  • The Autostrada A2 ( Polish for "A2 motorway"), also called Autostrada Wolności (Polish for "Freeway of Freedom"), is a largely completed and planned motorway in Poland . The 620 km long route runs along State Road 2 from west to east and represents the most important east-west axis of Polish road traffic . It begins in the west at the German border near Frankfurt (Oder) and leads via Poznan and Łódź to the motorway junction Łódź-Północ , where it crosses the A1 motorway . The A2 then leads to the Polish capital Warsaw , where it is interrupted by the S2 expressway . From Warsaw it will lead via Mińsk Mazowiecki and Siedlce to the Belarusian border, where it will merge with the M1 .

    The A2 is part of the pan-European traffic corridor II and the European route 30 on the entire route. Together with the federal motorway 12 , it has been connecting the two capitals Berlin and Warsaw since June 2012 and is therefore part of an important road connection between Western and Eastern Europe.

    On June 4, 2014, the 25th anniversary of the parliamentary elections in 1989 , the A2 was given the nickname "Autostrada Wolności"; On October 9, 2014, the 25th anniversary of the Monday demonstrations in Leipzig , the German A 12 was given the synonym "Freeway of Freedom".

    Planning history

    In 1939 a west-east connection through Poland was planned, but it was not yet routed via Łódź . In its western section up to the western bank of the Warta near Posen, the route was started in 1939 and partially completed by excavation using mostly Jewish forced laborers who were interned in 30 motorway camps. Individual bridges and culverts were also started. In 1942 construction work was stopped due to the war. In the network plans of 1945 and 1946, a route from the German border to Warsaw was planned. However, the route was then planned to the northeast via Białystok in the direction of Minsk . The motorway was still included in the 1963 network plan, only for the route between Poznan and Łódź there were several variants. The route was also included in the 1971 network plan, but an additional connection was planned between Poznan and Warsaw. In 1976 the network plan included a route from the German border via Poznan and Łódź to Warsaw and a route from Warsaw to the Soviet border. The route in its current form has been included in all network plans since 1985, and in 1993 the route was shown in the plans for the first time as A2. The only point of contention was the Warsaw southern bypass, which was planned as part of the A2 motorway. After several protests by the affected population of Warsaw and Ursynów , the government decided in 2004 to downgrade Warsaw's southern bypass from a motorway to an expressway . In the area around Warsaw, the A2 is therefore interrupted by the S2 expressway .

    Passenger cars

    The first section, about one kilometer long, from the border crossing with Germany to the first motorway junction Świecko is operated by GDDKiA and is free of charge. The following 257 km long section from Świecko to Konin will be realized as a public-private partnership . As a private contractor that was highway operating company Autostrada Wielkopolska obliged to be responsible for the financing, design, construction and operation of this section of the highway. Therefore, toll fees are charged at the toll stations on this section. In the Poznan area , the road is the city's motorway bypass and is therefore free of charge.

    The state authority GDDKiA is responsible for the next section of the motorway from Konin via Stryków and the Łódź  Północ junction to Warsaw . The section from Konin to Stryków is currently subject to toll in a closed system with two toll stations. The further section to Warsaw should also be subject to tolls. In order to avoid the construction of another toll station east of the Łódź Północ junction, the introduction of the toll will only take place after the entire section of the A1 motorway between the Toruń  Południe and Tuszyn junction has been completed . The section of the A1 and the section of the A2 (Konin to Warsaw) should form a closed system. This is to be limited to the west by the Żdżary toll booth near Konin, to the east by the Pruszków toll booth near Warsaw, to the north by the Nowa Wieś toll booth near Toruń on the A1 and to the south by the Jeżów toll booth near Piotrków Trybunalski on the A1. To this end, the no longer required toll station at Stryków is to be dismantled.

    East of Warsaw, the introduction of the toll for the entire section up to the Belarusian border depends on the decision on the implementation model for the section with the exception of the Mińsk Mazowiecki motorway bypass . The Mińsk Mazowiecki motorway bypass, which was implemented as an investment by GDDKiA, is to remain free of charge until it is fully completed. The motorway will only be subject to tolls once the entire route from Warsaw to the border with Belarus has been completed.

