Public enemy no. 1 (Original title: Enemy of the State ) is an American action thriller from director Tony Scott from the year 1998 with Will Smith , Gene Hackman and Jon Voight in the lead roles. In the USA the premiere took place on December 16, 1998 in Germany.

In the USA, a new, stricter surveillance law is to be passed by Congress . Thomas Brian Reynolds , head of department of the US secret service NSA , in Occuquan Park , Baltimore, urges the chairman of the Republican Party in Congress, Hammersley , to approve this change in the law. When Hammersley refuses on moral grounds, he is killed by one of Reynolds' agents and this politically motivated murder is staged as an accident. The murder as well as the removal of traces are recorded by chance by an ornithologist's video camera . On the run from NSA agents who were set on the ornithologist to get the videotape, he meets the successful lawyer Robert Clayton Dean from Washington, DC , who is looking for a Christmas present for his wife Carla in a lingerie shop . He received his business card from him and, unnoticed, slipped him a game console with a copy of the evidence video on a memory card. Shortly afterwards, he dies in a traffic accident on his further escape.
With the help of the business card, Reynolds can quickly track down the unsuspecting lawyer. Since a first attempt to get the disk during a house visit to Dean fails, he and his team set out to ruin Dean's reputation and thus his credibility in order to discredit his integrity as a witness in the event of a police / judicial testimony. Reynolds' agents then search Dean's house for the video copy at night without finding it, installing listening devices in the house and tracking devices in his everyday objects, such as shoe heels, wristwatches, fountain pens and making it look like a break-in by a gang of young people through gross devastation. He is also told that he was working with mafia boss Pintero , whom he had to meet a few days earlier as part of his own case, as well as an affair with his college friend Rachel Banks , who works for him as an informant , whereupon Dean loses his job and his wife puts him in front of the door, his bank accounts are frozen and his credit cards blocked. Initially, Dean considers these developments to be a plot by Pintero, as he had turned it against himself at the joint meeting.
Dean then seeks advice from Rachel Banks. At his insistence, she explains to him how he can personally contact Edward "Brill" Lyle , who works underground and who used to work for the NSA as a wiretapping specialist. The NSA observed the meeting and then set a fake "Brill" on Dean to intercept him, who initially went into the network, but can then escape again through surprising intervention by the real Brill. Brill is able to remove some of the bugs in Dean's clothing and equipment and explains to him that it is not the Mafia but the NSA who are behind all the developments. However, when Brill's cover threatens to be blown, he refuses to continue helping Dean. Dean, now on his own again, manages to get rid of the last bug and temporarily shake off the NSA. He secretly reconciles with his wife and tracks down the floppy disk with the video evidence that his little son had unsuspectingly taken. He then tries to contact Rachel again, but finds her murdered in her apartment, along with objects that would incriminate him in the act.
Dean goes to Brill again and can now convince him to help him. After viewing the disk in Brill's hideout, Dean and Brill know the reason why Dean is being followed. The NSA is back on the track of the two of them through a call from Dean in his wife's office, which is why Brill is forced to blow up his hiding place and flee with Dean. This also destroys the floppy disk. Since Dean and Brill are now without evidence, they are now working with the methods of the NSA: For their part, they install bugs and mini-cameras in the hotel suite of a congressman who appears in public as a strong advocate of the new security law . The surveillance reveals that he has a relationship with his secretary. The bugs are discovered by an intended technical malfunction and trigger an internal NSA investigation that puts Reynolds in distress.
Brill, with Dean's help, tries to get Reynolds' confession and record it during a meeting with him. When the plan fails, both are captured by the NSA. But Dean can lure Reynolds and his men into the house of Pinteros, which is already under observation by the FBI, under the pretext that the video is located there . In an exchange of fire provoked by Dean between the criminals present, both Pintero and Reynolds and most of their people die. A confession of Reynolds, recorded by NSA agent Fiedler , which is discovered by the FBI after the exchange of fire, ultimately provides evidence of his guilt. Dean returns to his original life, while Brill goes into hiding again. The planned new surveillance law will not be passed, but the public will not be informed of the machinations that led to the introduction of the bill.

The lexicon of international films wrote that “the familiar Orwell theme ” served “as the trigger for a technocratic action crime novel which initially benefited from the virtuoso handling of the technology, but whose ostensible speculation with“ super cool ”tempo and excess soon ran out of steam”.
The online film database (OFDb) wrote: " Public enemy No. 1 is a wonderfully styled and exciting thriller that takes the subject of media surveillance seriously and examines its dangers, but remains primarily committed to entertainment [...]."
Trivia
- To make the film more authentic, on the set was a consultant for measures against technical monitoring (Engl. Technical surveillance counter-measures , short TSCM ) present, further comprising a small supporting role in a store as a salesman for espionage had been saving equipment.
- NSA staff met with director Tony Scott, producer Jerry Bruckheimer, and executive producer Andy Davis to create a positive portrayal of the NSA. The NSA staff, however, were not impressed by the portrayal of the NSA in the film.
- Mel Gibson and Tom Cruise were initially slated for the role of Robert Clayton Dean . Tom Cruise had even signed a contract for the role, but could n't accept Wide Shut because of the ongoing shooting of Eyes Wide . Eventually the role went to Will Smith . About George Clooney was briefly also for the role of Thomas Brian Reynolds ( Jon Voight been thinking).
- Public enemy No. 1 refers to the film Der Dialog (original title: The Conversation ) from 1974 by Francis Ford Coppola , also with Gene Hackman . In this, too, Hackman played a surveillance specialist who was clearly similar to Brill. There is even an old photo of Hackman as Harry Caul in Brill's NSA files.
- At the end of the film, Robert Dean sees himself on the television screen. The image is inverted like in a mirror, which would not be the case with a camera shot.
