The Advisory State Assembly for Baden was a body that existed after the Second World War to draw up a state constitution. As the predecessor of the Baden state parliament , it corresponded to the consultative state assemblies in the two other countries of the French occupation zone Rhineland-Palatinate and Württemberg-Hohenzollern as well as the appointed state parliaments of the states in the American and British occupation zones.

After the Second World War , the states of Baden and Württemberg were divided between the American occupation zone in the north and the French zone in the south. The states of Württemberg-Hohenzollern and Baden were established within the French zone, and the state of Württemberg-Baden in the American zone .

On December 1, 1945, the French military government for Baden moved from Karlsruhe to Freiburg . At the same time, the provisional administration of Baden , which was headed by ministerial directors from Karlsruhe, also relocated its offices to Freiburg. In the weeks that followed, various parties were founded in Baden. These included the Baden Christian Social People's Party (BCSV), a predecessor organization of the CDU, and the Democratic Party (DemP), a forerunner of the FDP . In May 1946, the military government ordered electoral lists to be drawn up for community assemblies and soon afterwards also for district assemblies. The elections for the community assemblies took place on September 15, 1946 and the elections for the district assemblies on October 13, 1946. On October 8, 1946, the French military administration ordered the establishment of the Advisory State Assembly for Baden , whose main task was to draw up a draft constitution. The election of the members of the Advisory State Assembly took place on November 17, 1946 in Freiburg. The election took place according to the proportional representation system via the lists of approved parties by two electoral bodies. The first electoral body consisted of the delegates from the district assemblies, the second body consisted of the members of the municipal assemblies of cities with a population of over 7,000. Only members of the community assemblies and members of the district assemblies were eligible.

The Consultative State Assembly met on November 22, 1946 for its constituent meeting under the senior president Otto Vielhauer in the historical department store in Freiburg. In its 16th and last session on April 21, 1947, it adopted the draft constitution that it had drawn up by 40 votes to twelve. After the French military government had approved the text of the constitution, the constitution of the state of Baden was submitted to the population for a vote at the same time as the election for the first state parliament on May 18, 1947 and was approved with 67.9% of the votes.

At the constituent meeting of the National Advisory Assembly on November 22, 1946, Leo Wohleb ( BCSV ) was elected President. First Deputy was Franz Geiler ( SPD ), Second Deputy George Mall (DEMP) and Third Deputy Erwin Eckert ( KPD ). After Wohleb was elected President of the State Secretariat on December 3, 1946, the Assembly elected Karl Person as its President. Georg Mall was replaced in March 1947 by Otto Vielhauer as deputy.