    Trucks

    The viaTOLL system is currently used for trucks on most of the motorway sections operated and completed by the GDDKiA . In contrast, the trucks on the sections operated by Autostrada Wielkopolska have to pay the toll manually at the toll stations. Since the toll costs on the sections operated by the concessionaire are very high in the best case with a total of 121 złoty, many trucks switch to the parallel state road 92 . In order to counteract this diversion, tolls were also introduced on July 1, 2011 on the parallel sections of the national road from Nowy Tomyśl to Konin. This is where the viaTOLL system comes into play. Since the section of the state road between the easternmost toll station at Rzepin and Nowy Tomyśl is still toll-free, the trucks to Poznan use the state road for the most part.

    Border crossing D / PL - Świecko

    This 1.1-kilometer section from the Frankfurt (Oder) - Świecko border crossing , which has since been concluded due to Poland's accession to the European Union and the Schengen Agreement , to the first Świecko junction on the Polish side was built between 1994 and 1997. In contrast to the following section Świecko - Nowy Tomyśl , this is operated by the GDDKiA , because when the concession contract was signed with the Autostrada Wielkopolska SA in 1997, due to the regulations at the time, it was only possible for the state to build a motorway section close to the border. In 2011, this section was modernized for 16.8 million zlotys, including a concrete ceiling. Although it has been developed like a motorway with two lanes per lane and otherwise all the parameters of a motorway are met, it remained signposted as Landesstraße 2 after the modernization was completed on September 30, 2011 . In the future, it is planned to relocate the motorway south of the closed border crossing. The planned section should be 700 meters long. As a final measure, the renovation of the Świecko junction is planned, as it does not currently meet the requirements of a junction .

    This 105.9 kilometer section runs from the Świecko junction to the Nowy Tomyśl junction . To 2037 the joint stock company Autostrada Wielkopolska SA is a concessionaire to operate the highway section in charge. Therefore, the section is subject to tolls for all vehicles.

    planning phase

    In 1996 it was decided to localize this section of the A2 in the Lubusz Voivodeship . The concessionaire Autostrada Wielkopolska SA promised in its first statements in 1997 that the section from Świecko to Stryków (approx. 360 km), which was then covered by the concession, would be opened by 2001. In the next notifications it was intended that construction of this section from Świecko to Nowy Tomyśl would begin in March 2005 with an expected completion in 2008. At the end of August 2006, in a discussion between the concessionaire, the GDDKiA and the voivode of the Lubusz Voivodeship, it was decided that the concessionaire should apply for project changes in the already invalid location definition instead of a completely new location definition. The corporation was to receive such commitments for the project changes, develop a report on the environmental impact of the proposed highway (required by new building codes), and keep the funding sources by the end of 2006, making it likely that construction of this section would be in 2007 could begin with a completion in 2009. On July 12, 2006, the Polish Ministry of Transport published a statement in which the completion of the section was expected in 2010.

    Conclusion of contract, construction and handover

    On August 29, 2008, the contract for construction and operation was signed as part of a public-private partnership between the concessionaire, GDDKiA and the Ministry of Transport after all talks had ended. Construction was to start in March 2009 and completion was scheduled for May 20, 2012. On June 29, 2009 the contracts to finance this investment were signed with the subsidiary Autostrada Wielkopolska II SA . The total costs amounted to 1.56 billion euros , of which 1.3 billion euros was accounted for by construction costs. The financing was guaranteed by a total of twelve international banks and was managed by the European Investment Bank (EIB), which on June 30, 2009 granted a loan of 974 million euros (approx. 62.5% of all costs). The other eleven banks granted loans of 394 million euros (approx. 25.5%). In addition, the concessionaire contributed € 186 million to 12% of all total costs. As the main construction company, Strabag was commissioned by the concessionaire to build this section within a consortium. The official start of construction with the groundbreaking ceremony took place on July 16, 2009. The construction work could be accelerated so that an early opening was planned in 2011. On November 30, the official opening ceremony took place with numerous guests of honor from politics and business, including the Polish President Bronisław Komorowski and the Brandenburg Prime Minister Matthias Platzeck . The section was opened to traffic on December 1st. However, since no rest stops with petrol stations and toll stations had been completed and further construction work was taking place outside the directional lanes, all vehicles could drive on the section free of charge until the end of all construction work on May 20, 2012. On this day the toll was introduced on this section.

