Ronald Pofalla (2018)

Ronald Pofalla (* 15. May 1959 in Weeze ) is a former German CDU - politician and federal minister and, since 2015 Member of the Board of Deutsche Bahn AG . He was the deputy chairman of the CDU / CSU parliamentary group and general secretary of the CDU. In the Merkel II cabinet he was Federal Minister for Special Tasks and Head of the Federal Chancellery from October 28, 2009 to December 17, 2013 .

He has been an employee of Deutsche Bahn since January 1, 2015, has been a member of the Executive Board since August 2015, and has been responsible for infrastructure since 2017.

Life

education

Pofalla was born in 1959 in Weeze, the son of a cleaner and a field worker. After completing secondary school in 1975 at the secondary school in Weeze, Pofalla attended the technical college for social pedagogy in Kleve , where he obtained the technical college entrance qualification in 1977 . He then studied social pedagogy at the Düsseldorf University of Applied Sciences . In 1981 Pofalla finished his studies in social pedagogy with a diploma (FH), before he started studying law at the University of Cologne , which he finished in 1987 with the first state examination . After completing his legal clerkship , he also passed the second state examination in 1991 and has since been admitted to the bar. From 1993 he worked, meanwhile as a partner , for the law firm Holthoff-Pförtner in Essen .

Even during his student days, Pofalla was supported by the entrepreneur Bernhard Josef Schönmackers, who runs waste disposal and environmental companies in the Kleve district. Schönmackers was - according to his own statements - by the then municipal director of Wienen "asked for funding or support for Mr. Pofalla's studies". Pofalla was then supported for several years with 1200 to 1300 DM per month. "The whole point of our cooperation was to give Mr. Pofalla a certain financial basis for his law studies", but also to establish "political contacts" and to deal with questions of tenancy and labor law. According to Schönmacker, the further collaboration with Ronald Pofalla also consisted of “political support for the development and expansion of our company”.

Party career

Pofalla has been a member of the CDU since 1975. Here he was initially involved in the Junge Union , whose state chairman in North Rhine-Westphalia he was from 1986 to 1992. From 1991 to 2007 he was chairman of the CDU district association Kleve (since November 2014 honorary chairman) and from 2000 to 2014 also of the CDU district association (since then honorary chairman) Niederrhein . Pofalla has also been a member of the CDU state executive in North Rhine-Westphalia since 1995.

On December 5, 2005, he was named CDU General Secretary by the CDU federal executive board and was officially elected on November 27, 2006 at the 20th federal party conference in Dresden with 80.78% of the vote. His successor was Hermann Gröhe in October 2009 .

Pofalla belonged to the local council of his birthplace Weeze and was chairman of the CDU parliamentary group from 1979 to 1992 .

He was a member of the German Bundestag for 24 years . From 2002 to 2004 he was legal advisor and from 2004 to 2005 deputy chairman of the CDU / CSU parliamentary group for the areas of economy and work as well as medium-sized companies . At the end of 2014 he gave up his mandate in the Bundestag to move to the board of the state-owned Deutsche Bahn AG.

Pofalla entered the Bundestag in 1990 via the state list of North Rhine-Westphalia and since then has always been a directly elected member of the Kleve constituency . In the 2013 Bundestag election , he received 50.9% of the first votes (2009: 48.9%).

From October 28, 2009 to December 17, 2013, Pofalla held the position of head of the Federal Chancellery, and was also Federal Minister for Special Tasks in the Merkel II cabinet. As head of the Federal Chancellery, Pofalla was also the Federal Government's agent for the intelligence services. Private

Pofalla belongs to the Evangelical Church . He is childless and twice divorced. In order to become a father, he did not take over a ministry after the 2013 federal election. He has been married to the lawyer Nina Hebisch for the third time since August 6, 2016.

Pofalla has two siblings.

