The ice hockey league was divided into a north group with seven teams and a south group with nine teams in the 2008/09 season. The groups each played a triple round internally (three first and second leg against each other team in the group) and an additional single round against the teams in the other group. The main round therefore comprised 54 games in the north and 62 games in the south. In each group, the four best clubs in the main round qualified for the play-offs ; the season was over for the remaining clubs. The play-offs were held within the group using the best-of-five procedure (the Blue Lions Leipzig waived). The two winners of the play-offs, the Hanover Indians in the north and the ESV Kaufbeuren in the south, were promoted to the 2nd Bundesliga .
New in the league were EV Landsberg as relegated from the 2nd Bundesliga and Herner EV as promoted from the Regionalliga NRW and winner of the Oberliga promotion round. The clubs eligible for promotion from the Bayernliga and the Regionalliga Nord / Ost, EHC Waldkraiburg , EC Pfaffenhofen and EHV Schönheide , waived promotion. The 1. EV Weiden withdrew to the Landesliga Bayern Nord for financial reasons .
In the Oberliga, up to four field players with a foreign license and a total of up to 15 players who were either field players born before January 1, 1987 with a German license or players with a foreign license were allowed to play per game (so-called U21 rule ). Even players who had played three years in youth in Germany according to Article 64 of the German Ice Hockey Association's rules of play (SpO) were not subject to the 15 player restriction. Until the end of the transfer on January 31, 2009, each of the clubs was able to sign foreign outfield players without restrictions, but foreign goalkeepers were not allowed to be used.
The two bottom of the table in the main round, the Eisbären Juniors in the north and TEV Miesbach, were relegated to the Regional League and Bavarian Ice Hockey League . Both teams could have moved up to the league, but TEV Miesbach waived and the Eisbären Juniors teams were disbanded after the season.
The Blue Lions Leipzig went bankrupt during the seasons . After negotiations with the ESBG, the team continued the game, but refrained from participating in the play-offs in order to get the opportunity to apply for the Oberliga Nord in the following season 2009/10 despite bankruptcy. But after the renunciation of almost all regional league teams eligible for promotion and the withdrawal of the Piranhas Rostock and the Saale Bulls Halle no Oberliga Nord came about, the Blue Lions were forcibly relegated.

In addition to the previous year's top division clubs Blue Lions Leipzig , Hanover Indians , Rostock Piranhas , Saale Bulls Halle , Rote Teufel Bad Nauheim and Eisbären Juniors Berlin, the Herner EV 2007 takes part in the preliminary round group as a newcomer. The team of 1. EV Weiden , which reached the play-offs in the preseason, withdrew from the league for financial reasons.
In the southern group, in addition to the relegated from the 2nd Bundesliga 2007/08, the qualified top division teams from the previous season competed . These were EV Füssen , ESV Kaufbeuren , EHC Klostersee , TEV Miesbach , EC Peiting , Starbulls Rosenheim and Deggendorf Fire . The athletic relegated EHF Passau Black Hawks remained in the league, as in addition to the league champion Tölzer Löwen , the Wölfe Freiburg rose as a replacement in the 2nd Bundesliga.