    particularities

    This 105.9 kilometer section is the largest infrastructure project in Poland and one of the largest infrastructure projects in Europe, most of which was built by a construction company in a record time of around 17 months and with the new technology of exposed aggregate concrete slabs as a road surface. According to estimates, the road surface with this technology will be preserved for 40 years without modernization. A total of 11.2 million tons of materials, including around 4.5 million tons of aggregate and 6.8 million tons of sand , were used. Around 2500 construction workers from Strabag or subcontractors were hired over the entire construction period. In addition, 76 bridge structures were built, including 31 over the motorway and 19 along the roadways, six rest areas, two motorway maintenance depots, five toll stations and six motorway junctions. In addition, a quarter of the construction costs were spent on environmental protection. 13  green bridges , 150 passages for smaller animals and 10.5 kilometers of noise protection walls were built.

    Nowy Tomyśl - Konin Zachód

    This 149.2-kilometer section runs from the Nowy Tomyśl junction to the Konin Zachód junction. Until 2037, the corporation's Autostrada Wielkopolska SA as a concessionaire to operate the highway section in charge. Therefore, the section is subject to tolls for all vehicles except for the section between the Poznań Zachód and Poznań Wschód nodes (~ 27 km; Poznań bypass ).

    Planning and construction as Olimpijka

    The section was planned as part of the Olimpijka during the time of the People's Republic of Poland in the 1970s . Due to the economic crisis, only two sections were realized and opened in Poland. The first, 34.2 kilometers long section between the Września and Sługocin nodes was built in 1977 and 1985 and opened on October 9, 1985. The second, 13.8 km long section from the Sługocin junction to the Konin Zachód junction (formerly Modła) was built from 1986 to 1989 and opened to traffic on November 10, 1988.

    Modernization or new construction as A2

    In 1997, the concession agreement was signed with the Autostrada Wielkopolska SA company to complete and operate this section. At the same time, the modernization of the parts from the times of the People's Republic of Poland and the new construction of the missing parts should take place. Overall, all construction work on the entire section was carried out in six years between 1998 and 2004. The construction costs amounted to 638 million euros. The investment was divided into five parts:

    • The construction of the western part of the piece from the node Nowy Tomyśl to the node Poznań Komorniki (50.4 km) was carried out in the years 2002 to 2004. The section was opened on October 27 of 2004. Just one week after the opening, the toll for all vehicles in the open system was introduced on November 3, 2004 on the route from the Nowy Tomyśl node to the Poznań Zachód node. In 2012 the Buk node was converted . It was equipped with two connecting ramps and a toll station so that the toll can be paid in a closed system from April 23, 2012 . The route from the Poznań Zachód junction to the Poznań Krzesiny junction is part of the southern Poznań bypass and is therefore toll-free for all vehicles.
    • The construction of the next section between the Poznań Komorniki and Poznań Krzesiny (13.3 km) nodes began in 1998 and was completed in 2003. The section was opened to traffic on September 13, 2003. As early as 1998, the section was set as a toll-free section in the concession due to its function as a southern bypass of Poznan. The widening of the motorway to three lanes per lane began in 2019. This should be completed in mid-2020 [obsolete] .
    • Construction of the next, 37.5-kilometer-long section between the Poznań Krzesiny and Września nodes began in 2002. The line was completed the next year and opened on November 27, 2003. The route from the Poznań Krzesiny junction to the Poznań Wschód junction is part of the southern Poznań bypass and is therefore toll-free for all vehicles. The remainder of the section from the Poznań Wschód junction to the Września junction is subject to tolls for all vehicles with the motorway section to the Lądek toll station in the open system. The toll was introduced on December 1, 2003.
    • The two eastern sections between the Września and Sługocin nodes (34.2 km) and Sługocin and Konin Zachód (formerly Modła) (13.8 km), which were planned and built as part of the Olimpijka during the time of the People's Republic of Poland Modernized from 2001 to 2002 and completely opened again on December 20, 2002. The route from the Września junction to the Lądek toll booth is subject to tolls for all vehicles in the open system. The toll was introduced on December 1, 2003. The remainder of the route from the Lądek toll station to the Konin Zachód junction is toll-free due to the need to adapt the previous route to the closed system.

