The Weinstein scandal includes several allegations , first published in October 2017 in the New York Times and the New Yorker , that the American film producer Harvey Weinstein committed sexual harassment , sexual assault or even rape against dozens of women in the film industry for decades made guilty. Weinstein denied having had non-consensual sex.

Shortly after the allegations were published, Weinstein was fired from his company and banned from the Academy of Motion Picture Arts and Sciences and other professional associations. His wife Georgina Chapman announced the separation and divorced. Politicians whom he had supported distanced themselves from him.

background

Harvey Weinstein and his brother Bob Weinstein founded the film production company Miramax and ran it from 1979 to 2005. In March 2005, the brothers founded The Weinstein Company ; in September 2005 they sold Miramax.

Rumors of Weinstein's " cast couch" practices had been circulating in Hollywood for years; Entertainers occasionally made appropriate suggestions. In 1998, Gwyneth Paltrow said on the Late Show with David Letterman that Weinstein required "a thing or two" to do. In a 2005 interview , Courtney Love advised young actresses, "If Harvey Weinstein invites you to a private party at the Four Seasons , don't go." In 2010, an article entitled Harvey's Girls alluded to Weinstein's "Casting Couch": "Everyone For a couple of years Harvey is looking for a new girl to be his mouse. "In 2012, a character on the television series 30 Rock said:" I'm not afraid of anyone in show business, I refused to have sex with Harvey Weinstein on no fewer than three occasions - out of five . ”At the 2013 Academy Awards , host Seth MacFarlane joked when announcing the best supporting actress nominee:“ Congratulations, you five ladies no longer have to pretend you think Harvey Weinstein is attractive. ”In 2014, Weinstein was also made by the Polish director Andrzej Żuławski publicly referred to as "Hollywood's biggest pig". The following year, Jordan Sargent, in the Gawker article Tell Us What You Know About Harvey Weinstein's “Open Secret,” wrote that “rumors about the powerful producer who is harnessing his industrial power for sexual gratification, consensual or otherwise, tended to Going unspoken limited to muted whispers and shoddy rumor blog comments ”.

In 2015, the New York Times reported that Weinstein was questioned by police after a 22-year-old woman accused him of touching her inappropriately. The woman was the Italian model Ambra Battilana Gutierrez . At the time, she was portrayed by some tabloid media as an aspiring opportunist and alleged blackmailer and associated with the notorious bunga-bunga parties of former Italian Prime Minister Silvio Berlusconi . Manhattan District Attorney Cyrus Vance Jr. did not indict for lack of evidence. At that time, Weinstein was still able to avert a marriage crisis.

Revelations 2017

The journalists Jodi Kantor and Megan Twohey of the New York Times first reported substantial accusations of sexual misconduct by Weinstein on October 5, 2017 . In their article, the authors accused Weinstein of sexual harassment for over three decades and reported payments in eight settlements to actresses and production assistants, temporary workers and other employees of the Miramax and Weinstein Company.

On October 10, 2017, NBC News correspondent Ronan Farrow reported on The New Yorker about additional allegations that Weinstein had sexually assaulted or molested 13 women and raped three women. Farrow said he planned to put the material on NBC months earlier but hinted that the station was under pressure not to release it. NBC denied this, but other press media confirmed and criticized this at NBC . According to Farrow, 16 former or current executives and assistants close to Weinstein said they observed or were aware of Weinstein's undesirable sexual advances. Four actresses shared their suspicions that Weinstein withdrew them from film projects or persuaded others not to cast them on film projects after they rejected his sexual advances and complained about him. The New Yorker also published the recording of an incriminating sound recording from a sting operation by the New York police's "Special Victims Unit" in 2015. In it, Weinstein admitted to having groped Ambra Gutierrez .

The following year, Jodi Kantor and Megan Twohey as well as Ronan Farrow received the Pulitzer Prize in the category of public service for exposing the Weinstein scandal .

More allegations

After the articles appeared in the New York Times and New Yorker , many women in the entertainment industry made similar allegations against Weinstein. According to their reports, Weinstein invited young actresses or models into a hotel room or office on the pretext of discussing their careers and then demanded massages or sex from them. Former Weinstein colleagues and employees told reporters that these activities were made possible by employees, staff, and agents who arranged these meetings, as well as lawyers and press officers who suppressed complaints through payments and threats. A former assistant answered and protested against such allegations of "collaboration". She and her work colleagues suffered themselves and lived in a “system of manipulation and oppression”. In retrospect, however, she reproaches herself for not having left that "system of humiliation and exploitation" earlier.

Sexual harassment or coercion

Women who have reported being sexually harassed or coerced by Weinstein include:

Rapes

Anthony, Argento, Evans, McGowan, Sciorra, and an unnamed woman quoted by the New Yorker also accused Weinstein of rape in addition to sexual harassment and coercion . In October 2016, McGowan had expressed in a cryptic tweet that she had been raped by Weinstein. In October 2017, she also accused several people from his environment of complicity, including the entire board of the Weinstein Company and actor Ben Affleck .

Detective agencies of former Mossad agents

In order to counteract the publication of these allegations, Weinstein hired security services to investigate women affected by false identities. He signed a contract with Black Cube , a company that is largely operated by former officers of the Mossad and other secret services, in July 2017. Two detectives met McGowan, who accused Weinstein of rape - among other things under the pretext of being a women's rights activist be. An agent pretended to be affected under a false identity. Black Cube later apologized and announced that it would donate the EUR 1.1 million fee to women's rights organizations. In other cases, journalists and detectives commissioned by Weinstein interviewed women to determine which press representatives they had contacts with - and reported this to Weinstein.

