In Styria , there are 36 landscape conservation areas , which due to the Styrian Nature Conservation Act are identified and the corresponding individual regulations.
Intention and legal basis
Landscape protection areas are “areas that
- a) have particular scenic beauties or peculiarities,
- b) in the interaction of the type of use and buildings as a cultural landscape are of rare characteristics or,
- c) have or should receive special importance due to their recreational value. "
- Section 6 (1) Styrian Nature Conservation Act 1976
The landscape protection area is a general nature protection category that primarily protects the overall landscape appearance.
In accordance with the principle of § 2 protection of nature and landscape , "in all projects that are expected to have a lasting impact on nature and landscape [...] to avoid changes that damage nature, deface the landscape or disrupt the enjoyment of nature
- a) on maintaining the ecological balance of nature,
- b) to take into account the preservation and design of the landscape in its character ( landscape character ) as well as in its recreational effect ( welfare function ) and
- c) to take precautions for the repair of any damage. "
In addition, according to Section 6 (1), the district administrative authority ( state government , if it is also a European protected area) requires a permit for:
- a) Soil extraction (quarries, clay, sand, gravel and peat extraction systems, removal of deposits, etc.) or expansion of existing extraction sites;
- b) Construction of apartment houses and holiday villages in accordance with the regional planning regulations as well as buildings with a total height of over 18 m ;
- c) Construction of certain buildings and systems outside of a closed built-up area without corresponding development plans or development guidelines on the basis of regional planning regulations;
- d) Use of areas as sports and practice areas or shooting ranges ;
- e) major earth movements
- f) Setting up tent camps or setting up caravans for more than one night outside of homesteads, localities or places approved for this purpose (except e.g. during construction work).
The concept of landscape protection areas in Styria was based on the Reich Nature Conservation Act , most recently in a version from 1956. At that time, the unspecific category comprised a large number of functions, including in particular the “preservation of the Styrian house landscape types ”. With the creation of the state development program and modern, management- oriented nature conservation (according to the IUCN ), the category was subjected to a revision at the end of the 2000s. For this purpose, the “actual protection purpose” of the individual areas was formulated more precisely and legally anchored. The Administrative Court had previously objected to this lack in a decision. There were some fine and new delimitations. In addition, some areas were deleted from the directory that represented an "incomprehensible" "arbitrary peeling of individual parts of the landscape, the characteristics of which apply in the same way to the entire large landscape". These areas were also adequately covered by other protective measures ( regional planning law , forestry law , various other ex lege protection ). Changes also arise with regard to Natura 2000 areas (European protected areas according to § 13a NschG 1976), which meanwhile also represent a category under state law (so that in some cases only one designation category would be necessary), and plans, the successful modern class of biosphere reserves also in the To set up Styria.
