The 2008/09 DFB Cup began on August 7, 2008 and ended with the final in the Berlin Olympic Stadium on May 30, 2009. Werder Bremen won the 66th edition of the competition with a 1-0 win against Bayer 04 Leverkusen . Leverkusen had eliminated defending champions FC Bayern Munich in the quarterfinals . Bremen was able to qualify for the play-off round of the 2009/10 UEFA Europa League by winning the cup , which they would not have reached in tenth in the Bundesliga , and were later eliminated in the round of 16 against Valencia CF due to the away goals rule . As ninth in the Bundesliga, Leverkusen did not take part in any European competition in the 2009/10 season.
In accordance with a resolution of the extraordinary DFB Bundestag in 2006, the second teams from professional clubs were no longer eligible to participate in a departure from earlier regulations.

The 64 teams are placed in two pots for the draw for the 1st round: The amateur pot contains all teams that
- have qualified for the DFB-Pokal through the state cups (24),
- were promoted to the second division in the 2007/08 season (4) or
- were relegated from the second division in the 2007/08 season (4).
Each of these teams is drawn to a team from the professional pool, which includes all teams from the First Bundesliga and those 14 teams from the Second Bundesliga that were not relegated from the Second Bundesliga in the 2007/08 season. The teams of the amateur pot enjoy the home right.
In the 2nd round there will also be a draw from an amateur and a professional pot. Here, however, the teams that have been promoted to the Second Bundesliga are also considered professional teams. Here, too, the amateur teams enjoy home rights. If one of the pots is exhausted, the remaining pot is drawn to the end; the team drawn first in a pairing always receives home rights. From the round of 16 onwards, there will only be a single pot. An amateur team enjoys home rights when they play against a professional team, otherwise the team drawn first in a pairing. The final is traditionally played in Berlin.

The final of the DFB Cup took place on May 30, 2009 in Berlin.
With Werder Bremen , a team won the competition for the first time that had only played away games during the tournament. It was the Hamburger SV in the semifinals in a penalty shootout , the 13th of Bremen in their Cup history, defeated. No team has sought the decision from the point more often.
This final was contested for the first time in 13 years (1995/96) by two teams, neither of which had qualified for an international competition via the league or the European Cup.
