Brigitte Bierlein (born June 25, 1949 in Vienna ) is an Austrian lawyer , former constitutional judge and non-party politician . She was Federal Chancellor of the Republic of Austria from June 3, 2019 to January 7, 2020 .

From 1990 to 2003 Bierlein was Advocate General of the General Procuratorate at the Supreme Court , from 2003 to 2018 Vice-President of the Constitutional Court of the Republic of Austria and its President from February 23, 2018 to June 2, 2019.

Life

After completing compulsory school, Brigitte Bierlein attended the Vienna III Federal High School in Kundmanngasse, where she graduated from high school in 1967 . She then started studying law at the University of Vienna and completed it in a minimum of time. In 1971 she became a doctor of law doctorate . After the judicial preparatory service and the judge's examination in 1975, Bierlein worked as a judge first at the District Court of Innere Stadt in Vienna and then at the then criminal district court of Vienna. In 1977 she became public prosecutor for general and political criminal matters in Vienna. In 1986 Bierlein moved to the Vienna Public Prosecutor's Office.

From 1987 she worked in the criminal law section of the Federal Ministry of Justice and then returned to the Vienna Public Prosecutor's Office as a senior public prosecutor. In 1990 she became the first woman to hold the position of Attorney General in the General Procuratorate at the Supreme Court, where she was also the deputy head of the General Procuratorate. Bierlein was also involved in legal organizations outside of her professional activities and in 1995 became a member of the board of the Association of Austrian Public Prosecutors. From 2001 to 2003 she was its president. From 2001 to 2003 she was also a board member of the International Association of Prosecutors (IAP).

In April 2019, Brigitte Bierlein was appointed head of the special commission to clarify the allegations against the Vienna State Opera Ballet School , in which she was also responsible for law and victim protection. In June 2019 she was succeeded by Susanne Reindl-Krauskopf .

Constitutional Court

In 2002 Bierlein was proposed by the Austrian federal government as a member of the Constitutional Court and at the same time - as the first woman - as its vice-president. On November 28, 2002, she was appointed Vice President by Federal President Thomas Klestil with effect from January 1, 2003.

After Gerhart Holzinger's retirement as VfGH President on December 31, 2017, Bierlein initially headed the Constitutional Court on an interim basis as Vice President in accordance with Section 3 Paragraph 4 in conjunction with Paragraph 2 VfGG. On February 23, 2018, she was appointed President of the Constitutional Court by Federal President Alexander Van der Bellen at the suggestion of the Federal Government Kurz I.

According to Art. 147 Para. 4 u. 5 B-VG , members of the Constitutional Court may not also belong to the federal government ( principle of incompatibility ). In the run-up to being sworn in as Federal Chancellor, Brigitte Bierlein resigned from the position of President of the Constitutional Court on June 2, 2019.

On May 30, 2019 Bierlein was the first woman in the history of the Republic of Austria for the office of Chancellor designated . Federal President Alexander Van der Bellen tasked them with the formation of a transitional government until the formation of a government after the new election of the National Council scheduled for autumn 2019 , after the National Council had expressed its distrust of the Federal Government Kurz I as a result of the Ibiza affair . On June 3, 2019, she was the successor to the temporarily employed for a few days interim government Löger immediately thereafter by the Federal President as Chancellor and, as required by the Federal Constitution following her suggestion the other members of the Federal Government Bierlein sworn in . Six female and six male federal ministers were represented in their government. The transitional government should continue the official business of the federal ministries until a new government is sworn in after the early elections to the National Council in autumn 2019 . On January 7, 2020, after more than half a year, the term of office of the interim government under Brigitte Bierlein ended with the inauguration of the Federal Government Kurz II under the renewed Federal Chancellor Sebastian Kurz.

Brigitte Bierlein is non-party . Their political orientation was described in the press as “right of center”, in the standard as bourgeois or even right-wing conservative . The climate scientist Gottfried Kirchengast criticized Austria's climate policy, which fell during Bierlein’s term of office.
