After the state elections in Upper Austria in 2009, 28 of the 56 mandates went to the Austrian People's Party (ÖVP), 14 to the Social Democratic Party of Austria (SPÖ), 9 to the Freedom Party of Austria (FPÖ) and 5 to The Greens Upper Austria (GRÜNE).

The legislative period began with the constituent session on October 23, 2009. The constituent session elected the state government Pühringer IV after the members of the state parliament had sworn in .