    Konin Zachód - Stryków

    This 103-kilometer section, operated by GDDKiA , runs from the Konin Zachód junction to the Stryków junction and is equipped with two lanes per lane. This section was built within 22 months from 2004 to 2006 and opened to traffic on July 26, 2006. The construction costs of 401.4 million euros were borne by the European Union to 81% (325.3 million euros) . The construction of the section was divided into five stages, which were carried out by different construction companies:

    • The first and second stages comprised the sections from the Konin Zachód node to the Koło node (~ 29 km) and from the Koło node to the Dąbie node (~ 17 km). The construction contracts between the Austro-Portuguese consortia consisting of Strabag , Hermann Kirchner (only second stage) and Mota-Engil and the Polish Ministry of Transport were signed on July 28, 2004. The construction costs amounted to 83 million euros for the first stage and 94 million euros for the second stage.
    • The third and fourth stages comprised the sections from the Dąbie node to the Wartkowice node (~ 17 km) and from the Wartkowice node to the Emilia node (~ 23 km). The construction contracts between the Polish-Spanish consortia consisting of Budimex Dromex SA and Ferrovial Agroman SA and the Polish Ministry of Transport were signed on July 28, 2004. The construction costs for the third stage amounted to 47 million euros and for the fourth stage 62 million euros.
    • The fifth stage covered the section from the Emilia node to the Stryków node (~ 18 km). The construction contract between the Austrian-Polish consortium consisting of Hermann Kirchner, Strabag and PRM Mosty Łódź SA and the Polish Ministry of Transport was signed on July 28, 2004. The construction costs amounted to 52 million euros.

    In the period from November 14, 2008 to the end of 2010, the section for the toll introduction was prepared; it took place u. a. the construction of toll booths. The cost was 379 million zlotys . The toll was introduced on July 1, 2011 for all vehicles. The viaTOLL system was introduced for trucks ; for cars, the toll was paid at the toll booths. Since June 1, 2012 it has also been possible to pay tolls for cars via the viaTOLL system with the help of the viaAUTO toll device .

    Stryków - Łódź Północ

    This 1.7-kilometer section between the Stryków and Łódź Północ nodes was implemented in 2008 as part of the Stryków bypass at the time, to enable truck traffic to be removed from the city. In addition to this section of the A2, the first connecting ramp of the Łódź Północ motorway junction planned at the time was built, as well as the western lane of the A1, which was also planned at the time, as a connection to the national road 14 near Stryków. The approximately five-kilometer bypass cost over 190 million zlotys and was opened on December 22, 2008.

    Łódź Północ

    The 2.5 kilometer long section of the A2 was built as part of the motorway junction and opened on June 3, 2012 with the commissioning of subsection A and part of subsection B of the east adjoining section leading to Warsaw .

    According to the GDDKiA's initial plans , construction of the entire section from Lodz to Warsaw should begin between 2006 and 2007. Completion should take place in 2008. On July 26, 2006, then Minister of Transport, Jerzy Polaczek , announced that the selection of the concessionaire for the construction, operation and financing would end at the end of 2006 ; construction would begin between the third and fourth quarter of 2007 and would be completed by the end of 2010 at the latest.

