A number of the most important garden architectural monuments in Austria are listed by name in the directory of parks and gardens in accordance with Section 1, Paragraph 12 of the Monument Protection Act (DMSG).
Basics
Legal and organizational matters
Conservation falls according to the Austrian constitution in the jurisdiction of the Federal ; however, the states are responsible for nature conservation . The Federal Monuments Office , founded in 1923 , initially looked after both architectural monuments and natural monuments , the latter became part of national competence in the Second Republic.
In 1964 the Constitutional Court tried to clarify the competence between the federal government and the federal states to draw a clear dividing line between culture and monument protection matters on the one hand and products of nature on the other. He drew on a legal text from 1918, which dealt with export bans on cultural property, in order to use the term “monument” defined in the constitution as a federal matter exclusively for objects “of historical, artistic or cultural significance”, and drew from it the conclusion, "Fields, avenues and parks and other such manifestations of the designed nature are not monuments." In the 1970s, the competence of nature conservation - as far as the federal government is concerned - was transferred to the Federal Environment Agency . In connection with gardens and parks, the Federal Monuments Office was only able to protect the monuments made exclusively by man (such as stairs, figures), but no longer the designed nature itself. Nevertheless, in 1986 the Federal Monuments Office founded a department for garden architecture in order to support the owners of historical gardens and parks, at least through specialist advice, in shaping nature and restoring the historical condition.
Under Géza Hajós , the long-standing head of the garden architecture department at the Federal Monuments Office, it was possible to develop the historical garden design as a cultural asset relevant to the protection of historical monuments . An inventory of Austria's historic gardens, completed in 2004, recorded around 1,700 sites, of which the Federal Monuments Office estimated around 1,000 to be worthy of protection. With the amendment of the Monument Protection Act of 1999, a small selection of historical parks and gardens was anchored as explicitly worthy of protection and assigned to the competence of the Federal Monuments Office through a provision with constitutional status:
" Parks and gardens are also with regard to those parts that consist of designed nature, monuments and thus matters of monument protection ."
For this purpose, a list of 56 gardens and parks by name was published in Annex 2 of the Act, which are ex lege matters of monument protection; this list also has constitutional status. This selection was agreed in advance in talks with the federal states. The protection authority of these gardens was thus transferred from the federal states to the federal government (federal matter within the meaning of Art. 10 para. 1 no. 13 B-VG ). The list annexed to the Act did not cause already listed for these plants, but only created the legal requirement that the Federal Monuments Office in individual cases after examination and approval of the owner by decision might explain monument (also) for the designed nature. The fact that - in contrast to architectural monuments - the consent of any private owners is required for the scope of the protected status makes it more difficult. 32 of the gardens mentioned in the list were publicly owned at the time of the amendment to the law, and 24 were privately owned. Since then, real protection has been possible mainly for publicly owned facilities, as well as for some privately operated show castles and church property.
The garden architecture department responsible at the Federal Monuments Office was - after Hajós retired - merged in the 2010s in the central department for special materials (with the agendas of sound monuments and technical monuments ).
For the protection of gardens
Garden architecture per se is based on a nature of change that goes beyond the classic preservation of historical monuments and their focus on preserving the original substance and comes closer to a modern model of a living cultural asset. The protected goods are fixed aspects of the open spaces such as the conception of the facility and landscape design ( floor plans , terracing , etc.), but also changeable ones , such as the compositions of the vegetation (also in interaction with the functional buildings for example in castle gardens, with the most solid garden inventory, with water and similar environmental factors) or functional aspects ( ornamental, splendid and pleasure gardens , kitchen and breeding gardens , zoo and hunting gardens, etc.), which must be temporally adapted to the circumstances. The protection of parks and gardens "with regard to their designed nature" requires an expert concept drawn up on a scientific basis that "must enable a plan and descriptive clarification of the type and scope of the protection and both the actual condition and the target condition of the park- or gardens ”( Section 3 (5 ) DMSG ), i.e. a maintenance management plan, similar to that for nature conservation areas . As in the preservation of historical monuments, one has to weigh between preservation of the historically grown appearance and a careful restoration of an earlier planning state. Therefore there are gardens that are structurally and increasingly also when stocked with old varieties are kept strictly in a state (e.g. from the Baroque era) ( restorative garden maintenance), as well as those in which only legible traces of the old conceptions are preserved ( conservational garden maintenance). Naturally, formal gardens ( Italian and French gardens ) require a different treatment than landscape gardens (English gardens) .
The demarcation to landscape protection and the protection of used natural ecosystems, i.e. nature conservation matters, is formulated in such a way that monument protection "has to be limited to the extent of the parks and gardens that are associated with an immovable object that is officially listed as a historical monument particularly artistically or historically as well as spatially connected. “(§ 3 Abs. 5 DMSG). Some gardens were designated as natural monuments earlier, some are fully or partially included in one of the nature conservation classes. Some of the gardens are also an essential part of the UNESCO World Heritage in Austria.
