The law on the reorganization of the municipalities and districts of the new structure of the Ruhr area (Ruhr Area Law) of July 9, 1974 includes the territorial reform in the Ruhr area at the municipal level. Due to a court decision, however, parts of the law had to be changed retrospectively; this was done through the law amending the Ruhr Area Act of June 1, 1976.

With the passing of the Ruhr Area Law, the city ​​association model proposed by the North Rhine-Westphalian Interior Minister Willi Weyer as an alternative to the city and district model (incorporation model ) was ultimately rejected.

Brief description

Section I: Territorial changes in the area of ​​the municipalities

§ 1 District-free city of Duisburg

The city of Duisburg and the cities of Homberg , Rheinhausen and Walsum (without Eppinghoven obtained by the Niederrhein-law to Dinslaken was incorporated) are combined to form a new independent city Duisburg. In addition, there is the municipality of Rumeln-Kaldenhausen , the Baerl district of the municipality of Rheinkamp and the areas of Moers, Budberg and Dinslaken. Some areas of the city of Rheinhausen and the communities of Kapellen and Rumeln-Kaldenhausen are incorporated into Krefeld on this occasion .

The Düsseldorf law adds areas of the city of Angermund and the municipality of Wittlaer to the city of Duisburg.

The expansion of the city of Duisburg turned out to be far weaker than was actually planned. The towns and communities of Moers , Kamp-Lintfort , Rheinberg , Neukirchen-Vluyn and Kapellen were able to successfully defend themselves against complete incorporation.

§ 2 City of Moers

The city of Moers is merged with the municipalities of Rheinkamp and chapels and properties of the municipality of Budberg to form a new city of Moers and thus retains its political independence. Some areas of the municipality of Rheinkamp will be reclassified to Neukirchen-Vluyn .

§ 3 District-free city of Bochum

One of the most controversial points of the law: The independent cities of Bochum and Wattenscheid are merged to form a new independent city of Bochum.

§ 4 District-free city of Herne

The independent cities of Herne and Wanne-Eickel merge to form the new independent city of Herne. The legislature is thus implementing a resolution by the Wanne-Eickel city council to prevent integration in Bochum.

§ 5 District-free city of Bottrop / city of Gladbeck

According to the original law, the independent cities of Bottrop and Gladbeck and the municipality of Kirchhellen of the Recklinghausen district were to be merged into a new independent city of Bottrop. However, this merger, mockingly called Glabotki , was declared null and void on December 6, 1975, so that the three communities continued to exist within their old borders for the time being. Bottrop and Kirchhellen later merge to form the new city of Bottrop, Gladbeck remains independent.

§ 6 District-Free City of Essen / District-Free City of Mülheim

The city of Kettwig , which previously belonged to the Düsseldorf-Mettmann district, is largely incorporated into the city of Essen . The village of Mintard was previously part of Kettwig and Mülheim an der Ruhr . With this law it is fully assigned to the city of Mülheim.

Due to the Düsseldorf law, some areas of the Breitscheid community are added to the Mülheim urban area.

§ 7 District-free city of Dortmund

The independent city of Dortmund will only be enlarged slightly, namely by those parts of the communities of Holzen , Lichtendorf and Westhofen, which are located northwest of the federal motorway 1 .

§ 8 City of Castrop-Rauxel

The municipality of Henrichenburg of the Waltrop office is incorporated into Castrop-Rauxel .

§ 9 City of Dorsten / District-Free City of Gelsenkirchen

The municipalities of Rhade , Wulfen and Lembeck of the Hervest-Dorsten office and the municipality of Altendorf-Ulfkotte of the Marl office and areas of the municipalities of Altschermbeck , Kirchhellen, Lippramsdorf and Gahlen ( Dinslaken district ) are incorporated into the town of Dorsten . She is the legal successor to the office of Hervest-Dorsten . A small area of ​​the Altendorf-Ulfkotte community is incorporated into the city of Gelsenkirchen . This is the area of the Polsum substation .

The other areas of the municipalities of Altschermbeck and Gahlen are incorporated into the municipality of Schermbeck by the Lower Rhine Act .

§ 10 City of Marl

The municipalities of Hamm and Polsum as well as land belonging to the municipality of Lippramsdorf are incorporated into the city of Marl . She is the legal successor to the Marl office .

§ 11 City of Haltern

A new city of Haltern (since 2001: Haltern am See ) is formed from the city of Haltern, the parishes of the parish of Haltern , Hullern and Lippramsdorf . This also receives the municipality of Flaesheim , which was previously co-administered by Datteln , the hamlet of Hamm-Bossendorf of the municipality of Hamm (Amt Marl) and corridors of the municipality of Kirchspiel Dülmen , the remaining area of ​​which is provided by the Münster / Hamm Act (together with an area of ​​the municipality of Kirchspiel Haltern ) is incorporated into Dülmen . The Haltern office will be handled by the new city.

