The football match between Fortuna Düsseldorf and Hertha BSC on May 15, 2012 was the second leg of the relegation between the first division team placed 16th and the third placed in the 2nd Bundesliga at the end of the 2011/12 season.

The game had to be interrupted several times due to the burning of Bengali fire from both fan camps, a burst of Fortuna supporters and attacks by Hertha players against the referee. This led to considerable media coverage and a heated discussion about the necessary criminal and sports law consequences, in particular about the appropriateness of punishing Fortuna Düsseldorf with a ghost game .

The game ended in a 2-2 draw, so that Düsseldorf was promoted to the 1st Bundesliga and Hertha BSC had to be relegated to the 2nd Bundesliga.

prehistory

On the 34th matchday of the 2011/12 Bundesliga , Hertha BSC managed to occupy 16th place in the table with 31 points with a 3-1 win against TSG 1899 Hoffenheim , as 1. FC Köln at home with 1: 4 against FC Bayern Munich and had to go straight to the second division with 30 points.

Fortuna Düsseldorf secured one point the next day with a 2-2 draw against MSV Duisburg and with 62 points, thanks to the better goal difference, was able to save third place in the 2nd Bundesliga before FC St. Pauli across the finish line, the against won SC Paderborn 07 5-0.

The first leg of the relegation took place on Thursday, May 10th, in front of around 68,000 spectators in the Berlin Olympic Stadium. Hertha BSC first took a 1-0 lead through Roman Hubník in the 19th minute . Then the score could be turned by the Fortuna by Thomas Bröker (64th) and an own goal by Adrián Ramos (71st) to 1: 2. Düsseldorf fans lit Bengali fire in the first leg.

The game

Since the Düsseldorf team had won the first leg, a draw was definitely enough for promotion. Even if they lost 1-0 they would have been promoted due to the away goals rule . Had it been 2-1 for Hertha after 90 minutes, there would have been an extension. If it had won anything other than 1-0 or 2-1, Hertha would not have been relegated.

It was 1-0 after just 25 seconds after Maximilian Beister finished a solo run with a placed shot from 25 meters. For their part, Hertha equalized after several good opportunities in the 22nd minute through Änis Ben-Hatira .

In the 54th minute, Ben-Hatira saw the yellow-red card after an attack with a stretched leg against Adam Bodzek . Five minutes later, after a cross from Thomas Bröker , Ranisav Jovanović gave Düsseldorf the lead again. Subsequently, referee Wolfgang Stark had to interrupt the game for the first time because of the firing of firecrackers and Bengali fire thrown on the field by the Berlin guest fans. Shortly after the Hertha fans, Düsseldorf fans also set fire to Bengalos, some of which also landed on the field. For the rest of the game, Fortuna was primarily concerned with defending the narrow lead. Hertha kept running and pushed for the equalizer, which finally fell through Raffael in the 85th minute . After that, the game had to be interrupted a second time because spectators had again thrown Bengali fires on the field. The announcement was made by the announcer that if another Bengali fire were to break out on the lawn, the game would be stopped immediately. In the period that followed, several police officers (some with police dogs ) positioned themselves in front of the fan block.

Due to the repeated interruptions, an injury time of seven minutes was indicated by the fourth official Markus Wingenbach after the end of the regular playing time. Even during stoppage time, despite a large number of files, more and more Fortuna supporters made their way over fences and gangs into the interior of the stadium and right up to the edge of the field.

About one and a half minutes before the scheduled final whistle, a few hundred Fortuna fans stormed the square. Some of them set fire to more Bengalos, while others began to cut pieces out of the lawn. At least one corner flag was stolen. It is possible that some of the fans thought a whistle from Wolfgang Stark for the end of the game. The referee then interrupted the game again and immediately disappeared into the dressing room, the players of both teams followed him a little later into the "catacombs". The celebrating Düsseldorf fans were asked by security forces, players and the stadium announcer to leave the interior, otherwise the game could not be played to the end. After a few minutes the field was largely cleared and both teams were back on the field. Nevertheless, they were sent back to the cabins. Referee Stark came back to the field after about ten minutes of interruption of the game, the Fortuna team followed him a little later. Hertha BSC finally agreed to play the game to the end after about ten more minutes.