    In the next plans, the GDDKiA considered the realization as a public-private partnership . The state should provide the basis for the companies, but private companies should provide the financing and realization of the investment. According to experts, construction should not begin before spring 2009 and construction should not end in 2011. In February 2009, the GDDKiA announced that the financial terms proposed by the two consortia, Autostrada Południe SA and Autostrada Mazowsze SA, who were fighting for the investment, did not secure the public interest. Thus, the plans for the realization as a public-private partnership were ended by the Minister of Transport. Now the state should implement the entire section again.

    For faster implementation, the section has been divided into five subsections. The tenders began on March 27, 2009. The contracts with the companies and consortia were signed on September 28, 2009. The construction project and construction should be completed within 32 months, so that a handover of traffic was planned before the 2012 European Football Championship . The official start of construction with the groundbreaking ceremony took place on July 14, 2010.

    Subsection A

    This subsection runs for a length of 29.2 kilometers from the Łódź Północ motorway junction to kilometer 394.5 of the A2. In a tender, a Sino-Polish consortium led by the China Overseas Engineering Group (COVEC) with three partners was awarded the contract. The construction costs were put at 755 million zlotys and amounted to 44% of the construction costs estimated by the investor of around 1.7 billion zlotys. It is for this reason that European construction companies filed a formal complaint. It was complained that the consortium could not implement the project and make a profit at this low cost. Eventually the protest was dismissed.

    After the completion of the project planning, the building permit was granted on August 21, 2010. However, there were difficulties in carrying out the construction work. The acquisition of subcontractors and suppliers on the desired terms turned out to be difficult. After construction work began in autumn 2010, the consortium began to have financial problems in spring 2011. Construction stopped at the beginning of May 2011 because many Chinese workers had stayed in China after a vacation break and payments from the subcontractors were not made. On May 20, the consortium announced that the claims would be settled by the end of May and that the construction work would continue on contractual terms. However, construction work was not started. The consortium illegally demanded that the construction costs be increased by one billion zlotys, after which the GDDKiA terminated the construction contract with the consortium on June 13th. This decision became final on June 27th. The GDDKiA thereupon demanded the payment of the contractually stipulated compensation in the amount of 10% of the contract value, which for both subsections A and C together totaled 130 million zloty. Of this, PLN 13 million was deposited with Deutsche Bank , which paid it out immediately, and PLN 117 million with the Chinese banks Bank of China and Import Export Bank of China, which refused to pay out at the request of COVEC. The Warsaw District Court upheld a lawsuit brought by GDDKiA for payment of PLN 140 million in compensation and damages. COVEC appealed and filed lawsuits against GDDKiA in Chinese courts. Initially, the GDDKiA refused to take legal action in the Chinese courts, and eventually rented a law firm there. After the People's Court of China upheld a lawsuit by COVEC regarding the blocking of payments, the GDDKiA appealed the judgment to the Chinese Supreme Court on June 18, 2012. The GDDKiA also demanded the payment of debts to the Polish subcontractors in the amount of PLN 106 million and payment of all other costs in connection with the late completion of the motorway in the amount of PLN 550 million. By the beginning of 2015, the Chinese banks transferred the compensation amounting to PLN 129 million. The Foreign and Infrastructure Ministries are now to negotiate further contractual penalties on behalf of the GDDKiA. In July 2017, an agreement between GDDKiA and COVEC was announced, which was concluded on May 19, 2017 and meant the end of all ongoing legal proceedings. All mutual claims were regulated in the agreement, the content remained confidential.

    After the termination of the contract with COVEC, 26 European construction companies were invited to talks to continue and complete the construction of this section. Due to the completion by the European Football Championship 2012, no tender was made, but the contractual terms were determined in talks. On July 28, 2011 the contract was signed with a consortium consisting of the French construction company Eurovia and the Polish company Warbud. The construction costs were set at PLN 989 million.

    On June 3, 2012, the section was provisionally navigable. The maximum speed was set at 70 km / h, and traffic was restricted to passenger cars under 3.5 tons and coaches until September 5, because traffic was carried on the binder course . After the European Championships, the completion of the section began. For this purpose, the top layer was first applied to the northern carriageway, which was closed to traffic. This lane was opened to traffic on September 5, 2012. Then the production of the last asphalt layer on the southern carriageway began. This and all other construction work, including the installation of the noise barriers, was completed on October 15, 2012 as contractually agreed.