Weinstein's replies

Weinstein said after the article appeared in the New York Times that he would be taking time off. He apologized for his behavior, which had led to too much suffering, and wanted to get his "demons" under control. His advisor, lawyer Lisa Bloom , described him as an "old dinosaur that has to get used to a new era". Bloom was criticized for handling Weinstein's defense, and on October 7, 2017, she resigned as an advisor. Two days later, Weinstein hired the PR firm Sitrick and Company , which specializes in crisis PR . Weinstein's attorney Charles J. Harder wrote that his client would sue the New York Times , but as of October 15, he no longer represented Weinstein.

In response to the New York report, a Weinstein spokeswoman made the following statement:

“Any allegations of non-consensual sex are unequivocally denied by Mr. Weinstein. Mr. Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances ... Mr. Weinstein has begun counseling, has listened to the community and is pursuing a better path. Mr. Weinstein is hoping that if he makes enough progress, he will be given a second chance. "

Reactions

Weinstein's alleged acts were condemned by numerous celebrities after they became known in October 2017. It also sparked a public discussion of "willful ignorance and shameful complicity in sexually aggressive behavior and workplace harassment" in the film industry, as the Academy of Motion Picture Arts and Sciences put it.

After the scandal became known, the US actress Alyssa Milano called on the micro-blogging service Twitter to use the hashtag #MeToo if a woman had experienced sexual assault. Countless women answered the call. In France, the journalist Sandra Muller called for sexual assaults to be publicized with the hashtag “#BalanceTonPorc” (Eng. “Whistle your pig”); the term was shared 335,000 times in six days. Brigitte Macron , the wife of the French President, welcomed the debate.

Film directors

Speaking to Buzzfeed News , director Michael Caton-Jones said Weinstein replaced him with another director for B. Monkey and presented it as if he had voluntarily withdrawn from the project after dating it over the I quarreled about casting the main role. Weinstein had rejected his proposed Sophie Okonedo on a sexist basis, whereupon Caton-Jones accused him of not ruining the casting of the film with the cast couch. Actress Asia Argento , who eventually took on the role, is one of the women who accuses Weinstein of rape.

In a guest article in the New York Times , the actress Salma Hayek reported on December 12, 2017 how Weinstein had given her ever higher hurdles for her film project Frida and increasingly reacted with “Machiavellian anger” when she repeatedly rejected his sexual advances. Once he even threatened to kill her. Maria Wiesner from the FAZ sees this as confirmation that Weinstein “would have foregone profit, prestige and prizes just to take revenge for his hurt ego”, and “inevitably asks herself the question of how often similar behavior is good films prevented ". Weinstein denied Hayek's allegations.

In December 2017, Lord of the Rings director Peter Jackson said in an interview with the online portal Stuff that he was the actresses Ashley Judd and Mira Sorvino for his Hobbit and Lord of the Rings film projects in the 1990s Considered, however, because of warnings from the Weinstein brothers about working with them, no longer considered them for them. When the allegations against Weinstein became known, he considered his warnings, in retrospect, to be part of a “dirt campaign in full swing” against actresses. Ashley Judd filed a lawsuit against Weinstein in late April 2018.

Business

On October 8, 2017, the Board of Directors of The Weinstein Company removed Weinstein as CEO. Nine days later, Weinstein resigned from his position on the board of directors. Several companies ended their relationships with The Weinstein Company, including Apple , Hachette , Amazon , Lexus , Ovation TV, and Netflix . Shortly after the revelations of the Weinstein scandal, employees demanded the suspension of the often criticized confidentiality agreements , but The Weinstein Company was only ready to take this step in the course of filing for bankruptcy (under Chapter 11 ) on March 19, 2018.

Weinstein Clause

In the financial world, people soon began to include a so-called Weinstein clause in merger or takeover agreements. This stipulates that part of the transaction value can be reclaimed from the buyer if inappropriate behavior becomes known at a later point in time. Such escrow security amounts to up to 10% of the total transaction value.

Professional associations

Shortly after Weinstein's release, the British Academy of Film and Television Arts (BAFTA) suspended Weinstein's membership with immediate effect. The Academy of Motion Picture Arts and Sciences (AMPAS), which awards the Oscar , decided in an emergency meeting to expel Weinstein. It also announced ethical standards of conduct for its members, which came into force in December 2017 as a binding code of conduct. The Academy of Television Arts & Sciences (ATAS), which also awards the Emmy , excluded Weinstein for life. The Producers Guild of America (PGA) decided unanimously to initiate a process of elimination. When asked to comment, Weinstein did not comment on the allegations, instead gave up his membership and was subsequently expelled from the PGA association for life. A working group was also set up to deal with the issue of sexual harassment and issued a guide for producers in January 2018. The largest media union in Hollywood ( SAG-AFTRA ) also published a code of conduct in February 2018, and in April 2018 the union spoke out firmly against working meetings in hotel rooms with the aim of improving work safety.

politics

Prominent politicians condemned the acts accused of Weinstein. Several US politicians who supported Weinstein passed his donations on to charities, including Democratic Senators Al Franken , Charles Schumer , Patrick Leahy, and Martin Heinrich .

US President Donald Trump said he had known Weinstein for a long time and was not at all surprised by the allegations. Hillary Clinton , Barack Obama and Michelle Obama condemned the behavior reported about Weinstein on October 10, 2017. The group leader of the Democrats Nancy Pelosi described the revelations about Donald Trump as the trigger for the publicity of the Weinstein scandal, which led to a flood of complaints about sexual misconduct. In late November 2017, the United States House of Representatives unanimously decided to hold annual anti-sexism seminars for all MPs and their staff.

French President Emmanuel Macron initiated steps to remove Weinstein from the Legion of Honor . In the UK, called Labor - MP Chi Onwurah the responsible Honors Forfeiture Committee to initiate the process, with the Weinstein the title Commander in the Order of the British Empire may be withdrawn.
