Joachim Herrmann

Joachim Herrmann (* 21st September 1956 in Munich ) is a German politician of the CSU . He has been Bavarian State Minister of the Interior since October 16, 2007 , and has also been responsible for integration since 2018.

Herrmann has been a member of the Bavarian State Parliament since 1994 . As State Secretary in the State Ministry for Labor and Social Affairs, Family, Women and Health , he was a member of the Bavarian State Government for the first time from October 1998 to September 1999 and then acted as chairman of the CSU parliamentary group in the state parliament from 2003 to October 2007. From 2007 to 2018, during his time as Minister of the Interior, he was also responsible for construction and transport.

Life

Studies, military service and work

Joachim Herrmann was born as the son of the lawyer Johannes Herrmann (1918–1987) and Adele Herrmann born in Amberg . Koch (1924–2017) born. From 1959 he grew up in Erlangen , where his father became a full professor of legal history and civil law. His mother was, among others, school teacher at Munich Luisen-Gymnasium .

He attended the Losch School and the Fridericianum Gymnasium . After graduating from high school in 1975, he completed his military service in Mellrichstadt with the 352 Panzer Grenadier Battalion and in Hammelburg . In this context, he also completed the officer training course at the infantry school in Hammelburg. He then became a cadet and by dismissing the ensign of the Reserve transported. In the following years Herrmann performed several military exercises , including the reserve officer course as the best course. Since 1985 he was captain of the reserve, in November 2014 he was promoted to lieutenant colonel d. R. promoted.

Following his military service, he studied from 1976 at the Universities of Erlangen and Munich law .

After his second state examination in law , he joined the Bavarian State Chancellery as a member of the government in 1984 , where he worked in the department for economics and transport. In 1988 he moved to the Erlangen-Höchstadt district office as a senior government councilor , where he became head of the department for public security and order . In 1992, he settled as a lawyer down and served as General Counsel of Siemens operates AG.

During his studies he was involved in the RCDS and the Junge Union (JU). In 1977/78 he was chairman of the RCDS Erlangen and from 1979 to 1980 he was regional chairman of the RCDS in Bavaria. From 1983 to 1991 he was a member of the JU federal executive committee and served during this time from 1987 to 1991 as deputy JU federal chairman.

After his defeat in 1990 when he was elected Lord Mayor of Erlangen, he was elected to the Bavarian State Parliament in 1994; although he has been in politics for a long time, he is counted among the 94 group. In 1998/99 he was State Secretary in the Bavarian Ministry of Labor. From 2003 to October 2007 he was chairman of the CSU parliamentary group in the Bavarian state parliament . He represents the district of Erlangen-Stadt ( Middle Franconia ) in the state parliament.

In October 2007, he succeeded Günther Beckstein, who was elected Prime Minister, as Bavarian Minister of the Interior. The previous Secretary of State Georg Schmid was elected as his successor as CSU parliamentary group leader . Herrmann retained the office of State Minister of the Interior in the Seehofer I , Seehofer II , Söder I and Söder II cabinets , so that, after his predecessor Beckstein (in office from 1993 to 2007), he was the second longest term of office of Bavarian Interior Minister since Maximilian von Feilitzsch (1881 in office until 1907).

In October 2008 Herrmann withdrew his candidacy for the office of Bavarian Prime Minister and thus ended an internal CSU dispute in favor of Horst Seehofer . He had previously been traded as one of four possible candidates.

Hermann's administration is generally considered to be prudent. Even in crisis situations such as the attack in Munich in 2016 , the bomb attack in Ansbach or the attack on a regional train near Würzburg, he acted carefully and avoided excited tones.

Herrmann was the CSU's top candidate for the 2017 federal election . Since he only ran on the state list and not as a direct candidate and his party achieved more direct mandates than it would have been entitled to if pure proportional representation had been applied, Herrmann failed to make it into the Bundestag.

On March 21, 2018, under the new Prime Minister Markus Söder , the State Ministry of the Interior was rebuilt. Since then, Hermann is no longer responsible for construction and transport, as these departments have been expanded into an independent State Ministry for Housing, Construction and Transport , which was headed by Ilse Aigner from March 2018 to November 2018 . Instead, Hermann was given the additional integration department, which was previously part of the Ministry of Labor and Social Affairs .

Other engagement

During his studies in Erlangen in 1980 he became a member of the Catholic student association KDStV Frankonia (Czernowitz) in the CV . In 2010 he became an honorary member of the KAV Capitolina Rome .