§ 12 City of Herten

The city of Westerholt and the district of Bertlich in the municipality of Polsum become districts of Herten .

§ 13 City of Datteln / City of Waltrop

The city of Datteln is expanded to include the municipality of Ahsen, which was co-administered up to that point, and the municipality of Horneburg of the Waltrop office. The city of Waltrop is the legal successor to the Waltrop office , but remains unchanged.

§ 14 City of Lünen

The Altlünen community becomes a district of Lünen .

Section 15 Selm municipality

The new municipality of Selm is formed from Bork and Selm and has had city rights since 1977.

Section 16 City of Werne ad Lippe

Stockum becomes a district of the city of Werne ad Lippe, which has been called Werne since 1976 .

§ 17 City of Schwerte

The town of Schwerte is merged with the town of Westhofen and the municipalities of Geisecke , Villigst and Wandhofen of the Westhofen office and the Ergste municipality of the Ergste office to form a new town of Schwerte. In addition to this new municipality in the area of ​​the previous district of Iserlohn, there are also the areas of the municipalities of Holzen and Lichtendorf, which are located south of Federal Motorway 1. The new town of Schwerte is the legal successor to the offices of Ergste and Westhofen .

Section 19 Unna district

A new Unna district is formed from the communities of Lünen , Unna , Fröndenberg , Bergkamen , Kamen , Schwerte , Werne ad Lippe , Bönen , Holzwickede and Selm . The seat is the eponymous city of Unna, although Lünen has the most inhabitants. The new district is the legal successor to the old Unna district .

Section 20 Recklinghausen district

The cities of Recklinghausen and Castrop-Rauxel , later also Gladbeck , lose their district freedom and are incorporated into the Recklinghausen district.

Section 21 Ennepe-Ruhr-Kreis

The city of Witten becomes a municipality in the Ennepe-Ruhr district . Although it is now the largest municipality in the district, the district seat remains in Schwelm .

III. Section: Court Organization

Section 22 District Courts in Duisburg

In Duisburg, the district court districts are newly delimited:

The old court allocation continues for the time being for the incorporated districts.

Section 23 Bochum District Court

The area of ​​the Bochum District Court is expanded to include the new Bochum urban area. The district courts of Bochum-Langendreer and Wattenscheid existed until December 31, 1977.

Section 24 Herne District Court

The district court of Herne covers the area of ​​the former city of Herne, the district court of Herne-Wanne that of the former city of Wanne-Eickel.

Section 25 Local courts in Bottrop

The District Court Bottrop comprises from 1 January 1978 to the area of Bottrop and Kirchhellen. The latter still belongs to the Dorsten District Court for a transitional period . The district court Bottrop-Gladbeck , on the other hand, covers the old urban area of ​​Gladbeck. This paragraph had to be rewritten after the city of Bottrop was dissolved in 1976, but the geographical area of ​​the local courts did not change.

In addition, the Gelsenkirchen-Buer district court is being expanded to include the newly acquired area of ​​the Altendorf-Ulfkotte community. The district court of Gelsenkirchen-Buer was repealed on January 1, 2016 and was incorporated into the district court of Gelsenkirchen . The district court of Haltern has now been repealed and the town of Haltern am See has been assigned to the district court of Marl .

Section 27 Renaming of Local Courts

This paragraph confirms the renaming of the district courts of Mülheim (Ruhr), Wanne-Eickel and Gladbeck to Mülheim ad Ruhr , Herne-Wanne and Bottrop-Gladbeck . The latter renaming will also be reversed by the restoration of the city of Gladbeck.

Section 28 Gelsenkirchen Administrative Court

The administrative court of Gelsenkirchen includes the independent cities of Bochum, Bottrop, Dortmund, Essen, Gelsenkirchen, Herne and the districts of Recklinghausen and Unna.

IV. Section: Final provisions

Section 29 Independent cities

With this, provisions are made for the circled towns of Castrop-Rauxel, Lünen, Recklinghausen, Witten and later also Gladbeck, for example the continuation and establishment of vocational schools, which is incumbent on the district.

§ 30 City Directors / Lord Mayor

The senior city directors and mayors of the former, but still independent urban districts, may continue their titles until the end of their term of office.

§ 31 Territorial Change Agreements

The territorial change agreements are confirmed with various provisions.

§ 32 Entry into force

This law comes into force on January 1, 1975
