The municipal council elections in Burgenland 2007 took place on October 7, 2007 and were held simultaneously with direct mayor elections in 170 of the 171 Burgenland municipalities. Only the municipality of Steinberg-Dörfl , in which early elections took place in 2006, did not take part. The shortlist (runoff in the direct mayor elections) was held on October 21. The elections led to slight losses for the SPÖ and a stagnation of the ÖVP , which, however, was able to gain mandates from local councils. While the FPÖ lost almost half of its mandates by splitting off the Free Citizens 'List, the Free Citizens' List , which appeared for the first time, was able to move into the municipal council in ten municipalities. The Greens remained despite slight gains after the other parties.

The implementation of municipal council and mayoral elections were decided by the Burgenland provincial government and announced in the Provincial Law Gazette on July 24, 2007 (day of the announcement). October 7, 2007 was determined as the election day and October 21, 2007 as the day of the shortlisted mayor. The legal basis for carrying out the elections are the 1992 municipal election regulations (GemWO 1992, LGBl. No. 54/1992) and the Burgenland Voting Register Act (LGBl. No. 5/1996).

Right to vote

In the 2007 municipal council and mayoral elections in Burgenland, all men and women who had Austrian citizenship on the cut-off date (July 24, 2007) were actively eligible to vote. Citizens of a member state of the European Union who had registered in the municipal electoral register or had submitted an application for inclusion in the electoral register by the deadline were also entitled to vote. In addition, the voters had to be 16 years of age on election day (October 7, 2007) and have a place of residence in a Burgenland municipality on the reference date. Furthermore, one could not be excluded from the right to vote on the reference date.

Those entitled to vote were entered by the municipalities in the respective municipal electoral register. The electoral roll was then open to the public in the municipalities from August 14 to 23, 2007. During this period there was the possibility of inspection and objection. Only people who appeared in the completed electoral roll were entitled to vote on election day.

Passive suffrage

The passive right to vote could be exercised in the municipal council elections by all people who were actively eligible to vote and who had reached the age of 18 on election day (October 7, 2007). If Austrian citizens and citizens of the European Union were eligible for election, only Austrian citizens who were actively eligible to vote and who had reached the age of 18 on election day were eligible to vote as mayors.

In order to participate in the municipal council elections, it was necessary to submit a nomination, which, depending on the number of eligible voters in a municipality, could include a maximum of 18 to 58 applicants. For the candidacy to be valid, the nomination required supporting signatures from people who were actively eligible to vote, the minimum number of which varied between 5 and 30 signatures per municipality, depending on the number of eligible voters. The election proposal for the direct mayor elections could only be submitted by campaigning parties that had also submitted an election proposal for the municipal council elections. The campaigning parties had to submit the election proposals to the municipal electoral authority by September 7, 2007 and were able to amend or withdraw them by September 17 at the latest. If the candidacy was withdrawn, the lists were able to submit a supplementary proposal by September 21 at the latest. The municipal electoral authority ultimately decided by September 23 on whether to approve or reject the nomination.

Exercising the right to vote

Every eligible voter had to exercise his or her right to vote in the respective community of residence. In these elections, there was no possibility of voting using a voting card. If there was a residence in two or more municipalities, the right to vote could be exercised in these municipalities. If they were bedridden, eligible voters could apply to exercise their right to vote before the special electoral authority, which would visit the voters at home on election day. The actual election took place by means of two official ballot papers, whereby one ballot paper was necessary for the election of the municipal council and the election of the mayor. In the municipal council elections, in addition to the election of the party, up to three preferential votes could be distributed, whereby a maximum of two votes could be given to a candidate from the elected party. However, the preferential votes were only valid if they were given to members of the elected party.

Election result of the SPÖ

The Social Democratic Party of Austria ran in the 2007 elections in 169 of the 170 participating municipalities. Only in Tobaj did the SPÖ not appear as an independent group on the SPÖ & U list. Governor Hans Niessl stipulated surpassing the election results of 2002 as a choice destination before the election. The SPÖ lost 1.26% in the elections and lost 19 seats.

The SPÖ achieved its best result in its traditional stronghold Tschanigraben . Since there were no opposing candidates here, the SPÖ achieved 100% of the votes. In Draßburg the SPÖ was able to increase its share of the vote by 3.57% and reached 83.16%. In Weppersdorf , too , the SPÖ expanded its result slightly and posted 79.40%. In addition, the SPÖ achieved more than 70% of the votes cast in Neustift near Güssing , Neutal , Siegendorf , Schattendorf , Rauchwart , Olbendorf , Kaisersdorf , Riedlingsdorf , Winden am See and Bruckneudorf . In 24 other municipalities the SPÖ was over 60%, in 45 municipalities over 50%. Overall, the SPÖ achieved an absolute majority in 85 municipalities. The SPÖ recorded the greatest gains with 27.76% in Bildein , where it had not started in 2002. In Sigleß , the SPÖ was able to expand its absolute majority by 15.89% to 65.89%. The SPÖ also achieved high gains of over 10% in Kleinmürbisch , Frankenau-Unterpullendorf , Pinkafeld , Neudorf , Rohr im Burgenland , Wortberg and Gattendorf .