    Subsection B

    Subsection B comprises the A2 motorway between kilometers 394.6 and 411.5 over a length of 16.9 kilometers. The construction contract with the Polish-Portuguese consortium consisting of Mostostal Warszawa SA as leader and Acciona infrastructuras SA and Polimex-Mostostal SA as partner was signed on September 28, 2009. The construction costs amounted to 844 million zlotys. The building permit was granted on August 21, 2010. On June 3, 2012, the 2.8 km long section was opened together with subsection A to the Skierniewice junction . On June 6, 2012, the remaining 14.1 kilometers long section was opened to traffic together with the entire subsection C and a section of subsection D. The traffic from lorries and passenger cars over 3.5 tons was diverted from the motorway from the Skierniewice junction until September 5, 2012, as subsection A to the west was closed to these vehicles. After completion, the consortium brought legal action against the GDDKiA. The Warsaw District Court rejected a request for additional compensation for the increase in asphalt and fuel prices in the amount of PLN 36.9 million due to the lack of a basis for increasing the compensation. The consortium appealed. At the end of 2016, the Warsaw District Court upheld another lawsuit after the payment of remuneration for completed construction work, which the GDDKiA had withheld due to its own claim to payment of a contractual penalty. The judgment became final at the end of April 2017. The GDDKiA was obliged to pay a total of 29.12 million zlotys with interest.

    Subsection C

    This subsection leads over a length of 20 kilometers between the kilometers 411.5 and 431.5. It includes the Wiskitki node at Żyrardów . In a tender, a Sino-Polish consortium led by the China Overseas Engineering Group (COVEC) with three partners was awarded the contract. The construction costs were put at 535 million zlotys. This was 49% of the construction costs estimated by the investor of around PLN 1.1 billion. During the construction phase, which began with the building permit on October 14, 2010, the same problems as with Subsection A arose . The GDDKiA canceled the construction contract on June 13th due to the consortium's guilt. This decision became final on June 27th.

    Instead of a new tender, 26 European construction companies were invited to talks to continue and complete the construction of this section. The construction contract between GDDKiA and a consortium led by the Polish company Dolnośląskie Surowce Skalne (DSS) was signed on August 1st, 2011. In addition to DSS, the Czech subsidiary Bögl a Krýsl ks and the Polish subsidiary Bögl a Krysl Polska sp. z oo of the German parent company Max Bögl are further members of the consortium. The construction costs amounted to PLN 756 million. The Polish company DSS was previously responsible as a subcontractor for the delivery of the aggregate under the contract with COVEC and was thus also affected by unpaid invoices from COVEC. This had a negative impact on the company's liquidity. Due to high mobilization costs, a fast construction speed, which caused additional costs, unexpected and strong price increases for basic materials and services (asphalt, fuel, transport and delivery services), difficulties with an unexpected reorganization of the board after the death of the chairman and company founder worsened the situation, so that after only a few months the new board announced a loss of 34 million zloty. In order to avoid further losses and to resume the already stalled construction work, the company handed over a large part of the planned construction work in the consortium to the Bögl a Krysl group, so that the latter took over the management of the consortium from January 13, 2012. Due to the increasing financial difficulties, the Polish company DSS left the consortium in March 2012. It filed for bankruptcy in early April. Now the construction and all obligations have been taken over by the Bögl a Krysl group. The construction work was accelerated to such an extent within 2.5 months that the section was open to traffic by the time the European football championship took place at the beginning of June. For this purpose, 700 additional employees were temporarily employed in a three- shift service around the clock. For example, with the help of the parent company Max Bögl , the paving of the surface course with an 11-meter-wide asphalt paver was completed within around two weeks and completed on June 5, 2012 after several night-time work. The next day, the entire section was provisionally opened to traffic together with parts of subsections B and D. The additional construction work was pre-financed by loans and should be repaid by GDDKiA after payment of the remuneration. Furthermore, it became known that after the insolvency of DSS, all business relationships within the consortium were discontinued and a loan of 45 million zloty made by Bögl a Krysl to DSS could not be reclaimed.

