Political official

A political civil servant is a civil servant if he holds an office which , when exercising it, must be in constant compliance with the fundamental political views and goals of the government ( Section 30 (1) BeamtStG ). Political civil servants can be put into temporary retirement at any time in accordance with the provisions of Section 54 of the Federal Civil Service Act (BBG) or Section 30 of the Civil Service Status Act (BeamtStG) . If they are on probation as a civil servant , they can be dismissed at any time.

Federal officials

For federal civil servants, who is a political civil servant and can accordingly be put into temporary retirement is regulated in Section 54 of the Federal Civil Servants Act (BBG). Accordingly, the following civil servants are recorded for life:

soldiers

In soldiers' law there is the possibility of transferring to temporary retirement for the rank group of generals, i.e. from Brigadier General (or equivalent) upwards. The legal basis is § 50 Soldiers Act .

Federal Ministers and Parliamentary State Secretaries

Federal ministers and parliamentary state secretaries are not civil servants, but have a public-law office relationship ( Section 1 BMinG and Section 3 (3 ) ParlStG ). Like political officials, Federal Ministers can, according to § 9 Paragraph 2 Clause 2 Alt. 1 BMinG and parliamentary state secretaries according to § 4 1st Hs. ParlStG can be dismissed at any time.

State officials

Anyone political state official i. S. v. Section 30 (1) sentence 1 BeamtStG is determined in accordance with Section 30 (1) sentence 2 BeamtStG i. V. m. with the respective state civil servant law . For example, Section 37 of the Civil Service Act for the state of Mecklenburg-Western Pomerania regulates who is a political civil servant. These are state secretaries, the spokesman for the state government and the head of the Department for the Protection of the Constitution in the Ministry of the Interior.

Some state civil servant laws do not know the term political officer. Instead, the legal consequences are regulated by law at the respective office.

history

The Kingdom of Prussia first qualified under-secretaries, ministerial directors, high presidents, regional presidents, the heads of royal police authorities and the district administrators as political officials with the law of July 21, 1852. Bismarck expanded the group of people with Section 25 of the Reichsbeamtengesetz of March 31, 1873 to include officials below the rank of director, provided they worked in the Reich Chancellery or in the foreign service. It stayed that way until 1937, when the National Socialists also included the higher service (from the Government Council) in the Reich Chancellery, the Presidential Chancellery and the Foreign Office as well as all press officers of the Reich Ministries in Section 44 of the German Civil Service Act .

Under Section 36 of the Federal Civil Service Act (BBG) of 1953 ( Federal Law Gazette I p. 551 ), state secretaries and ministerial directors, all civil servants in the higher service in the foreign service from grade A 1a upwards, the president and the vice-president of the Federal Office for the Protection of the Constitution, the Federal Press Chief and their representatives and federal prosecutors, provided they were civil servants for life.