On the other hand, the SPÖ recorded heavy losses in Ritzing , where they lost 39.49% of the vote and thus the absolute majority and the mayor's chair. In Hirm , the SPÖ lost 24.35% when the ÖVP appeared for the first time, but was able to hold the absolute majority of the votes. The SPÖ also suffered heavy losses in Neudörfl , where it cost them 18.13% to appear on a citizens' list. In Kohfidisch the SPÖ lost 15.69% and the majority of the mandate to the ÖVP. The SPÖ also lost more than 10% of the votes in Bad Sauerbrunn , Parndorf , Mannersdorf an der Rabnitz , Stotzing , Deutschkreutz , Sankt Margarethen im Burgenland , Stinatz , Hornstein and Mogersdorf .

In relation to the Burgenland districts, the SPÖ achieved its best result in the free city of Rust (52.12%). This is followed by the Mattersburg district (51.60%), Eisenstadt-Umgebung (50.95%), Neusiedl am See (49.06%) and Oberpullendorf (48.41%). In the districts of Güssing (40.97%) and Jennersdorf (39.82%), the SPÖ performed much worse. The state capital Eisenstadt came in last with 27.85%.

Austrian People's Party

Election result of the ÖVP

The Austrian People's Party competed in the 2007 elections in 168 of the 170 participating municipalities. In Rohr in Burgenland a list of citizens close to the ÖVP started, in the SPÖ stronghold Tschanigraben there was no candidacy of the ÖVP. Prior to the election, Dietmar Halper , the ÖVP regional manager, named the election goal as maintaining or slightly expanding the number of mandates. With regard to their share of the vote, there were hardly any changes for the ÖVP compared to 2002, they only lost 0.07% of their share of the vote. Nevertheless, the ÖVP was able to win 34 mandates.

The ÖVP achieved its best result after a gain of 5.01% and 73.98% of the votes in Heiligenbrunn . Also in Strem (73.44%), Leithaprodersdorf (73.07%), Bildein (72.24%), Deutsch Schützen-Eisenberg (71.04%), Eberau (70.56%) and Burgauberg-Neudauberg (70 , 13%) the ÖVP reached more than 70%. Five of the seven strongest communities are in the Güssing district. In 20 other municipalities the ÖVP received more than 60% of the votes, in another 35 municipalities more than 50%. Overall, the ÖVP achieved an absolute majority in 66 municipalities in the 2007 municipal council elections. The ÖVP celebrated its greatest election success in the municipality of Ritzing , where, after a plus of 41.43%, it was able to unite a share of the vote of 64.80% and the SPÖ took over the mayor. In the free city of Rust, the ÖVP won 40.24% of the votes after it had run there for the first time in 35 years and the former long-term mayor Heribert Artinger no longer ran. In Hirm, too, the ÖVP, which did not compete here in 2002, was able to gain 29.06%. In Mannersdorf an der Rabnitz , Kohfidisch , Edelstal and Krensdorf , the ÖVP took the absolute majority and the post of mayor from the SPÖ after winning more than 10.0% of the votes. The ÖVP also won more than 10.0% in Stotzing , Gattendorf , Sankt Margarethen im Burgenland , Nickelsdorf , Stinatz , Kaisersdorf and Lackendorf .

The ÖVP recorded its biggest defeat in Schützen am Gebirge , where it lost 19.24% and the absolute majority after competing in a citizens' list. In Breitenbrunn and Neudörfl , too , the ÖVP lost more than 15% of its votes in the course of the candidacy of citizens' lists. The ÖVP also recorded losses of over 10% in Weichselbaum , Neuhaus am Klausenbach , Frauenkirchen , Wortberg and Mörbisch am See .

Freedom Party of Austria

Election result of the FPÖ

The Freedom Party of Austria (FPÖ) had been weakened in the run-up to the municipal elections by the change of numerous politicians to the Free Citizens' List . As a result, the FPÖ could only stand for election in 70 municipalities in 2007, while in 2002 they ran in 121 (without Potzneusiedl) municipalities. Nevertheless, FPÖ party chairman Johann Tschürtz set the election goal of the FPÖ with the achievement of a total of 70 seats. In the local council elections in 2002, the FPÖ had 96 seats. Ultimately, the FPÖ lost around 40% of its votes compared to the 2002 elections and won 53 seats (−43).

