Magistrate of the City of Vienna

The Municipality of the City of Vienna since November 1920 at the same time Office of the Vienna Provincial Government , is after the Vienna city constitution (WStV) from the mayor, the official leading councilors and councilors (currently state government and Aldermen Ludwig ), the Chief Executive Director (also the State Office Director ) and the corresponding number of servants. • the City Audit Office , until December 31, 2013 Control Office of the City of Vienna; he has to carry out audits at the decision of the municipal council or its city audit committee as well as at the request of the mayor or an official city council, but is otherwise free of instructions on the scope and type of audit work (Director: Peter Pollak). The powers of the city audit office were expanded considerably with the amendment to the city audit office, which was passed by the state parliament on November 21, 2013, compared to the previous control office rights.

The mayor is the head of the magistrate and is responsible for its management. He is authorized to give instructions to each employee (exceptions exist for the city audit office). He issues rules of procedure and business division of the magistrate. In cases that cannot be postponed, he can decide instead of other city authorities.

Executive city councilors, business groups

Magistrate Director

The management of the "internal service" for the entire magistrate (personnel deployment, organization, service regulations, etc.) is incumbent on the magistrate director (internal: "the MD"), who can assign orders to every magistrate employee (except: the city audit office), and the magistrate's directorate subordinate to him. The municipal department 48 (MA 48 waste management, street cleaning and vehicle fleet) is so well known that the number of the municipal department is now used not only in everyday language, but also as a brand name for Wiener Stadtreinigung.

The municipal departments are each specialized in certain areas of public life (e.g. building police, trade law, youth affairs, health care, traffic regulation, etc.). The current division of responsibilities for the City of Vienna's magistrate, which the mayor issues with the consent of the municipal council, contains the assignment of tasks to the departments.

Some of the main work areas of the magistrate have been redefined as (magistrate) companies or have been spun off from the magistrate in various legal forms. The official and slang abbreviation for Magistratsabteilung is MA , followed by the number of the department in Arabic numerals. Spoken z. E.g .: MA 48 (em-a forty-eight).

On April 10, 2019, the city presented a new brand identity after 20 years, which is to be implemented in the next 2-3 years. The city coat of arms is followed by "City of Vienna" and a word for the department, both in the legally protected font "Wiener Melange". Magistrate District Offices

In addition to the specialized municipal departments exist as "outposts" 16 municipal district offices for the 23 districts of Vienna . Scientific institution, fund

The following agendas have been completely outsourced from the magistrate due to Vienna state laws:

• Wien Museum: The former MA 10 - Museums of the City of Vienna was, like the federal museums, in 2002 as "fully legal", i. The institute (director since October 2015: Matti Bunzl ) remained under the responsibility of the culture division of the magistrate, but is no longer part of the magistrate itself.
• Vienna Social Fund : Many social agendas were gradually outsourced to the Vienna Social Fund (director: Anita Bauer) set up on January 1, 2002 under the Vienna State Foundation and Fund Act. It remained under the responsibility of the social business group of the magistrate, but is not itself part of the magistrate. In this case in particular, the opposition in the municipal council criticized the city parliament's now allegedly greatly reduced control rights.

history

In the 18th century the magistrate was initially understood to be a sovereign authority of the Archduke of Austria . The new regulation of Emperor Josef II, unofficially referred to as magistrate reform, officially consisting of the two court chancellery secretaries of August 16 and 20, 1783 , made the sovereign authority into a bourgeois authority, at the head of which was elected by a committee of the citizens for four years and by the sovereign confirmed mayor with two equally elected deputies. The then incumbent mayor Josef Georg Hörl was able to take part in the preparations for this reform and remained in office for another 21 years. (In 1784 the four Prague cities were merged into one and received a magistrate based on the Viennese model.)

With effect from November 1, 1783, three independent senates of the magistrate were constituted: the Senate in publico-politicis et oeconomicis (the actual city administration headed by the mayor, with 12 magistrates), the Senate in judicialibus civilibus ( civil jurisdiction , with 18 magistrates) and the Senate in judicialibus criminalibus ( criminal jurisdiction , with 12 magistrates). The two judicially active senates were headed by the two deputies of the mayor. The city administration was subordinate to the Lower Austrian provincial government , the judiciary senates were subordinate to the appellate court and the criminal court. The 42 civil servants working as magistrates were subordinated to 83 further civil servants from registrar to bailiff.

Until 1804 and from 1806 the authority was called the Magistrate of the Imperial and Royal Capital and Residence City of Vienna , from 1919 on it was called the Magistrate of the City of Vienna .

From 1812 the departments assigned to the magistrates' councils were called magistrate departments , and by 1847 there were already 17 of them. In 1848 the jurisdiction of the magistrate was taken over by state courts. The incorporation of the suburbs in 1890/92 increased the central administration to 19 departments, which were replaced by 22 municipal departments on January 1, 1902 under Mayor Karl Lueger . In addition, there were the building department departments of the city ​​building department , which were only incorporated in 1920, which then resulted in 30 departments. Since June 1, 1920, the magistrate, then under Mayor Jakob Reumann , has been subdivided into business groups led by executive councilors, to which magistrate departments and other magistrate institutions are assigned. (The reallocation initially resulted in seven business groups with a total of 54 municipal departments.)

Since the Federal Constitution came into force on November 10, 1920, the magistrate has also been the office of the Vienna provincial government ; the details were regulated in the Vienna City Constitution, which came into force on November 18, 1920 and continued the departmental system of the municipal code of spring 1920. In 1939 the Nazi regime introduced a division into nine main departments; In 1946, Mayor Theodor Körner returned to the 1933 organizational scheme.

The division of the magistrate into business groups, each comprising several magistrate departments and led by executive city councilors (there were up to twelve after 1945), changed according to political expediency, including when the ruling Social Democrats formed coalitions with the ÖVP after 1945 or, as is currently the case for the first time, with the Viennese Greens received. Municipalities (see above) also divide into business groups. In contrast to other provincial governors in Austria, the mayor of Vienna traditionally does not lead a department himself, but is the superior of the magistrate director and his staff. On January 1, 2014, the municipal control office was expanded to become the city audit office.

Colloquial language

In Viennese, instead of "die MA 48", "die 48er" (forty-eight) is spoken for short. This usage is also written down in the logo of this department: "48er".

Fictitious municipal departments

• According to the Vienna Archives Act, files held by the Magistrate must be handed over to the Vienna City and State Archives (MA 8) for archiving after 30 years at the latest , if they are to be preserved in the long term. Holdings that cannot be assigned to a specific department because they are e.g. B. come from times in which the magistrate was structured differently than today, are kept in the archive under a fictitious number that is over 100, for example MA 116: Holdings of the conscription office, where historical conscription sheets, home rolls, the alien index and the like are found.