    After the European Championship, the construction work should be completed by October 15, 2012 according to the contract. However, due to the concentration on the A1 section between the Kutno Północ and Kutno Wschód junctions , the construction work could not be completed on time. The GDDKiA did not agree to a postponement and listed penalties for it. The GDDKiA imposed further penalties for defects resulting from the speed of the construction work. The owner of the group of companies, Josef Krysl, said that the Polish construction company DSS was responsible for the delays and deficiencies and that the Bögl a Krysl group ran into financial difficulties even after both investments had ended, with the risk of bankruptcy. In addition, the GDDKiA and its civil engineers stopped working after the handover, although the cooperation with the Polish subcontractors had previously gone very well.

    After the section of the A1 had been handed over to traffic, construction work was not resumed. In May 2013, the group filed an application for mediation in court because of the GDDKiA's request for a fine to be paid. Final negotiations between the group and the GDDKiA should be held at the end of June 2013. These were postponed due to the death of the Group's CEO responsible for the construction contract. Overall, the total value of the fines imposed by the GDDKiA for the two construction contracts (A1 and A2) rose to 100 million zloty by the end of September 2013. The GDDKiA already made use of the bank guarantees (6 million zlotys) deposited by the company and demanded an immediate resumption of construction work in further negotiations. During the negotiations, Josef Krysl insisted that the penalties be canceled before the rest of the construction work can begin and be completed within a month and a half. Further applications from the company are analyzed by the GDDKiA. After failed negotiations, the Bögl a Krysl group initially withdrew from the contract on November 14, 2014, before the GDDKiA terminated the contract on November 19 due to the group's guilt. According to the GDDKiA, Bögl a Krysl had no right to terminate the contract, as the request to remedy defects during the guarantee period does not constitute a reason for termination. The GDDKiA itself saw in the attempt to terminate the intention that the companies no longer want to eliminate the defects during the guarantee period despite repeated requests and that cooperation and the completion of the construction work is no longer wanted. The GDDKiA continued to insist that all companies within the consortium were jointly and severally responsible for the implementation of the signed contract and that loans or cash flows between the consortium members should be viewed as an internal matter and not in the GDDKiA's area of ​​interest. Furthermore, GDDKiA withheld part of the agreed remuneration of PLN 756 million and increased the penalties for construction delays and defects to PLN 320 million. Unpaid subcontractors filed for bankruptcy of the group in court in Prague. Josef Krysl announced a lawsuit against the GDDKiA in early 2015.

    According to the GDDKiA's plans, the remaining construction work should now be completed by new companies in several stages by the end of 2017.

    Subsection D.

    Subsection D comprises the A2 motorway between kilometers 431.5 and 449.1 over a length of 17.6 kilometers. The construction contract with the Austrian-Polish-Portuguese consortium, consisting of Strabag as Leader and Mota-Engil SA and Mota-Engil Engenharia e Construção SA as partner, was signed on September 28, 2009. The construction costs amounted to 644 million zlotys. The building permit was granted on August 12, 2010. On May 27, 2012, the 10.3-kilometer section was opened together with a section of subsection E to the Grodzisk Mazowiecki junction . On June 6, 2012, the remaining 7.3 kilometers long section was opened to traffic together with the entire subsection C and a section of subsection B.

    Subsection E

    Subsection E comprises the motorway section of the A2 from kilometer 449.1 and the Konotopa junction near Warsaw over a length of 7.1 kilometers. The construction contract with the Polish-Spanish consortium consisting of Budimex SA and Ferrovial Agroman was signed on September 28, 2009. The construction costs amounted to 426 million zlotys. The building permit was granted on October 5, 2010. On May 23, 2012, the 4.8 kilometer section between the Pruszków and Konotopa junction and the connection to the S8 expressway was opened. On May 27, 2012, the remaining 2.3-kilometer section west of the Pruszków junction together with a section of subsection D was opened to traffic.

