The National Assembly ( French : Assemblée Nationale ) is the unicameral parliament of the Republic of Niger .
history
Niger's parliament goes back to the General Council , which was established in 1946 when Niger was still a French colony . The Territorial Assembly of Niger emerged from the General Council of Niger in 1952. In 1958 the country became an autonomous republic within the Communauté française . The parliament acted as the Constituent Assembly from December 18, 1958 and as the Legislative Assembly from March 12, 1959.
Three days before Niger's independence from France, which was declared on August 3, 1960, a law replaced the Legislative Assembly with the National Assembly. The parliament of the independent state initially lasted for three legislative periods . In the coup d'état by Seyni Kountché against President Hamani Diori on April 15, 1974, the National Assembly was also dissolved. Niger had no parliament for the next fourteen years.
After the constitutional referendum of 1989 , the National Assembly was restored. From 1991 to 1993, under President Ali Saibou , the High Council of the Republic replaced the National Assembly as a transitional parliament. After Salou Djibo- led coup d'état against President Tandja Mamadou on October 15, 2010, there was another interim parliament, the National Consulative Council. The National Assembly met again on March 30, 2011 after the 2011 parliamentary elections .

The legislative period lasts five years. The minimum age of the MPs is 21 years. On the lists of political parties, party alliances and independent candidates, at least 75 percent of the candidates must have a primary school diploma ( Brevet d'Etudes du Premier Cycle ). The Constitutional Court decides on the admissibility of candidacies and the legality of the elections. The President has the right to dissolve the National Assembly, after which new elections must be held within a certain period of time.
In the last parliamentary elections on February 21, 2016 , the PNDS-Tarayya received the most votes and 75 of the 171 seats in the National Assembly.
Skills and way of working
The sessions of the National Assembly are generally open to the public and only take place in camera at the request of the Prime Minister or a third of the MPs. The minutes of the meeting are published in the Journal officiel de la République du Niger . There are two regular meeting periods each year, beginning in March - for a maximum of 90 days - and in October - for a maximum of 60 days. Extraordinary meetings can be held at the request of the President of the National Assembly, the President or the Prime Minister. They are opened and closed by the President of the Republic by decree . Once a year, the Nigerien Human Rights Commission presents its human rights report to parliament.
The National Assembly votes on laws, taxes and the budget. The Nigerien government is responsible to the National Assembly. At the request of Parliament, the Court of Auditors must provide information on public income and expenditure. At the request of a tenth of the members of the parliament, the Constitutional Court must rule on the constitutionality of decisions.
The parliamentary immunity of the deputies can only be lifted by the National Assembly itself. If a member of parliament leaves the party for which he was elected to parliament, he loses his mandate, which is now exercised by a substitute. If, on the other hand, an MP is excluded from his party, he or she retains his seat as an independent MP and is not allowed to join any other parliamentary group during the current legislative period.
If the majority of the President and the parliamentary majority do not agree, the Prime Minister is selected by the President from a list of three personalities drawn up by the National Assembly. After taking office, the Prime Minister will give a speech on the direction of his policy before Parliament. If the National Assembly approves a motion of censure or refuses to approve the government program or any other text put to the vote, the Prime Minister must submit the resignation of the government to the President. The National Assembly elects from among its members four of the seven members of the Supreme Court , before which the President and members of the government can be tried. An indictment of the president requires a two-thirds majority, an indictment of a member of the government an absolute majority of the MPs. Constitutional amendments require the initiative of both the President and three-quarters of the MPs and can only be implemented by a majority of four-fifths of the MPs or a referendum. Authorization by parliament is also required for sending troops abroad and declaring war . Even the imposition of a state of emergency by the Council of Ministers that exceeds 15 days must be approved by the National Assembly. If the state president abusively declares a state of emergency , the national assembly can declare it ended.
President of the National Assembly
The National Assembly is chaired by the President of the National Assembly (French: Président de l'Assemblée Nationale ). The MPs elect the President for the duration of the legislative period. He is sworn in at the Constitutional Court on the holy book of his denomination. In the event of a crisis of confidence, the President of the National Assembly can be voted out early with a two-thirds majority of the MPs. The President is assisted by the Office of the National Assembly (French: Bureau de l'Assemblée Nationale ), the composition of which reflects the political configuration of Parliament. The office of the National Assembly appoints one of the seven members of the Constitutional Court.
The President of the National Assembly has a number of special powers. He calls the ordinary sessions of Parliament and can also convene extraordinary sessions. He is a member of the Council of the Republic . It selects four of the 92 members of the Economic, Social and Cultural Council, which in turn advises the National Assembly, as well as a representative in the Nigerien Human Rights Commission. He also designates one of the members of the High Council for Communication. At the request of the President of the National Assembly, the Constitutional Court must rule on the constitutionality of decisions. If the President of the Republic dies before the end of his term of office, is declared incapable of office for health reasons, or resigns, the President of the National Assembly takes on the functions of provisional head of state.