Consequences under sports law

Unsuccessful protest against game evaluation

Hertha BSC appealed against the rating of the game: “For us the game was irregular. It was no longer about athletic competition. The sole purpose of the reopening of this game was to prevent further escalation. ”, Hertha's lawyer Christoph Schickhardt justified the protest:“ The DFB statutes say that a game will not be scored under these circumstances, but will be repeated. ”Hertha manager Michael Preetz explained: “We are calling the DFB sports court to investigate this issue. The players were scared. It was no longer about the sporting events. The question of one's own safety was in the foreground, not the effort to score another goal in the remaining two minutes. "

Hertha BSC's objection was dealt with in a hearing on Friday, May 18, chaired by the chairman of the DFB Sports Court, Hans E. Lorenz . Referee Wolfgang Stark stated that, contrary to the claims of those responsible at Hertha BSC, the game was not only continued to prevent an escalation. Stark stated that the game ended properly. He also questioned the allegation that Berlin players had endured fears because they insulted and physically assaulted him after the game. Fortuna attorney Horst Kletke essentially referred to the factual decision of the referee and his assessment that it could continue to play without any problems, which was also in the interests of the Hertha BSC players. In his plea, the chairman of the DFB control committee, Anton Nachreiner, requested the rejection of the application and sharply criticized those responsible at Hertha BSC for their protest because the Berlin guest fans themselves almost stopped the game after Fortuna Düsseldorf's 2-1 lead.

The verdict of the DFB sports court on the question of the game rating was postponed to Monday, May 21 after the evidence and the pleading had been completed. Judge Lorenz had not admitted television images as evidence. Hertha BSC's objection was rejected. The chairman stated that there was no reason for objection and that Hertha BSC could not prove a one-sided weakening. Lorenz also said that the storm was "not carried out in a hostile attitude and did not serve to exercise violence, but to live out the feeling of ascent".

Hertha BSC then appealed the judgment and went to the next instance, before the DFB Federal Court, which dealt with the appeal on May 25th. After ten hours of hearing, the court upheld the judgment of the first instance. After Hertha BSC had received the Federal Court's written justification for the judgment, the Berliners accepted the judgment.

DFB proceedings and criminal investigations against players

On Wednesday evening, the DFB control committee announced that it had started investigations against both clubs and against Hertha players Lewan Kobiaschwili , Thomas Kraft , Christian Lell , Andre Mijatović and Fortuna captain Andreas Lambertz . Referee Wolfgang Stark filed a criminal complaint against Kobiashvili, accusing him of punching him in the neck with his fist. Furthermore, the referee was insulted by several of the above-mentioned players, presumably because he ended the match around 30 seconds too early. Lell had previously clashed with Düsseldorf's Assani Lukimya and is said to have insulted and spat at the defender. After the game, as part of the celebration with the fans, Lambertz took a Bengali torch in hand and waved it around as a gesture of joy, which violates the general ban on the use of pyrotechnics. A few days after the events, it became known that two Fortuna Düsseldorf players had set fire to more Bengalos in a discotheque the night after the game and that they had to be taken from them by security staff. The North Rhine-Westphalian BDK chairman Wilfried Albishausen called for the players to be punished.

On June 4, 2012, the DFB imposed a suspension against Kobiashvili retrospectively from May 16 to December 31, 2012, which is the longest suspension in the history of the Bundesliga for assault. The player denied having assaulted the referee. In December 2012, Kobiashvili was sentenced to a penalty of 60,000 euros, which he accepted, preventing a public trial.

The Berliners Thomas Kraft and Andre Mijatović were suspended for four and three games respectively. Düsseldorf's Andreas Lambertz was sentenced to a two-game ban. Against Christian Lell, who was not represented by Hertha lawyer Schickhardt, the DFB sports court imposed a five-game ban on June 5, 2012.