From November 2007 to October 22, 2013, Herrmann was the representative of the Bavarian State Parliament in the Broadcasting Council of the Bavarian Broadcasting Corporation and sits on the administrative advisory board of the Bavarian State Bank ( BayernLB ). He is also a member of the supervisory board of the handball club HC Erlangen and the supervisory board of the Romanian-German University of Sibiu . He is on the Board of Trustees of the Lichtblick Hasenbergl Foundation .

Private life

Herrmann is Roman Catholic. In 1983 Herrmann married Gerswid Terheyden from Bremerhaven , whom he met in 1976 as a fellow student on the same course. They have a daughter (* 1986) and two sons (* 1988 and * 1992).

Demonstration and police law

Herrmann became known beyond Bavaria for the new Bavarian Assembly Act that was drawn up under his responsibility. Bavaria is the first federal state to have passed its own assembly law as part of the federalism reform. The law is controversial because it generally tightens the legal framework for demonstrations. While Herrmann repeatedly stated that the law was directed primarily against “right-wing or left-wing radical chaots”, the project was heavily criticized from various sides. Federal Justice Minister Sabine Leutheusser-Schnarrenberger (FDP) stated in this context: "This law exudes the spirit of authoritarian thinking [...] one wants to intimidate citizens in the run-up to meetings."

After the massive protests against the Castor transport to Gorleben in November 2010, Herrmann supported the Lower Saxony Minister of Justice Bernd Busemann ( CDU ) in his demand to ask the demonstrators to pay for the police operation. According to Herrmann, the existing instruments, from fines to the possibility of sanctioning the right of assembly, were obviously not sufficient to provide a deterrent. “Those who demonstrate peacefully must have nothing to fear. But it cannot be that the use of force and breach of law are legitimized, as it were, because the act is not followed by a penalty or noticeable sanction, ”Herrmann told the FAZ . One must also consider "whether we can leave such demonstrators largely unmolested in the long term if they, as criminals, undercut railroad tracks or simply commit an administrative offense with their sit-ins," said Herrmann. “Illegal remains illegal. This will not change anything if the opposition parties in the Bundestag call for it, ”he added. He also wanted to work at the Conference of Interior Ministers for a solution on how the demonstrators could be made more responsible for the costs of the operation. The Greens chairwoman Claudia Roth then criticized the criminalization of the demonstrators: "Demonstrations are the staple food of democracy."

Herrmann defended Police President Wilhelm Schmidbauer , who came under criticism in February 2013, in the affair of assault by a police officer. He suspected that the victim had psychological problems, which led to criticism from the opposition in the Bavarian state parliament . A few months later, the Munich District Court stopped the proceedings against the victim for resisting enforcement officers, assaulting and suspected violating the Narcotics Act, whereas the police officer in question was sentenced to a suspended sentence of ten months for bodily harm in office.

Telecommunications and New Media

Online search

While Herrmann in the office of the CSU parliamentary group chairman had spoken out against excessive surveillance measures, he changed his position as Minister of the Interior fundamentally. Among other things, he expressly advocated that the Bavarian investigators, compared to their colleagues in other federal states, should have more powers. In addition to the online search , he strongly advocated the possibility of legally entering the homes of terrorist suspects in order to install programs to search their computers. From Hermann's point of view, this is necessary to prevent serious crimes.

In 2011, the Chaos Computer Club (CCC) analyzed leaked binary files from a state monitoring program and found that the state malware would violate the requirements of the Federal Constitutional Court . Herrmann confirmed that the software came from Bavaria and was used there by the State Criminal Police Office , but emphasized that it complied with the constitutional requirements. He declined to work with the CCC, referring to its self-image, as well as with the Pirate Party Germany , referring to their relationship to product piracy on the Internet.

Data retention

Herrmann is a firm believer in data retention . He took the attacks in Norway in July 2011 as an opportunity to re-introduce them and to call for more stringent monitoring of the Internet by security authorities. He stated, among other things:
"... Global surveillance and espionage affair

After the American surveillance program PRISM became known in mid-2013, Herrmann expressed himself ambivalent. In general, Herrmann regularly mentioned the need for electronic intelligence to combat terrorism. He explained that the American approach was “not our understanding”, because there is a difference between targeted and indiscriminate surveillance. In his opinion, the American services "apparently went too far" with their surveillance program. He demanded that the Americans disclose as quickly as possible how much data was actually collected. Regarding the statements of a CSU colleague, the European politician Markus Ferber , who had spoken of American "Stasi methods", he said that of course he did not make this statement his own. He pointed out that the USA used to be considered the "optimum of freedom rights" - but now we have to see it a little differently. With regard to Ferber's Stasi comparison and Leutheusser-Schnarrenberger's position of “memory madness”, he explained elsewhere: “These insults from our American partners are not acceptable. This is not how you treat friends who are our most important partners in the fight against terrorism. Everyone who really has responsibility for the security of citizens in Germany and Europe knows that it is the US secret services that have repeatedly given us important and correct information. You have thereby helped to prevent several attacks in the preparatory phase and to save human lives. ”After it became known that the US secret service NSA had tapped Chancellor Angela Merkel's mobile phone , Herrmann announced the purchase of crypto cell phones for the members the Bavarian State Government .

