The law for the reorganization of the municipalities and districts of the reorganization area Sauerland / Paderborn (Sauerland / Paderborn law) of November 5, 1974 was the ninth and last law of the second reorganization program of the regional reform in North Rhine-Westphalia . It regulated the municipal reorganization of the area of ​​the city of Hagen and today's districts Ennepe-Ruhr-Kreis , Hochsauerlandkreis , Höxter , Märkischer Kreis , Olpe , Paderborn and Siegen-Wittgenstein . However, the Ennepe-Ruhr-Kreis and Olpe districts, which were reorganized in 1969, were hardly touched. The law came into force on January 1, 1975.

I. section. Territorial changes in the area of ​​the municipalities

§ 1 City of Hagen

The city of Hohenlimburg and the municipalities of Berchum (Ergste) and Garenfeld (Westhofen), all from the Iserlohn district, were incorporated into the independent city of Hagen . This was expanded to include parts of the Waldbauer community, the Dahl district of the city of Breckerfeld and the parts of the Haspertalsperre that belong to the city of Ennepetal, as well as smaller areas of Dortmund (Syburg) and Nachrodt-Wiblingwerde (Lahmer Hase) .

The rest of the community Waldbauer was incorporated into the city of Breckerfeld .

The city of Dortmund received some plots of land from the municipality of Garenfeld and the city of Westhofen and in turn gave a smaller uninhabited area to the new city of Schwerte .

§ 2 City of Iserlohn

The previously independent city of Iserlohn and the city of Letmathe from the Iserlohn district and the municipalities of Hennen (Amt Ergste), Kesbern (Amt Hemer) and Sümmern (Amt Menden) were merged to form the new city of Iserlohn . This was supplemented by parts of the city of Hemer ( Bilveringsen , Griesenbrauck and Westig ) and some properties belonging to the Ihmert municipality.

§ 3 City of Hemer

Five municipalities of the Hemer office , namely the town of Hemer and the municipalities of Becke , Deilinghofen , Frönsberg and Ihmert , were merged to form the new town of Hemer . This was supplemented by parts of the Garbeck community and some properties from the Kesbern community. The office of Hemer was dissolved; its legal successor is the new town of Hemer.

§ 4 City of Menden (Sauerland)

The municipalities of Bösperde , Halingen , Lendringsen , Oesbern and Schwitten, as well as Asbeck (Balve, Arnsberg district ) , which are part of the Menden (Sauerland) municipalities , were merged to form a new city of Menden (Sauerland) , into which the district Ostsümmern of the municipality of Sümmern and two pieces of land belonging to the municipality of Holzen (Hüsten district, Arnsberg district) were incorporated.

The dissolution of the Menden office and arrangement of legal succession by the city of Menden (Sauerland), which is still envisaged in the draft law, was - apparently inadvertently - deleted from the recommendation of the state parliament committee for the second reading of the draft law.

§ 5 City of Arnsberg

The non-official cities of Arnsberg and Neheim-Hüsten , four municipalities of the Freienohl office - Breitenbruch , Oeventrop (Sauerland) , Rumbeck and Uentrop - as well as eight municipalities of the Hüsten office - Bachum , Bruchhausen (Ruhr) , Herdringen , Holzen , Müschede , Niedereimer , Voßwinkel and Wennigloh - were merged to form the new town of Arnsberg . To round off the border, parts of the city of Wickede (Ruhr) and the municipality of Freienohl (Sauerland) were incorporated into these. § 6 City of Sundern (Sauerland)

The municipalities of the Sundern Office (Sauerland) - Allendorf (Sauerland) , Amecke (Sorpesee) , Endorf , Hagen (Sundern Office) , Stockum , Sundern (Sauerland) , Westenfeld and Wildewiese - five municipalities of the Freienohl Office - Altenhellefeld , Hellefeld , Herblinghausen , Linnepe and Meinkenbracht - and the six southern municipalities of the Hüsten Office - Enkhausen , Estinghausen , Hachen , Hövel , Langscheid (Sorpesee) and Stemel - were merged to form a new town of Sundern (Sauerland) . Section 11 Eslohe community (Sauerland)

§ 18 City of Bad Berleburg

Section 20 Erndtebrück municipality

§ 23 City of Delbrück

Section 36 Hochsauerlandkreis

Section 39 Paderborn district

The districts of Warburg and Höxter were dissolved. A new district of Höxter was formed from ten cities and municipalities , the legal successor of the two dissolved districts.

III. Section. Court organization

Section 41 Ordinary jurisdiction

The newly formed communities were assigned to the district courts of Arnsberg , Bad Berleburg , Brilon , Delbrück , Iserlohn , Marsberg , Medebach , Menden (Sauerland) , Meschede , Paderborn , Schmallenberg , Siegen and Warburg . The Neheim-Hüsten district court was repealed on January 1, 1975, the Salzkotten district court on July 1, 1975 and the Burbach and Hilchenbach district courts on July 1, 1976.

IV. Section. Final provisions

Section 43 Special regulations for Iserlohn and Siegen

The cities of Iserlohn and Siegen, which lost their district freedom (Iserlohn) or had already lost them (Siegen), were temporarily given a special status until the functional reform, through which large parts of the tasks of an independent city were assigned to them.

Section 44 Official title of Mayor and City Director

Legislative process

On May 22, 1974, the state government introduced a bill to reorganize the municipalities and districts of the Sauerland / Paderborn area into the state parliament, which it amended on August 30, 1974, as announced, to include provisions on the organization of courts and the territorial change agreements. The draft law essentially differed from the law passed later in that, according to the state government's ideas, the Olpe district should also be included in the merger of the Siegen and Wittgenstein districts. Furthermore, instead of the current districts of Höxter and Paderborn, only a large district of Paderborn was planned. For the area of ​​what is now the city of Iserlohn, the draft law provided for two independent cities, Iserlohn and Letmathe. Finally, the reclassification of the entire Hasperbach valley from Ennepetal to the city of Hagen was planned. The state parliament discussed the draft law on June 12, 1974 in the first reading and, after a brief debate, referred it to the committee responsible for administrative reform. For the second reading, the committee largely recommended that the state parliament accept the draft. The later decided changes compared to the original draft law are based on this opinion of the state parliament committee. The committee rejected the proposals of the SPD to incorporate the community of Breckerfeld to Hagen, the city of Hemer to Iserlohn and the city of Freudenberg to Siegen and to include the city of Schmallenberg in the Olpe district, as well as the proposals of the CDU to merge Bad Lippspringe and Schlangen to incorporate the city of Plettenberg into the Olpe district.

The state parliament adopted this recommendation for a resolution on September 25, 1974 and referred the proposal back to the committee. All amendments were rejected or withdrawn at this second reading. The applications were rejected