The FPÖ suffered the greatest losses in municipalities, where it was no longer able to stand for election due to the change of its municipal councils to other electoral alliances. In Halbturn the FPÖ had achieved its best result with 32.45% in 2002, in 2007 the FPÖ could no longer compete in the community after FPÖ members had run together with the newly founded "Citizens' List Halbturn". The second largest municipality in the FPÖ, Deutschkreutz , was also lost to a citizens' list. Manfred Kölly , the only mayor of the FPÖ after the 2002 elections, founded the “Free Citizens List - Manfred Kölly” after being expelled from the party and joined the FBL. All FPÖ councilors from Deutschkreutz and other officials had also switched to the FBL. In Lutzmannsburg (2002: 18.39%) the FPÖ no longer competed in 2007, in Mörbisch am See the FPÖ fell from 16.77% to 5.50% and was only able to hold one mandate. In Kleinmürbisch (2002: 13.46%), the FPÖ flew out of the municipal council after heavy losses.

The FPÖ achieved its best result in the home community of party chairman Tschürtz Loipersbach in Burgenland , where it rose to the second strongest force with 24.97% of the votes after winning 5.76% and two mandates. The party achieved its second-highest result in Oberschützen , where it lost 5.17% of the 2002 result with 18.53% of the vote. The FPÖ also lost almost 5% in Deutsch Jahrndorf , but achieved their third-best result with 17.31%. The FPÖ was able to win more than 10% of the votes in Wimpassing an der Leitha (16.49%), Bad Tatzmannsdorf (15.54%), Mariasdorf (14.22%), Deutsch Schützen-Eisenberg (13.66%), Litzelsdorf (12.78%) and Zurndorf (11.76%). For the most part, however, the FPÖ also lost significant votes in these communities, only in Litzelsdorf a significant gain of 7.33% was recorded.

Free list of citizens

Election results of the Free Citizen List

The Free Citizens List (FBL) was founded in March 2007 by former FPÖ politicians after internal party quarrels and was able to win over numerous local liberal politicians for their goals. This enabled the FBL to run for the first time in local council elections in 53 parishes. List founder Wolfgang Rauter anticipated winning 50 to 60 council seats before the election. Ultimately, the FBL was able to move into ten different councils with 30 seats.

The FBL achieved the strongest results in municipalities where, after the transfer of numerous former FPÖ politicians to the FBL, no FPÖ candidacies were made. The FBL achieved the greatest electoral success in the municipality of Deutschkreutz , where the only FPÖ mayor of Burgenland, Manfred Kölly , had founded the "Free Citizens List - Manfred Kölly" together with all FPÖ municipal councils and other officials before the FBL was founded. Kölly was able to surpass the local council result of the FPÖ of 2002 by around 15% and made the FBL the strongest parliamentary group in the local council of Deutschkreutz with 38.66% and ten seats. In the direct mayor elections, Kölly also prevailed with 60.61% in the first ballot and thus became the only mayor of the FBL. The FBL achieved its second best result in the municipality of Eltendorf , where the list with 19.92% was able to practically double the former result of the FPÖ and won three mandates. In Großhöflein , too , the FBL under list founder and ex-regional councilor Wolfgang Rauter was able to significantly exceed the FPÖ's 2002 election result with 18.06% and achieve four mandates. The FBL was able to achieve further strong results in Heiligenkreuz im Lafnitztal (16.5%), Breitenbrunn (12.78%) and Mörbisch am See (11.79%). In addition, the FBL moved into the municipal councils of Stadtschlaining , Oggau am Neusiedler See , Zillingtal and Deutsch Kaltenbrunn .

In relation to the Burgenland districts, the FBL achieved its best result in the Oberpullendorf district (4.42%). This is followed by the Jennersdorf district (3.83%), Eisenstadt-Umgebung (3.76%) and the state capital Eisenstadt (2.47%). In the districts of Mattersburg (0.77%), Oberwart (0.70%), Neusiedl am See (0.57%) and Güssing (0.25%), the FBL performed much worse. The FBL did not run in the statutory town of Rust.

The green

Election result of the Greens

After the Greens ran in the local council elections in 2002 in 15 municipalities, they ran in 2007 in 21 municipalities. In 14 municipalities they ran for the first time, in seven municipalities they were no longer running after the failure in 2002. In 2006 the Greens also took part in the early elections in Steinberg-Dörfl . Before the election , state spokesman Joško Vlasich formulated the electoral goal to double the municipal council mandates from 13 to 26. Ultimately, however, the Greens only achieved half of the targeted gain and are represented in 14 municipalities in the municipal council after the 2007 municipal council elections.