Violent computer games

Herrmann has repeatedly criticized so-called " killer games ". In 2009, Herrmann spoke in an official communication of “killing training software” and called for an “outlaw” of these games, which, in his view, “were on a par with drugs and child pornography in terms of their harmful effects , “whose ban is rightly not questioned “ Place. In mid-2009 there was a fundamental dispute within the CSU between Herrmann and the Bavarian Minister of Social Affairs Christine Haderthauer . This had suggested, after years of tightening the procedure , easing the living conditions for asylum seekers . Herrmann did not take up Haderthauer's initiative. Herrmann himself rejected Haderthauer's assertion and described its presentation as "fundamentally wrong". Both take different positions on the Asylum Implementation Ordinance. Herrmann fundamentally rejects the deletion of the wording, called for by Haderthauer, that the accommodation of those affected should "encourage their willingness to return to their home country". In December 2011, the organization Young People Without Borders named Herrmann “Deportation Minister of the Year”. The reason given was that the minister had recently increasingly wanted to deport refugees to Iraq. In addition, Bavaria has the most extensive camp system with 148 refugee camps, in which 7,636 people are housed. The accommodation is intentionally poor in order to encourage the refugees to return to their homeland. Herrmann was also awarded the negative prize in 2013; this time it was about already completed and planned deportations to Afghanistan . According to the Bavarian Refugee Council , 2,000 Afghans live in Bavaria in constant fear of being deported. Herrmann described the allegations as baseless and explained that in the previous three years a total of only twelve men, half of whom were criminals, had been deported from Bavaria to Afghanistan.

In February 2014, Herrmann, with reference to a “recognition rate close to zero”, demanded that asylum seekers from countries in the Western Balkans be cut and that the countries be classified as safe countries of origin in order to process asylum applications more quickly. According to Herrmann, there is no daily bloodshed in the region. On August 27, 2015, Herrmann stated on Maybrit Illner's talk show that comparing displaced persons with refugees was an “insult to the displaced persons”. On August 31, 2015, he commented on Hart but fairly in connection with the refugee debate on the disparaging use of the term “ negro ”, pointing out that the Afro-German pop star Roberto Blanco was a “wonderful negro”. Herrmann wanted to take an ironic stand against racism. Herrmann even had to accept the alleged "racist sentiment" and personal hostility in this context. Blanco himself, on the other hand, stated that he knew that Hermann had not meant the word that way, and expressly thanked him for the attribution as "wonderful".

After the terrorist attacks on November 13, 2015 in Paris , Herrmann emphasized that the issues of refugees and the fight against terrorism should not be lumped together. Like party leader Seehofer, he opposed previous statements by Finance Minister Markus Söder .

In August 2019, he called for return centers to be set up in North Africa to stop the distress at sea and illegal migration. The real problem with the current construction is "that everyone who is saved from drowning is brought to Europe".

Beginning of April 2006 was beaming the channel MTV a commercial for the controversial cartoon - television series Popetown out. The letter said that the Christian faith was "insulted". The suffering, death and resurrection of Jesus Christ are "for the vast majority of Christians in the center of their faith". The MTV commercial therefore "exposes the Christian faith to ridicule in a particularly disparaging manner". Herrmann also announced: "If the public prosecutor's office does not pursue this, then the need for legislative action is obvious." He also demanded that religious content and symbols should be protected more criminally than before.

In April 2010 Herrmann proposed a ban on veiling in the public service.

Transport policy

Herrmann fell over with an excavator during a photo session in 2012 when he tried to dig the symbolic first excavator shovel for a road project in Kempten .

In 2013 Herrmann advocated abolishing the motor vehicle tax in mid-2014 and replacing it with a car toll vignette, which, unlike the motor vehicle tax, would also be paid by foreign car drivers on German motorways.

Identification service treatment of minors

2017 Herrmann has put an item on the agenda of the Conference of Interior Ministers that in the future 6- to 14-year-old children for the purpose of counter-terrorism and fingerprints may be captured.

Nonsmoker protection

In January 2008 the Bavarian Non-Smoking Protection Act came into force. In March 2008 Herrmann declared that the Oktoberfest in autumn 2008 would not come under the regulation. After losing the absolute majority of the CSU in the state elections in Bavaria in 2008 , Herrmann declared: “It is clear that we made mistakes with the smoking ban. [...] That has to be corrected.