Controversy

Allegations and house searches

In January 2000, tax investigators went to Bonn's chief public prosecutor, Bernd König - who at the time was representing the proceedings against former Federal Chancellor Helmut Kohl on suspicion of breach of trust - and declared that they would investigate an employee of MP Ronald Pofalla. They also asked König whether further investigations would affect the ongoing proceedings against Kohl. The connection to the proceedings against Kohl arose because he was defended by lawyer Stephan Holthoff-Pförtner and Pofalla works in his office and also brokered Kohl's mandate to Holthoff-Pförtner. If the CDU were to win in the following NRW state elections in 2000 , Pofalla would also be the new NRW Minister of Justice , as he was appointed to his shadow cabinet by the CDU top candidate Jürgen Rüttgers . Rüttgers again accused the investigators that the investigations should only have discredited Kohl's lawyers and Pofalla. The tax investigation investigated as early as 1996 that Pofalla was said to have received an unexplained amount of 1.4 million D-Marks in 1994, but this case was also closed because there was no reason for an investigation. As part of other investigations against Holthoff gatekeeper, which had been running since 1999, tax officials formulated another accusation on March 28, 2000, according to which Pofalla had an "unexplained increase in assets" of 700,000 marks for the years 1993 to 1997, and demanded Clarification of a house search in Pofalla's private house, his divorced wife, his Bundestag office and three banks. The public prosecutor in Kleve affirmed a suspicion and informed Bundestag President Wolfgang Thierse on April 17, 2000 that an investigation into tax evasion should be initiated against Pofalla. Following a unanimous decision by the Immunity Committee to lift Pofalla's immunity , a total of eleven requested house searches and seizures were carried out on May 11, 2000. These did not produce any results and NRW Minister of Justice Jochen Dieckmann criticized a violation of the principle of proportionality . The case against Pofalla was closed in August 2000 for lack of evidence. During the later review of the proceedings, the Kleve Regional Court found that there was no sufficient initial suspicion and that the investigation and the resulting house search were illegal . Later lawsuits by Pofalla and the CDU parliamentary group before the Federal Constitutional Court were rejected by the Second Senate as inadmissible . The CDU parliamentary group had initially also called for a committee of inquiry , but then let the corresponding plans fizzle out.

Verbal lapses

Pofalla has repeatedly been attributed with a hot temper and inappropriate language. At a meeting of the general secretaries of all parties represented in the Bundestag in March 2009, Pofalla clashed with FDP general secretary Dirk Niebel so violently that they only yelled at each other. In the dispute over the suspension of compulsory military service in June 2010 with Defense Minister Karl-Theodor zu Guttenberg , Pofalla is said to have ridiculed him as "Rumpelstiltskin". Following a meeting of the NRW regional group on September 26, 2011, Pofalla verbally attacked his party colleague Wolfgang Bosbach because he did not want to follow the CDU party line and refused to approve the expanded European rescue package (EFSF). Pofalla is said to have said to Bosbach: "I can no longer see your face" and, after Bosbach pointed out to Pofalla the freedom of choice guaranteed in the Basic Law, replied: "I can no longer hear that shit". Pofalla then found himself exposed to severe criticism, both from the media and from politicians from within his own ranks. The CDU MP at the time, Erika Steinbach, described Pofalla's statements as “bullying” and the FDP MP Erwin Lotter described it as a “freak” that poisoned the climate in the black-yellow coalition. After Pofalla had apologized for his abuse towards Bosbach and declared: "I am very angry about what happened and I am extremely sorry", Bosbach declared the dispute over.

After the surveillance and espionage affair became known in 2013 , Pofallas did not make any statements to the public, although these fell within Pofalla's immediate area of ​​responsibility as the head of the Federal Chancellery responsible for the Federal Intelligence Service and the coordination of the secret service . In an interview with Die Zeit , Angela Merkel explicitly referred to Pofalla's responsibility. Despite new revelations, he later stated that all allegations made against the secret services involved were "off the table" and that there had been "no millions of fundamental rights violations" in Germany. Rather, the secret services involved had assured him in writing that they would adhere to German law. These statements were often viewed with malice and developed into an Internet phenomenon . At the large-scale demonstration entitled “ Freedom instead of fear ”, demonstrators often referred to Pofalla's statements on posters. The satirical program Extra3 of the NDR awarded him the negative prize "Silver Deputy Sheriff Star" for his role in the surveillance and espionage affair, which he turned down, however. While Pofalla had put information about German citizens to US intelligence services at two records in July 2013, two months later several media outlets citing confidential documents of 864 records transferred to the United States by the Constitutional Protection in 2012, and more 657 transfers were made to British services.

When it was revealed the following October that Chancellor Merkel's mobile phone had also been tapped by the US secret service NSA , Pofalla expressed his indignation in front of the press and spoke of a "serious breach of trust" on the part of the USA. He also announced that he would re-examine all previous US statements on the surveillance measures.

Change to Deutsche Bahn

According to press reports at the beginning of January 2014, Pofalla is said to have planned to move to the board of Deutsche Bahn . As later became known, Rüdiger Grube had spoken to Pofalla during his time as Minister of the Chancellery. He was one of several candidates for a post with which Grube should be relieved of time-consuming tasks of maintaining political relationships, which, according to Grube, made up more than half of his working hours. Pofalla and Grube are considered friends.

The planned change to Deutsche Bahn aroused wide criticism. The managing director of Transparency International Germany , Christian Humborg, asked Pofalla to give up his mandate in the Bundestag. Ulrich Kelber , Parliamentary State Secretary in the Federal Ministry of Justice, commented that the impression was created that Pofalla was being “purposefully bought”. Britta Haßelmann (Greens) criticized the process, if it turned out to be correct, as "outrageous". In connection with the possible change of Pofalla, mandatory waiting periods for politicians were discussed. In 2005, Pofalla himself had strongly criticized Gerhard Schröder , who had accepted a post at Nord Stream AG immediately after the end of his term of office as Federal Chancellor , and called for rules of conduct “to prevent similar cases in the future”. With his move to Deutsche Bahn, the Kleve district no longer has a directly elected member of the Bundestag. The rail and transport union also criticizes the change.

