed over to the newly created regional court in Nauheim on the same day .

The End

With the Courts Constitution Act of 1877, the organization and names of the courts were standardized across the empire . On October 1, 1879, the Grand Duchy of Hesse therefore repealed the regional courts. Functionally, they have been replaced by local courts . So now the replaced Amtsgericht Friedberg , the District Court Friedberg . The higher courts directly superordinate to the local courts were now called “ regional courts ”. The Friedberg District Court was assigned to the district of the Giessen Regional Court . The area of ​​responsibility was expanded to include the municipality of Wölfersheim .