The Greens achieved the best result in the municipality of Nickelsdorf , where the Greens received 17.27% of the vote. With a plus of 8.27%, the Greens in this municipality won two more mandates in addition to their existing mandate. In Jennersdorf , the Greens achieved their second-best result, but stagnated at 11.22% and lost their third mandate - which was confirmed after an election challenge and a ruling by the Constitutional Court. In Großwarasdorf , the Greens posted slight gains and were able to win a mandate with 9.76%. The party achieved further good results in Neusiedl am See (7.67%) when they ran for the first time and in the state capital Eisenstadt (7.64%). In Frankenau-Unterpullendorf, however, the Greens lost around 5% (7.36%) as well as one mandate. In Breitenbrunn and Mattersburg , the Greens were able to keep their mandate from 2002, in Heiligenkreuz im Lafnitztal , Steinberg-Dörfl (2006), Rudersdorf , Neudörfl , Oberpullendorf and Steinbrunn , the party won one mandate each when it took office for the first time. In eight communities, however, the Greens failed because of their entry into the local council. The Greens suffered heavy losses in the Oberwart district, where they lost their only mandate in Pinkafeld and Oberschützen and are therefore not represented in any municipality in the district. In the Güssing district, too, the Greens only appeared in the district capital Güssing , where they failed to join the local council. In addition to the state capital, the Greens achieved the highest proportion of votes in the districts of Jennersdorf (3.66%), Oberpullendorf (1.30%), Mattersburg (1.26%) and Neusiedl am See (1.24%). This was followed by the districts of Eisenstadt-Umgebung (1.21%), Oberwart (0.43%), Güssing (0.24%) and the statutory town of Rust (0%).

Details of the mayoral elections

In the direct mayor elections on October 7, 2007, the SPÖ achieved 86 mayors, the ÖVP had 72, the FBL one and other lists three mayors. The biggest winner was the ÖVP, which beat the governing SPÖ mayors in the eight municipalities of Edelstal , Kohfidisch , Krensdorf , Mannersdorf an der Rabnitz , Mogersdorf , Ritzing , Raiding and Oberloisdorf and also won the mayor's post in Gattendorf from a list of citizens. With the loss of eight mayor's posts , the SPÖ was only able to gain four from the ÖVP in Großmürbisch , Horitschon , Jabing and Müllendorf . The SPÖ had already won the mayor 's post of Steinberg-Dörfl from the ÖVP in 2006 . In Deutschkreutz , the FPÖ lost its only remaining mayor post in Burgenland. The former FPÖ politician Manfred Kölly there ran for the FBL in 2007 and was confirmed in the first ballot.

Shortlisted

The shortlist on October 21 had to be held in those eight Burgenland municipalities in which none of the mayoral candidates had received an absolute majority after the first ballot. In the run-off elections, the ÖVP was able to maintain the post of mayor in Schützen am Gebirge , Zurndorf , Lutzmannsburg , Deutsch Jahrndorf and Stadtschlaining , while ÖVP candidate Josef Kolby beat the incumbent SPÖ mayor Herbert Gross in Mönchhof . In Parndorf , too , the previous SPÖ mayor Anton Gabriel was beaten by his challenger Wolfgang Kovacs (Parndorf list). Only in Großhöflein was the incumbent SPÖ mayor confirmed in the runoff elections. After the run-off elections, the SPÖ provides the mayor (including Steinberg-Dörfl) in 88 (−5) municipalities in Burgenland, 78 (+5) mayors in the ÖVP, 1 mayor in the FBL and 4 (± 0) mayors on other lists .

Electoral objections

In the four municipalities of Jennersdorf , Wiesen , Halbturn and Donnerskirchen , objections were raised against the election result in the course of the municipal council elections. In the three communities of Halbturn, Donnerskirchen and Jennersdorf there were objections to the allocation of ballot papers. While the state electoral authority rejected the objections in Halbturn and Donnerskirchen, the appeal of the Greens in Jennersdorf was granted. There a ballot paper had been assessed as "valid for the ÖVP", but was invalid after the Greens objected and according to the state electoral authority. The Constitutional Court confirmed the municipal electoral authority. In Jennersdorf, the mandate moved from the Greens back to the ÖVP. According to the SPÖ, there were irregularities in the special electoral authority in Wiesen. The state electoral authority finally approved the challenge of the SPÖ in Wiesen on the grounds of "illegality of the election act before the special electoral authority", since when voting in a senior citizens' home, the electorate was not identified by a member of the special electoral authority. The election will be held on April 6, 2008.