DFB proceedings against the clubs

On June 12, 2012, the DFB control committee applied for a ghost game to be fined 100,000 euros against Fortuna and a partial exclusion of the spectators, as well as a 50,000 euros fine against Hertha BSC. On June 28, 2012, the DFB sports court followed this request. Both Hertha and Fortuna appealed the judgment. On August 10, 2012, the DFB sports court ruled on Fortuna's objection and changed the penalty. Instead of a ghost game, it imposed a partial exclusion of spectators for the first two home games of the 2012/13 season in Düsseldorf. In the games on September 1, 2012 against Borussia Mönchengladbach and on September 22, 2012 against SC Freiburg , only 25,000 Fortuna supporters and 5,000 supporters of the visiting teams were allowed to watch in the stadium. The standing area had to remain closed during these encounters. In return for the waiver of the punishment with the first ghost game of the 1st Bundesliga, the fine was increased to 150,000 euros for Fortuna Düsseldorf.

Club proceedings against fans

In November 2012 Fortuna Düsseldorf sued the fan who cut the penalty spot from the lawn for 50,000 euros in damages . This had caused a stir in the tabloid press, as he had tried to auction the stolen penalty spot on Facebook . In December 2012, the parties reached an out-of-court settlement that included a stadium ban and a monetary payment for the fan, the amount of which was agreed not to disclose.

Reactions

Although, according to a police report by the local officials, "there were no serious physical confrontations or violence either before, during or after the game," the game was described as one of the biggest scandalous games in Bundesliga history and aroused wide-ranging reactions from politics and society . The discussion flared up again about the role of ultras , clubs, security services and the police in preventing violence and the use of pyrotechnics in stadiums.

In a joint statement by the DFB and DFL, the officials stated that they had taken note of the incidents with “dismay and concern.” “A point has been reached at which new approaches must be taken to combat violence in the vicinity of soccer games. The latest riots at the end of the season make it clear once again in a sad way that the previous concepts and measures alone are no longer sufficient. ”DFB General Secretary Helmut Sandrock said in an ARD hotspot that he thinks it is possible that standing room will be abolished and fences again be dragged around the playing field.

Federal Interior Minister Hans-Peter Friedrich ( CSU ) demanded: “The clubs have to make it clear to their fans that violence will not be tolerated. You have to make them understand that pyrotechnics have no place in stadiums. And finally they have to make it clear to them that the fan privileges for Ultras and others will no longer exist if peace and order does not finally return there. ”In a comment for the soccer magazine Kicker , Rainer Franzke called for“ strictest sanctions ”and“ concerted action against the hooliganism in football. "He complained that" long specify the perpetrators of violence in the corners and behind the goals set the tone "and" not only tolerated by the neighbors, but also cheered in many cases and supports "would.

In a comment on tagesschau.de , the journalist Patrick Gensing, on the other hand, was critical of what he thought was “too violent reactions” from media representatives. Instead, he demanded “more serenity and a sense of reality” from everyone involved. Marco Noli, lawyer a . a. for fan rights, said in an interview with the football magazine 11 Freunde that he “could not see any increase in fan violence” and instead the stadiums were “much safer than in the past”. He accused the Hertha officials of having "maliciously poured poison into the debate" through terms such as "fear of death" and "bloodbath" in connection with the game. Further discussion of the topic in the media (eg. As in the talk shows hard but fair or People and Politics ) he described as "outrageous" and "populism" that the dialogue between fans and officials harm. Sandra Maischberger had previously described Ultras as the “ Taliban of football fans” in her talk show , while her guest Werner Schneyder described choreographies as “ fascist rituals of gathering”.

At the football safety summit in July 2012, which was convened in response to this football game, a ban on Bengalos was decided, the burning of which is to be punished with a stadium ban . The standing room in the stadiums should not be abolished.
