After the initially planned as trade minister governor of New Mexico , Bill Richardson , had rejected the nomination of an ongoing investigation against him in early February 2009 it was announced that President Obama was planning to appoint a politician of the opposition Republicans in his place with Judd Gregg. The Republican Senate faction initially protested against this, as it was feared that New Hampshire's Democratic Governor John Lynch would appoint a Democrat as Gregg's successor, thereby expanding the Democratic majority in the Senate. Gregg himself had declared his waiver in this case, but after a conversation with the governor received his assurance that he would be followed by a Republican.

Gregg then gave his consent and was officially nominated by the president. It was later announced that Governor Lynch would name J. Bonnie Newman as his successor . She was Gregg's chief of staff during Gregg's time in the House of Representatives and worked for the US administration under Presidents Reagan and Bush .

Gregg withdrew his candidacy in the run-up to Congress adopting the stimulus package because of various differences. He stated that he was financially conservative and therefore could not always have stood behind President Obama.
