The local elections in Lower Saxony in 2016 took place on September 11, 2016. The district councils , the Hanover regional assembly as well as the city, municipality and joint municipal councils were determined. At the same time, the city district councils and the local councils and also some district councilors and mayors were elected. You now have a term of office of five instead of eight years.

It was the 19th local or partial local elections since 1948.

As in the local elections in other federal states, the personality of the candidates also plays a stronger role in Lower Saxony than in state and federal elections. As a result - not least because of the right to vote - non-party applicants also have a chance. The CDU remained the strongest party nationwide in the 2011 elections, with the SPD just behind. Nevertheless, both parties lost percentage points, just like the FDP. The nationwide winner was the Bündnis 90 / Die Grünen party, which made strong gains. The Left was able to more than double its percentage, the others also gained, but most of their votes fell on local civic associations. The pirates received 0.5 percent of the vote in the municipal elections and 1.0 percent in the district elections. Right-wing parties played no role nationwide. At 55.5 percent, the turnout in this local election was slightly higher than in the last local election.

Eligible voters

In the 2016 municipal elections in Lower Saxony, all Germans and citizens of another EU state who had reached the age of 16 on election day were eligible to vote if they had been permanently resident in the electoral area for at least three months and were entered in the electoral roll. In addition, they were not allowed to be excluded from the right to vote on the basis of civil or criminal court decisions.

Candidates

Germans or citizens of another EU state who are at least 18 years old on election day and have lived in the respective electoral area for at least six months and are not excluded from eligibility (Section 49 of the Lower Saxony Municipal Constitutional Act - NKomVG) can apply for a municipal mandate in a representation ). Candidates for a nomination from one party may not be members of another party. Applicants on the nomination of a group of voters do not have to be members of the group of voters.

In the local elections in Lower Saxony on September 11, 25 parties ran. In addition, groups of voters and individuals could also stand for election. The state election committee announced the participating parties two and a half months before the polls. According to § 4 (electoral principles, electoral system) of the Lower Saxony Local Election Act (NKWG), the bodies to be elected are elected in general, direct, free, equal and secret and proportional representation connected with the election of persons. Each voter has three votes, which can be cumulative or variegated . You can choose not only the individual candidates, but also the lists for which they stand. This gives voters the opportunity to successfully elect individual candidates with poor list placement by corresponding personal votes. The distribution of seats is based on the Hare-Niemeyer method , there is no explicit threshold clause .

There is only one vote in person elections (district administrators, mayors and lord mayors). If no candidate receives an absolute majority of the votes, there will be a runoff two weeks later between the two best placed applicants.

irregularities

After Die Linke had achieved an unusually high result of 21.55% in the city council election in Quakenbrück , the evidence of irregularities in the postal vote increased. The public prosecutor's office started investigations into suspected election fraud and searched the homes of eight suspects, mostly members of the left or family members. In November 2016, the city council unanimously voted to invalidate the postal vote. When it was repeated on March 5, 2017, Die Linke only got 16.56% and had to give up two of its seven seats.

In Bad Bevensen , the election committee had decided to exclude the Greens from the city council election because they had submitted a list of candidates with an incorrect order of places 2, 4 and 6. The Greens had sued against this non-admission to the election and got the right from the administrative court in Lüneburg in November 2017. A new election took place on March 11, 2018, in which the Greens won 46.24%.