    Warszawa Lubelska - Mińsk Mazowiecki

    This 14.8 km long section connects the Warszawa Lubelska junction east of Warsaw, where the S2 expressway from Warsaw meets the S17 expressway and merges into the A2 after the intersection, with the Mińsk Mazowiecki bypass, which is around 2 kilometers west of the junction through a provisional crossing of national road 2 near the village of Choszczówka Stojecka .

    Mińsk Mazowiecki bypass

    The 21-kilometer route begins near a former provisional roundabout with state roads  2 and  92 in the village of Choszczówka Stojecka and ends at the Kałuszyn junction (formerly Ryczołek), where it also crosses state roads 2 and 92. It serves as a bypass around Mińsk Mazowiecki and will remain toll-free until the western section to the Warsaw Lubelska junction is completed.

    On July 9, 2009, the contract for the construction of the section was signed between GDDKiA and a consortium consisting of the Polish construction company Przedsiębiorstwo Budowy Dróg i Mostów Sp. Z oo Mińsk Mazowiecki as leader and the Italian company Astaldi SpA as partner. Completion should take place by the end of July 2012. The construction costs were set at 567 million zlotys. The official start of construction took place on August 24, 2009. The completion date could not be met. The last work, including the installation of the noise barriers, could not be carried out. Ultimately, this work was completed with a one-month delay by August 29, 2012, and the section could be opened on that day.

    Kałuszyn - Siedlce Zachód

    This 37.5 km long route is intended to connect the eastern end of the Mińsk Mazowiecki bypass at the Kałuszyn junction with the town of Sielce (Siedlce Zachód junction) and thus extend the A2 to Siedlce. From the Kałuszyn junction, the motorway will curve around the city of the same name from west to east and cross the existing state road 2 in the east at Groszki . In the further course to Gręzów, the A2 will run north of the state road and meet the state road at Gręzów west of Siedlce. The city will bypass the A2 from the south, whereby it will run parallel to the state road. The motorway will have two lanes, each consisting of two lanes and the option of adding a third lane.

    The planning began at the end of 2007 with the preparation of the basic technical, economic and ecological documents that were required to maintain the environmental impact decision. This decision was received by the regional environmental agency at the end of 2011. After the Ministry of Transport announced that it had agreed to finance further planning and construction in the amount of around 1.7 billion zlotys in mid-2017, planning was resumed with the preparation of the program concept at the beginning of 2018. A schedule was set for completion by the end of 2023. For the tender, the entire section was divided into three subsections:

    • Kałuszyn junction - Groszki junction (12.1 km)

    Siedlce Zachód - Biała Podlaska

    This 63.5 km long route leads from Siedlce (Siedlce Zachód junction) to the Biała Podlaska junction north of the existing national road 2 . The motorway will have two lanes, each consisting of two lanes and the option of adding a third lane.

    The planning began at the end of 2007 with the preparation of the basic technical, economic and ecological documents that were required to maintain the environmental impact decision. This decision was received by the regional environmental agency at the end of 2011. After the Ministry of Transport announced that it had promised to finance further planning and construction in the amount of approx. 3 billion złoty at the beginning of 2018, planning was resumed with the preparation of the program concept in mid-2018. A schedule was set for completion by the end of 2024.

    Biała Podlaska - PL / BY state border

    This 32.1 km long route runs from the Biała Podlaska junction to the state border near Kukuryki / Brest . The A2 will initially run along the existing national road 2 to Dobryń . At Dobryń the route branches off from national road 2 and is led along national road 68 to the border crossing, where there is a connection to the M1 . The motorway will have two lanes, each consisting of two lanes and the option of adding a third lane.

    The planning began at the end of 2007 with the preparation of the basic technical, economic and ecological documents that were required to maintain the environmental impact decision. This decision was received by the regional environmental agency at the end of 2011. After the Ministry of Transport announced the funding commitment for further planning and construction in the amount of around 1.5 billion złoty in mid-2018, planning was resumed with the development of the program concept at the beginning of 2019. Completion was targeted for 2025, so that the entire A2 would be passable from the German to the Belarusian border.
