In 2005 he was elected as a member of the federal party leadership. From April 10, 2008, Huber represented the FPÖ in the Lower Austrian state parliament.

On March 1, 2018 it was announced that Martin Huber will succeed Gottfried Waldhäusl , who is moving into the Lower Austrian provincial government as regional councilor , in his previous function as club chairman in the Lower Austrian state parliament . On March 22, 2018, with the constitution of the Landtag of the XIX. Legislative period , Huber took office as FPÖ club chairman.

On September 21, 2019, Huber was suspended from the FPÖ by party leader Norbert Hofer (see criminal proceedings for violating the Prohibition Act ). Huber remained as a non-attached member of the state parliament. A party expulsion, which was initially announced for the first meeting of the federal party leadership after the 2019 National Council election , has not yet taken place (as of January 6, 2020). Criminal proceedings for violating the Prohibition Act

On April 20, 2014, the 125th birthday of Adolf Hitler , Huber wrote on his Facebook profile at 12:14 a.m.: “Congratulations to those who have their birthday today”. Norbert Hofer suspended him from the FPÖ on September 21, 2019. According to a press release by the FPÖ, research showed that Huber did not express birthday wishes on any other day. In November 2019 it became known that the public prosecutor's office had investigated Huber on the basis of the posting and had submitted an extradition request to the Lower Austrian state parliament. However, he did not have to agree because Huber himself consented to the persecution.

Although he denied the allegation to the last, Huber was found guilty on August 19, 2020 by a jury with five to three votes for a violation of Section 3g of the Prohibition Act 1947 and sentenced to twelve months of conditional imprisonment. The judgment is not final, as its defender filed an appeal and an annulment complaint and the public prosecutor made no explanation.
