Higher Regional Court of Kassel
The Higher Regional Court of Kassel or Court of Appeal Cassel , shortly OLG Kassel , was from 1879 to 1945 a German Court of Appeal , based in Kassel .
history
prehistory
Since 1746, the Higher Appeal Court Kassel existed as the Higher Appeal Court in Hessen-Kassel, i.e. as the highest court. With the exception of the interruption of the period from 1807 to 1813 in which the Kassel Court of Appeal existed instead in the Kingdom of Westphalia , the Kassel Higher Appeal Court remained in its function until 1866. After the annexation of Kurhessen by Prussia in 1866, the court structure was incorporated into the Prussian one. In Kassel, a court of second instance has now been created with the Kassel Court of Appeal . The former Hessian justice offices and six newly created district courts served as the first instance .
The Higher Regional Court of Kassel
After the Reich Justice Laws came into force, the law of March 4, 1878, repealed the Court of Appeal and created the Kassel Higher Regional Court in its place. It had a criminal and two civil senates and was one of the smaller Prussian higher regional courts. The district of the OLG Kassel included the province of Hessen-Nassau and the principality of Waldeck . Subordinate to the higher regional court were the regional courts of Kassel, Hanau and Marburg and these 76 local courts. The Kassel Higher Regional Court had a President, a Senate President and eight councilors.
In 1935 the Prussian Higher Regional Court of Kassel - like all courts in the German states - was subordinated directly to the Reich Ministry of Justice , thus becoming a Reich authority bound by instructions. On October 1, 1944, the Kassel Higher Regional Court had to hand over the greater part of the Hanau Regional Court district to the Frankfurt Higher Regional Court. This decision took into account the fact that Frankfurt was spatially much closer to Hanau than Kassel. When the American troops marched into Kassel on April 4, 1945, the court was no longer active.
As part of the formation of the new federal state of Greater Hesse after the Second World War , it was decided not to establish a new higher regional court in Kassel. Its district was added to that of the Frankfurt Higher Regional Court, which has since been responsible for the entire state. Only the external senates of the Frankfurt court remained in Kassel.