The former SPD member of the Bundestag Peter Conradi , the former Stuttgart regional court chairman Dieter Reicherter and the lawyer Eisenhart von Loeper reported Pofalla on suspicion of infidelity. He is said to have put three state secretaries under pressure in February 2013 to support the continuation of the Stuttgart 21 rail project , although there were economic concerns. However, the Berlin public prosecutor did not start any investigation. After further evidence emerged, a new criminal complaint was filed.

At the end of January 2014, Grube announced that it would present the Supervisory Board with a concept for the future structure of management board positions that would become vacant at the end of March 2014, without a direct personnel decision being made. In June 2014, Grube announced that Pofalla would move to Deutsche Bahn on January 1, 2015 and be appointed to the board in 2017 at the latest. Pofalla is to take over about half of the 22 corporate divisions reporting to CEO Rüdiger Grube today. In addition to maintaining political contacts, Pofalla, as a general representative (below the board of directors), will also be responsible for all corporate representatives of the federal states as well as the areas of business and regulation . He was also to take over the post of the then retiring Deutsche Bahn director Gerd Becht in 2017 . Since January 1, 2015 he has been employed as a general representative for political and international relations at Deutsche Bahn in Berlin . His annual salary is estimated at 600,000 euros.

Pofalla will also continue to be responsible for national and international relations. According to the supervisory board, the federal government has urged that the change planned for 2017 be carried out early. With Merkel, Pofalla ensured that Grube's contract was extended, and in return, Grube promised to build Pofalla as his successor. Since August 2015, Pofalla has been the director of economics, law and regulation. A number of executives went or were left under Pofalla. Around 2016 he was considered the likely successor to Grube as CEO from 2019/2020 and his favorite.

On December 14, 2016, the DB supervisory board decided to appoint Pofalla as a board member for infrastructure with effect from January 1, 2017. Previously, three candidates proposed by personnel consultancies on behalf of the chairman of the supervisory board with extensive practical experience in the committee's personnel committee were rejected by the federal representative due to a lack of a “political profile”. The areas of economics , politics , corporate security , DB security and international business relations should be incorporated into the board department . The legal department is transferred to Ulrich Weber .

Pofalla (2017)

After Grube's resignation, Pofalla worked hard to become his successor. Federal Transport Minister Alexander Dobrindt as well as the railway and transport union and the SPD had spoken out against him. Chancellor Angela Merkel did not support him either. In a confidential conversation, Chancellery Minister Peter Altmaier and Federal Transport Minister Alexander Dobrindt assured Pofalla that they would find a solution that he could live with. Among other things, this prevented the appointment of Siemens manager Siegfried Russwurm to the board post. With the decision of the Supervisory Board on March 22, 2017, Pofalla received a new five-year contract.

Pofalla is considered well prepared and has his area under control. Pofalla's influence on the Railway Regulation Act passed in 2016 was the subject of widespread criticism. Among other things, he said: "Deutsche Bahn will not agree to the law like this."

He is to head the Steering Committee for Stuttgart 21 from April 1, 2017. The assumption of responsibility for S21 met with criticism because, as minister of the Chancellery, he had an influence on the decision of the supervisory board to continue the project and, as a board member, was now involved in a lawsuit against the project partners regarding participation in additional costs.

In order to ensure the punctuality of trains in long-distance rail traffic, Pofalla suggested in 2018 that trains should skip scheduled stops or, in the event of a long delay, also turn around in front of the destination station so that the train in the opposite direction would be on time again. This early turning, known as the Pofalla turn , was introduced on a test basis on the Berlin - Duisburg - Düsseldorf route.

Petersburg Dialogue

Pofalla has headed the Federal Government's Petersburg Dialogue since 2015 . His predecessor Lothar de Maiziere was criticized for supporting the Russian perspective too clearly. Pofalla was preferred to Ruprecht Polenz , who had called for drastic restructuring measures in order to balance the tendency and the entrepreneurial nature of the dialogue. Also Matthias Platzeck resigned to its position on the issue of annexation of the Crimea as a successor candidate from. Pofalla seemed suitable for a constructive dialogue with Russia, also due to his Eastern European experience and economic contacts. The dialogue should be resumed, but the sanctions should remain in place.

Coal commission

In June 2018, Pofalla was appointed one of four chairmen of a federal government commission to phase out coal. The supervisory board of Deutsche Bahn unanimously approved the secondary employment. Pofalla had to promise that he would take on fewer obligations in the commission than his co-chairs there. In the autumn meeting of the supervisory board, he also had to demonstrate that he was fulfilling his duties as DB board member in full.

Critics see a conflict of interest in Pofalla's work, as Deutsche Bahn is benefiting from the plans of the coal commission through long-running traction power plants and low prices.
