District Court of Giessen (1821–1879)
The district court of Giessen was from 1821 to 1879, a first instance court of general jurisdiction , based in Giessen in the province of Upper Hesse of the Grand Duchy of Hesse .
designation
The courts of first instance in the provinces of Upper Hesse and Starkenburg of the Grand Duchy of Hesse were called the district court from 1821 to 1879 , while those responsible for the cities of Gießen and Darmstadt were called the “city court” - without this having any effect on their factual or instance jurisdiction.
founding
From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level .
In the area of Gießen and its surrounding area, the administrative tasks were assigned to the district of Gießen , the jurisdiction tasks to the district court of Gießen and the city court of Gießen , which had equal jurisdiction in terms of instance and subject matter, but had different court districts . The higher court responsible for the Giessen City Court was the Giessen Court Court .

Further development
When in 1822 the barons of Schenck zu Schweinsberg ceded the patrimonial jurisdiction to which they were entitled in some places to the state, Hermannstein was assigned to the district court of Giessen.
On April 1, 1827, the baronial von Buseck family ceded their patrimonial court in the Buseck valley to the state. The communities located there were assigned to the district court of Gießen (see: overview). To compensate for this, local jurisdiction for a number of municipalities was transferred to the Giessen City Court on the same date. (see: overview).
In the course of a comprehensive restructuring of the judicial districts, Hermannstein was handed over to the Giessen City Court on October 15, 1853.
March 1, 1861 Winnerod that until then the district court Grünberg had heard in the mayoralty Bersrod , which belonged to the district of the District Court Giessen incorporated . This was linked to the fact that Winnerod was now also assigned to the district of the Giessen Regional Court.
The next change in the judicial district caused the consequences of the peace treaty of September 3, 1866 between the Grand Duchy of Hesse and the Kingdom of Prussia : On January 20, 1867, the former Electoral Hesse enclave of Treis an der Lumda was added to the district. To compensate for municipalities annexed by Prussia in the district of the City Court of Gießen, jurisdiction for a number of localities was transferred to the latter (see overview).
The End
With the Courts Constitution Act of 1877, the organization and names of the courts were standardized across the empire . On October 1, 1879, the Grand Duchy of Hesse therefore repealed the regional courts. Functionally, they have been replaced by local courts . So now the District Court of Gießen replaced the Regional Court of Gießen (as well as the previous City Court of Gießen ). The higher courts directly superordinate to the local courts were now called “ regional courts ”. The district court Gießen was assigned to the district of the regional court Gießen .
